CALL TO ORDER
The Council "Brown Bag" Work Session of January 16, 2004, was convened at 12:00 P.M.
by President Pro Tempore Cliff Olsen in the absence of Mayor John Landwehr.
ATTENDANCE
The following Council Members were present when the meeting convened:
Present: Angle, Berry ( *arrived 12:05 PM), Ferguson, Gordon, Groner, Klindt,
and Olsen
Absent: Viessman, Vogel, and Weber
A quorum was present.
DISCUSSION OF AGENDA ITEMS
Items were not necessarily discussed in order that they appeared on the agenda.
PUBLIC HEARINGS
Councilman Richard Groner asked questions about the vote on the Tanner Bridge Road
rezoning, and wanted to know specifically how 5 -A related to 16 -A in the associated
documents. City PlannerJanice McMillan explained itwas the same thing. Councilman Dan
Klindt also explained what had occurred in the Planning & Zoning Commission meeting on
this issue. Councilman Clyde Angle asked about the negative vote at the Planning &Zoning
meeting. He was concerned that the residents didn't understand what the developers were
doing. Councilman Cliff Olsen stated maybe this could be sent back for Planning & Zoning
to expand on. City Planner Janice McMillan explained it is a concept plan and not a final
plan and there is an opportunity to make some recommendations back to the Planning &
Zoning Commission. The Council asked City Counselor Nathan Nickolaus to find out if the
Council could send it back with recommendations.
CONSENT AGENDA
Councilman Cliff Olsen stated that City Clerk Phyllis Powell had handed out a new page 4
of the January 5 City Council Minutes which contained a correction to a typo. He asked the
Council to substitute that corrected page in their packets.

Councilman Richard Groner wanted to know if anyone else had asked to be on the
University Extension Council besides the person being recommended for reappointment.
City Administrator Rich Mays stated that others had applied.
BILLS INTRODUCED
2003 -161: Councilman Darren Gordon asked who had requested this parking change. Matt
Morasch stated that Immaculate Conception Church had requested it due to a sight
distance problem with the traffic pulling out onto the street there. He also answered
Councilman Richard Groner's question about how long the no parking zone would be.
2003 -162: City Administrator Rich Mays stated that he had not communicated that
Councilman Cliff Olsen had agreed to be the primary sponsor of this bill and asked the City
Clerk to make the necessary correction to indicate that.
BILLS PENDING:
2003 -156 and 2003 -157: Councilman Michael Berry asked if these two bills could be
moved up to final reading and vote right after the related public hearings so that citizens
who came with an interest in them would not have to stay so long. The Council did not have
a problem with his request, and Councilman Cliff Olsen asked someone on the staff to
inform Mayor John Landwehr of the request so that he could consider it Monday night.
2003 -160: Councilman Clyde Angle asked if someone was going to clarify the final
certification date at the meeting. City Counselor Nathan Nickolaus stated he would do so.
Councilman Angle asked if Councilman Cliff Olsen, as the sponsor of the bill, would
consider withdrawing it. Councilman Cliff Olsen stated that Councilman Viessman was out
of town until after the January 27 ballot certification date, and that Mr. Viessman had stated
he would vote fora bill which had a referendum clause in it. Councilman Clyde Angle stated
he is concerned because the public had not had enough previous notice as they had with
the other versions and he felt the public would be extremely disadvantaged. He stated that
the bill in its current format would serve no purpose if passed. Councilman Richard Groner
stated the bill served a purpose because he is running for re- election and he is "hung out
to dry" because he has given his word and stated he is for banning smoking and would
support this bill because of his position on the issue of second hand smoke.
City Administrator Rich Mays stated that since the bill was not introduced at one of the
televised City Council meetings, he would ask City Counselor Nathan Nickolaus to talk
about the bill and what it entailed for the benefit of the public.
No official actions were taken since this was a work session only.
