RESOLUTION ~ - 2003
A RESOLUTION AUTHORIZING
AN INTRA-AGENCY LEASE AGREEMENT BETWEEN RP&L AND THE
CITY OF RICHMOND'S FIRE AND POLICE DEPARTMENTS
WHEREAS, Richmond Power & Light (RP&L) currently owns a parcel of vacant ground
containing approximately 4.5 acres located just west of Rom ark Industries in the
1700 block of South 8th Street, Richmond, Indiana; and
WHEREAS, there exists next to such vacant ground other vacant ground currently owned by
Charline Wilder containing approximately .92 acres; and
WHEREAS, the City of Richmond's Fire and Police Departments are in need of space upon
which to erect a fire and police training facility; and
WHEREAS, Ms. Wilder has expressed a desire to donate her property to the City of Richmond
if used for the purpose of a fire and police training facility, which donation would
be made in honor and memory of her deceased husband, Arch Wilder; and
WHEREAS, RP&L is not currently using it's above described property and is willing to enter
into an intra-agency agreement according to the terms and conditions contained
herein.
NOW, THEREFORE, BE IT RESOLVED, by the Richmond Power and Light Board of
Directors that an intra-agency lease agreement be drafted between RP&L and the City of
Richmond's Police and Fire Departments, regarding the use of the above described RP&L
property, which terms in such lease shall include the following:
1. The Fire and Police Departments shall utilize the above ground solely for the
purpose of erecting a police and fire training facility thereon.
2. The responsibility for maintenance and upkeep upon such property shall be with
the City of Richmond through its Fire and Police Departments.
3. The sole consideration for the "lease" of such property shall be the 'Fire and Police
Department's responsibility for maintenance and upkeep.
4. The term of this agreement shall be for a period often (10) years; provided, that if
RP&L needs the property for any purpose relating to its utility purposes, the term may be
terminated prior to such time with at least one (I) year's prior notice to the Police and Fire
Departments. Further, at the termination of the lease agreement for any purpose, the
responsibility for removing any structures erected thereon shall be with the City of Richmond
through its Police and Fire Departments.
5. The Police and Fire Departments shall have an option to renew this agreement for
two (2) additional terms often (10) years each according to the same terms and conditions
contained herein; provided, that RP&L does not require the property for any utility purposes at
such time.
