RESOLUTION 2014-77
RESOLUTION APPROVING A SITE PLAN REVIEW
FOR FEZ JON AT 22 HAMEL ROAD
WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and
existing under the laws of Minnesota; and
WHEREAS, Fez Jon (the "Applicant") owns approximately 0.6 acres of property within
the City located at 22 Hamel Road ("the Property") and legally described in Exhibit A, which is
attached thereto; and
WHEREAS, the Applicant has made an application for a site plan review for the
construction of an eight unit apartment building and detached garage on the Property; and
WHEREAS, the Planning Commission reviewed the application on August 12, 2014 and
September 16, 2014 and recommended approval to the City Council, subject to certain terms and
conditions; and
WHEREAS, the City Council reviewed the application at the October 7, 2014 meeting
and reviewed the recommendation of the Planning Commission and city staff report and attached
materials; and
WHEREAS, the City Council makes the following findings of fact for the Site Plan:
1. The proposed plan is consistent with the requirements of the Uptown Hame1-2 District.
2. The proposed structure is generally consistent with the architectural standards for
buildings within the Uptown Hame1-2 District.
3. The proposed plan is consistent with the Comprehensive Plan.
NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota
hereby approves the proposed Site Plan with the following conditions:
1. The Applicant shall provide a right-of-way easement for the sidewalk and the portion of
Hamel Road not included within platted right-of-way.
2. A tree replacement plan shall be provided for review and approval by City Staff.
3. The landscaping plan shall be revised to meet the minimum standards of the Zoning
Ordinance and shall be approved by City Staff prior to the issuance of any permits. The
plan shall replace the tree in the parking lot island with a substantial landscaping feature
,that is appropriate for an island.
4. All construction shall conform to the minimum standards of the Zoning District.

5. The detached garage shall meet the building standards for the Zoning District.
6. All comments by the City Engineer shall be addressed.
7. The Applicant shall provide an 8 foot drainage and utility easement along the eastern
edge of the property.
8. The fiber cement board siding shall be chestnut brown in color as recommended by the
Planning Commission.
9. The Applicant shall enter into a Development Agreement and provide Letters of Credit in
the amount specified in the agreement prior to the issuance of any permits.
10. This approval shall be valid for a period of one year from the date of this action.
11. All fees incurred by the City regarding the processing and review of this application shall
be paid by the Applicant.

and upon vote being taken thereon, the following voted in favor thereof:
Anderson, Martin, Martinson, Pederson, Weir
And the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.
