HomeMy Public PortalAbout20040503REGULAR COUNCIL MEETING MAY 3, 2004 CALL TO ORDER The Regular Council Meeting of May 3, 2004, was convened at 6:00 P.M. by Mayor John Landwehr. ROLL CAL The following Council Members were present for the roll call: Present: Berry, Brown, Crane, Ferguson, Harvey, Martin, Patterson, Viessman, Vogel and Weber Absent: None A quorum was declared present. Mayor John Landwehr stated that Girl Scout Troop 107 were running the television cameras at tonight's meeting and thanked them for their help. ITEMS TAKEN UP OUT OF ORDER Mayor John Landwehr stated that unless the Council objected, he would like to move the Lewis & Clark presentation up on the agenda so the presenter can leave to attend another function. There were no objections Mr. Bill Stine, appeared in costume as "Pvt. John Potts" who was the only German immigrant on the Lewis and Clark Expedition. Mr. Stine read from the journal of Pvt. Potts. Following his presentation, Ms. Sandra Coffin of the Missouri River Quilt Guild invited citizens to attend the Lewis & Clark Quilt Show on June 5 & 6 at Lewis & Clark Middle School. SELECTION OF PLANNING & ZONING REPRESENTATIVE & ALTERNATE Councilman Roy Viessman made a motion that Kevin Brown be elected as Representative and Dean Martin be elected as Alternate, seconded by Councilman Bob Weber and approved unanimously. PUBLIC HEARINGS Annexation of Dent Property, 618 Schumate Chapel Road (Pending Bill 2004 -4). City Planner Janice McMillan gave the background details of the proposed annexation. REGULAR COUNCIL MEETING MAY 3, 2004 Following her presentation, no one present requested to speak in favor of, or opposition to, the proposed voluntary annexation. Mayor John Landwehr declared the public hearing concluded. Mayor John Landwehr stated that the Council had expressed a desire to take up Bill 2004- 4, which corresponds to this public hearing, immediately following the public hearing. Bill 2004 -4, sponsored by Councilman Viessman, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE VOLUNTARY ANNEXATION OF 45 ACRES OF REAL PROPERTY CONTIGUOUS TO AND LYING WEST OF THE PRESENT CITY LIMITS INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED WEST OF SHAWN DRIVE AND NORTH OF SCHUMATE CHAPEL ROAD IN THE NORTHEAST QUARTERAND THE SOUTHEAST QUARTER OF SECTION 33, TOWNSHIP 45 NORTH, RANGE 12 WEST, IN COLE COUNTY, STATE OF MISSOURI, AND REPEALING SECTION 1 -17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY AND ENACTING A NEW SECTION PERTAINING TO THE SAME SUBJECT. Bill 2004 -4 was read third time by title, placed on final passage and passed by the following roll -call vote as Ordinance 13715: Aye: Berry, Brown, Crane, Ferguson, Harvey, Martin, Patterson, Viessman, Vogel and Weber Nay: None MINUTES AND REPORTS RECEIVED AND FILED Mayor John Landwehr announced that the following minutes and reports have been received and are on file and may be reviewed in the City Clerk's office: a. 2003 Missouri River Regional Library Audit Report (entire audit not copied due to size and bound format, available for reviewed in City Clerk's office) CVB - Athletic Events Committee, March 17, 2004; Governing Board, March 23, 2004 c. Board of Electrical Examiners & Review, October 8, 2003 COUNCIL LIAISON REPORTS There were no reports made at this time. REGULAR COUNCIL MEETING MAY 3, 2004 ANNOUNCEMENTS OF OTHER UPCOMING MEETING AND EVENTS Councilman Bill Patterson announced several upcoming events in connection with Heritage Week, and invited citizens to participate in those events. Kevin Brown announced that the Letter Carriers' Food Drive will occur this upcoming Saturday, May 8, and encouraged citizens to participate. APPOINTMENTS BY THE MAYOR Mayor John Landwehr recommend the following appointments to the Jefferson City Police Department: a. Police Officer: Kelly Messerli, Michele LaFleur, & Curtis Bohanan b. Police Telecommunications Operator: Shawn Gerstner A motion was made by Councilman Bob Weber to approve those appointments, seconded by Councilman Kenneth Ferguson and approved unanimously. Mayor Landwehr recommended the approval of the following Police promotion: a. Promotion to Police Sergeant: Deric Heislen A motion was made by Councilman Roy Viessman to approve the promotion, seconded by Councilman Michael Berry and approved unanimously. Those persons appointed and promoted were present at the