CALL TO ORDER
The Regular Council Meeting of June 7, 2004, was convened at 6:00 P.M. by Mayor John
Landwehr.
ROLL CAL
The following Council Members were present for the roll call:
Present: Berry, Brown, Crane, Ferguson Harvey, Martin, Viessman, Vogel and
Weber
Absent: Patterson
A quorum was declared present.
Prayer was offered by Councilman Kevin Brown, which included a call for a moment of
silence in memory of President Ronald Reagan who passed away this week, following by
the Pledge of Allegiance.
PUBLIC HEARINGS
a. Rezoning & Associated Comprehensive Plan Amendment for 1033 & 1037 South
Country Club Drive
City Planner Janice McMillan gave a report on behalf of staff detailing the background of
the request for the rezoning. Following her presentation, the following persons requested
to speak in favor of, or in opposition to, the proposed rezoning:
In favor:
Susan Moore and Joe Distler, 33302 Mount Hope Road, California, MO, the applicants,
stated their support of their application.
No one present spoke in opposition.
Mayor John Landwehr declared the public hearing in this matter concluded, and stated that
the Council wished to take up the bill which corresponds to this public hearing at this time.

AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF
JEFFERSON, BY REZONING 0.88 ACRES FROM RS -2 SINGLE - FAMILY RESIDENTIAL
TO RD MEDIUM DENSITY RESIDENTIAL ATTACHED FOR PROPERTY LOCATED AT 1 033 AND

Bill 2004 -13 was read third time by title, placed on final passage and passed by the
following roll -call vote as Ordinance 13722:

ANNOUNCEMENTS OF OTHER UPCOMING MEETING AND EVENTS
Mayor John Landwehr announced how citizens may use the recycling program for their
outdated telephone books.
APPOINTMENTS BY THE MAYOR
Mayor John Landwehr recommended the following appointments to the Council for
approval:
a. Council Liaison to Fire Fighter's Pension Board — Councilman Bill Patterson

A motion was made by Councilman Bob Weber for approval of the appointment as
recommended, seconded by Councilman Roy Viessman and approved unanimously.
PRESENTATIONS FROM STAFF, CONSULTANTS & INVITED GUESTS
There were no presentations made at this time.
PRESENTATIONS FROM THE GALLERY
Mr. Clyde Angle, 3618 W. Gordon Drive, distributed a handout and made a presentation
on behalf of Mothers Against Drunk Driving (MADD), and asked Mayor John Landwehr to
appoint a commission to address the issue of drunk driving.
CONSENT AGENDA
The following items were presented to the Council for their approval by Consent:

A motion was made by Councilman Michael Berry for approval of the Consent Agenda as
presented, seconded by Councilman Kenneth Ferguson, and approved unanimously.
BIDS OVER $25,000
The following bids over $25,000 were presented to the Council for their approval:
a. Bid 2142 - Light Bars, Police Dept. (sent to Council 5 -28)
b. Sole Source 2145 - Ticket Dispenser & Entry Gates (sent to Council 5 -10)
c. Bid 2149 - Mobile Lift System (sent to Council 5 -28)
Councilman Dean Martin made a motion to approve items (b) and (c), seconded by
Councilman Brian Crane and approved unanimously.
Councilman Bob Weber made a motion to amend item (a) so that its approval is contingent
upon the enactment of Bill 2004 -23, seconded by Councilman Kevin Brown and approved
unanimously. Councilman Bob Weber then made a motion to approve item (a) as

amended, seconded by Councilman Michael Berry and approved unanimously.
BILLS INTRODUCED
Bill 2004 -15, sponsored by Councilmen WEBER, Martin, Berry, Brown, Crane, Harvey,
Patterson, Viessman, Vogel, entitled:
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, OPTING OUT OF THE
STATE SALES TAX HOLIDAY.
Mayor John Landwehr asked Finance Director Steve Schlueter to explain if the city opts
out, how much of a sales tax holiday would still be in effect. Mr. Schlueter stated that the
state's 4.225% sales tax amount will still be waived if the city opts out of the holiday. Mr.
Schlueter and City Administrator Rich Mays answered several questions about this
particular issue, and Mr. Mays indicated he would get a current list to the Council of other
cities in Missouri who are also opting out.

Mayor John Landwehr asked Chalie Lansford, Assistant Director of Community
Development, to give a brief report on this issue since it only comes up every ten years. Mr.
Lansford reported on the amount of savings and the services negotiated between the city
and the contractor on solid waste services for at least the next five years. He answered
questions asked by Council Members about landfills, recycling, etc.

Bill 2004 -14 was read third time by title and placed on final passage. A motion was made
by Councilman Kevin Brown to accept the substitute Bill 2004 -14 which was distributed
earlier by City Counselor Nathan Nickolaus, seconded by Councilman Brian Crane, and
approved unanimously. Bill 2004 -14 was then passed, as substituted, by the following roll -
call vote as Ordinance 13723:

INFORMAL CALENDAR

Councilman Vogel requested that bill 2004 -11 remain on the Informal Calendar at this time.
SCHEDULED REPORTS
Mayor John Landwehr announced that "Scheduled Reports" will be a new category which
will appear on every agenda to list any reports which have been scheduled for a future time.
He indicated it will help affected persons or departments keep track of when they are
expected to make those reports.
Councilman Edith Vogel made an illustrated presentation regarding flag etiquette and
answered questions about the proper methods to display, recognize, and dispose of retired
flags. Following her presentation, Mayor John Landwehr stated that if citizens wish to retire
a flag but cannot get it to the VFW post for appropriate retirement, they can get it to City
Hall and staff will make sure it gets to the VFW for them. He thanked Councilman Vogel for
her informative presentation.
NEW BUSINESS
There was no New Business brought forward at this time.
UNFINISHED BUSINESS
Councilman Kevin Brown stated he wished to state, in light of the presentation made earlier
regarding traffic safety, stress that staff, the Missouri Department of Transportation and
public safety agencies have been doing everything possible to help address the issue of
safety on Highway 50, but stated that the public is going to have to obey the speed limits
for accidents to decrease.
Councilman Kenneth Ferguson stated that he did not believe Mr. Angle made remarks
about safety, but rather DWI offenses, and agreed with Mr. Angle that it would be a good
idea for the Mayor to appoint a committee to address that issue. Mayor John Landwehr
asked the City Council to think about the matter, and also to think of a purpose for such a
committee before one is appointed and get back to him with their thoughts on the matter.
Councilman Dean Martin asked Fire Chief Robert Rennick to give an update on the Fire
Summer School held in Jefferson City over the past weekend, to which Chief Rennick
responded by making a brief report.
Councilman Edith Vogel commended persons who have worked so diligently to make the

recent Lewis and Clark festivities a great success, and especially former Councilman Carol
Blaney. She stated she learned much from the presentations which were made at the last
several Council Meetings and thanked the Task Force for making those.
APPROVAL OF CLOSED SESSION MINUTES
Closed Session Minutes of May 17, 2004: A motion was made by Councilman Bob Weber
for approval, seconded by Councilman Brian Crane and approved unanimously.

Mayor John Landwehr stated that, pursuant to Sec. 610.021 of the Revised Statutes of
Missouri, the Chair would entertain a motion to go into Closed session to discuss the

A motion was made by Councilman Kevin Brown to go into Closed Session, seconded by
