RESOLUTION N0. 393 IN TH� MATTER OF ACQUISITION AND IPdPROVEP�NT DISTRICT PdO. 4 OF THE CITY OF ZYNW00D �LSOZUTIOSZ ORD�RING ISSUANCE OF BONDS TO OBT9IN INID�DIATi, POSSESSION. WHEREAS: in a resolution adopted by the Board of Trustees, now known as the City Council of the City of Zyn�ood on the lst day of 8'ebruary, 1927, the acquisition oY lands required for the opening, widening and extension of Peach Street and Norton Avenue in the City of Lynwood as proposed in the Resolution of Intention in the above entitled matter adopted on the 14th day o£ December, 1926, was ordered and the City Attorney of the City of Lynwood was directed to bring an action for the condemnation of the property necessary therefor and to report to this Board of Trustees, now known as the Cou.ncil oY the City of Lynwood, the amounts of money required for the purpose of obtaining immediate possession and use of the property so ordered to be acquired, upon com- plying with the requirements of the law applicable �hereto; and 49HEREAS: said City Attorney, on the 6th day of J eptember, 1927, reported to this Board of Trustees, now known as the -- Council, thst an action in eminent doman had been filed in the Superior Court, said action being entitled "City of Lynwood, a Municipal Corporation, Plaintiff, vs. Louisa Meredity DRcClure, et al, Defendants", being SuperiorCourt Case No. 228821, and that proof was presented to said Court of the amou.nts of money adequate to secure to the owners of property sought to be con- demned and of any estate therein, the im.mediate payment of juat aompensation as soon as the same can be ascertained according to law, and that the said Court made an order directing the deposit oP money to aecure such payment of compensation to the de£endants in said action, and that the total amount required £or deposit in court in order to obtain immediate possession o£ said pro- perty as aet forth in said order of Court is the sum oY Twenty Thousand Sig Hundred Fifty-five Dollars ��p20, 655.00); and WHr.REA5: at its meeting held on the 6th day of September, 1927, the Board oY Trustees, now„known as Council oY eaid City figed a dsy, hour and place for a hearing upon the issuanee of bonds against the lands in the assessment district in Acquisition and Improvement vistrict No, 4 0£ City of Lynwood for the purpose of obtaining the amou.nts required by the Court, to-wit, amounts totaling the sum of Twenty 7}housand Sig Hundred Fifty-Pive Dollars ��'20,655,00), in order that immediat� posaession and use of the public ways sought to be acquired under the proceedinga in the above entitled matter may be had, and £or the purpose of flzrnishing an opportunity to all persons owning lands within said assessment district, or otherwise interested, to be heard, and in said resolution directed that the Clerk ,� � . ��> of this Boa.rd of Trustees, now known as the Councily^ give notice of said hearing in the manner required by Section 28 of the "Acquisition and Improvement Act oP 1925^; and G�REAS: it appears from af£idavits on file in the office of the Clerk o£ this Board of Trustees, now known as Council, that notice of said hearing, in the manner and Yorm required by law, has been regularly posted and published in accordance with the requirements of Section 28 of said Act; and this ia the ti:me and place heretofore Piged for said hearing and the matter has been fully heard and a:.�.i11, Yair and impartial hearing has been accorded to all objections presented, and evidence has been received upon the question oP the necessity for the issuance of said bonds and the sufficiency of the proceedings heretofore had and taken in the above entitled matter; �OiV, T�� FFORE, BE IT I2ESOZVED by the Board of Trustees, � now known as the City Council of the City of Lynwood, that it is hereby fourid, determined and ordered as follows, to-wit: 1. That the public interest and convenience require that the City of Zynwood, a Municipal Corporation, Plaintiff in the suit eminent doman entitled "City of Zynvuood, a Municipal Corporation,,Pla.intiff vs. Louisa �eredith McClure, et al, Defendants", being Superior Court Case No, 228821, taken . im.mediate possession and use of the property�therein sought to be acquired, � - 2. That notice of the day, hour and place of the hearing upon the question of the issuance of the bonds for the purpose - QP ob�sining such immediate possession has been regularly posted and published in the manner required by law. 3, That all of the acts, determinations and proceedings heretofore had and taken in the matter of 6cquisition and Improvoment District No. 4 of the City oP Zynwood are regular and in aTl respects sufficient, and that all protests and objections to the iesuance of said bonds, and to any of the acts, determinations or proceedings heretofore had and taken are hereby overruled and denied, 4. That the public necessity and convenience require, snd it ia hereby ordered,�that bonds oY the said:,:District shall be issued in the total sum of Twent� Thousand Six Hundred FiYty- five Dollars ��20,655.00), for the purpose of obtaining the necessary amounts to deposit in court in order that immediate poasession and use of the lands sought to be acquired may be had, and that the City Treasurer of the City of Lynwood, is hereby ordered to issue bonds 'oY the said District, designated "Series A=A", in the said aggregate principal sum, dated the day this resolution ie adopted, all in the manner and form provided in the ^Acquisition and Improvement Act of 1925", and in further accordance with the provisions for such bonds contained in the Resolution of Intention adopted in the matter of said Acquisition and Improvement District by this Board of Trnstees, now known as the City Council, on the 14th day of December, 1926. 5: That the Clerk of this Bo�,rd of Trustees, now knovcn as the Council, shall forthevith transmit to said City Treasurer, � an attested copy of this resolution and order, together with an . � .. ...a.. . . . � • . . � attested copy of said �esolution of Intention 2 hereby certify that the foregoing resolution was adopted by the Board o�.Trustees, riow kriown as the City - • Council oP the City of Lynwood, at,an Adjourned Regular , � meeting held on the 20th da y of September, 1927; by the following vote of the members thereof: ' ` 9yes: Tr ustees - Tweedy,Skelton,,Murray and Greenamyer , Noes: None .. .