meeting for introduction to the City Council, and Mayor John Landwehr congratulated the employees. Mayor John Landwehr recommended the following appointments to City Council committees and liaisons to boards and commissions: COUNCIL COMMITTEES Annexation & Growth Committee (5 members): Berry, Crane, Ferguson, Martin, Weber Appointments Review Committee (5 members): Brown, Crane, Ferguson, Viessman, Vogel Conference / Convention Center Committee (5 members): Brown, Harvey, Patterson, Viessman, Vogel Environmental Services Committee (5 members): Berry, Harvey, Martin, Patterson, Weber Finance Committee: all ten Council Members Public Works & Planning Committee: all ten Council Members REGULAR COUNCIL MEETING MAY 3, 2004 A motion was made by Councilman Bob Weber for approval of the appointments to Council Committees as recommended, seconded by Councilman Roy Viessman and approved unanimously. PRESENTATIONS FROM STAFF, CONSULTANTS & INVITED GUESTS Roger Schwartze and Nichole Kolb Hood, Missouri Department of Transportation, made a presentation regarding recent additions of equipment which will improve traffic flow on Whitton Expressway / Hwy. 50. Following the presentation, several questions were asked by Council Members regarding various intersections and future plans for further improvements. Several Council Members suggested it would be beneficial to add barriers between the lanes at certain locations to prevent injury or death to motorists from oncoming traffic in the event of an accident. Ms. Donna Cavitte, Missouri's Commission on Human Rights, introduced thirteen year old REGULAR COUNCIL MEETING MAY 3, 2004 Christine Ricana, a student at Thomas Jefferson Middle School in Jefferson City. Ms. Ricana recently won the first annual statewide poster contest sponsored by the Commission. Her poster was displayed, and the Mayor and City Council congratulated Ms. Ricana for this outstanding achievement. Councilman Kevin Brown mentioned that he noticed some Boy Scouts enter the Council Chambers. Mayor John Landwehr invited them to introduce themselves, after which he welcomed Don Hillos and his two sons from Boy Scout Troop 2 of First Presbyterian Church. They are attending the meeting to earn their Citizenship in the Community badge. PRESENTATIONS FROM THE GALLERY There were no presentations from the gallery made at this time. BIDS OVER $25,000 The following bid over $25,000 was presented to the Council for the approval: a. Bid 2121 - Uniform Rental A motion was made by Councilman Roy Viessman for approval of the bid as presented, seconded by Councilman Brian Crane and approved unanimously. Councilman Bob Weber requested that the rules be suspended so that Bill 2004 -12 can be placed on final passage. There were no objections to the request to suspend the rules. NEW BUSINESS Amending 2004 -2005 Council Meeting Schedule to accommodate July 4 holiday. A motion was made by Councilman Bob Weber to approve the amendment, seconded by Councilman Roy Viessman and approved unanimously. Mayor Landwehr announced that he would address the council at the next meeting pursuant to Section 4.4 of the Charter UNFINISH ED BUSINESS Mayor John Landwehr announced that he had asked City Clerk Phyllis Powell to establish a "reference library" of city reports and studies to be kept in a location accessible to the public. He reported that the shelf to house the library is in place, and encouraged departments to submit those substantive reports which they would like included, and encouraged citizens to utilize the library. Councilman Michael Berry stated that he recently read a newspaper article which named Lafayette Street as the main artery to access the redeveloped prison site, and he believes that is incorrect since no decision has been made yet regarding the access. GO INTO CLOSED SESSION Mayor John Landwehr stated that, pursuant to Sec. 610.021 of the Revised Statutes of Missouri, the Chair would entertain a motion to go into Closed session to discuss the following: REGULAR COUNCIL MEETING MAY 3, 2004 Legal Actions [Sec. 610.021.(1)] Real Estate [Sec. 610.021.(2)] A motion was made by Councilman Kevin Brown to go into Closed Session, seconded by Councilman Kenneth Ferguson and approved unanimously by the following roll -call vote at 7:30 PM: Aye: Berry, Brown, Crane, Ferguson, Harvey, Martin, Patterson, Viessman, Vogel and Weber Nay: None
