WORKSHOP MEETING - JANUARY 28, 1992
A workshop meeting of the Bal Harbour Village Council was held
on Wednesday, January 28, 1992 in the Council Chamber at Bal
Harbour Village Hall. The meeting was called to order at 4:13 p.m.
by Mayor Stern. The roll was called and those present were:

Assistant Mayor Andrew R. Hirschl
Councilman Matthew B. Blank
Councilman James E. Boggess'
Councilman Sol M. Taplin
Also present: Carole S. Morris, Village Manager
Jeanette Horton, Village Clerk
Richard Jay Weiss, Village Attorney
As a quorum was determined to be present, the meeting
commenced.
2. Review of Quarterly Financial Report: Mrs. Morris
prefaced this review by stating that overall the financial status
is sound. One item of concern is the sewer treatment expense and
this matter is being reviewed with Robert Wheldon to determine
whether this is a billing problem or an operational problem, as
gallonage/usage has accelerated as much as 50%.
Councilman Taplin expressed concern relative to insurance
payments. Mrs. Morris explained that these are one-time payments
for the year and will not occur every quarter.
Mrs. Morris then confirmed with Council that this format of
presentation was as they desired. Assistant Mayor Hirschl
requested that the previous year's figures be included with each
quarter's review for comparison.
3. Other Business: Mr. Weiss reported to Council that the
Police union employees ratified the PBA Contract 17-1.
In addition, at Council's request, he, Mrs. Morris and
Assistant Mayor Hirschl met with Mr. Olsen and Mr. Riso relative to
the Architectural Review Board. He explained that the Civic
'Councilman Boggess arrived at 4:35 p.m.

Association would be willing to forego enforcing their restrictive
covenants and file a document to that effect with the Clerk of the
Court if one of the following two scenarios were adhered to:
Scenario One: The Architectural Review Board would be
comprised of five members - two appointed by the Council, two
nominated by the Civic Association and one chosen by the four
members. In the event Council did not agree with the two
nominations by the Civic Association, they could reject same and
request other nominations.
Scenario Two: The formation of two Architectural Review
Boards - one for the residential district and one for the remainder
of the Village. The five members of the Board relative to the
residential district could be appointed by the Village Council from
the residential area and perhaps under nomination by the Civic
Association.
After discussion, it was Council's decision that the
Architectural Review Board be structured as outlined in Scenario
One. It was determined that the two members nominated by the Civic
Association could, but need not be residents, but Architects or
Landscape Architects.
Mayor Stern brought to Council's attention that as a part of
the Quincentennial Celebration, three ships will be docking at the
Port of Miami on February 15 with several thousand boat escorts and
subsequently dock at Bayside two weeks for public tours. She
encouraged all to participate, as this opportunity comes only once
every 500 years.
Assistant Mayor Hirschl then questioned the Village's
liability relative to a home under construction in the residential
security district where construction had ceased and possible
hazardous conditions existed. It was determined that no liability
existed on the part of the Village.
4. Adiourn: A motion to adjourn was offered by Councilman
Taplin and seconded by Assistant Mayor Hirschl. There being no
further business to come before Council, the motion carried
unanimously (5-0) and the meeting adjourned at 4:55- p.m.
