HomeMy Public PortalAbout2015-025 Resolution Approving Variance and Site Plan John Day CompaniesMember Martin introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION 2015-25 RESOLUTION APPROVING VARIANCE AND SITE PLAN REVIEW FOR JOHN DAY COMPANIES TO EXPAND THE PARKING LOT AT 695-765 TOWER DRIVE WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, Glen Lincoln Partners (the "Applicant"), owns property located at 695-765 Tower Drive (the "Property"), which is legally described in Exhibit A, attached hereto; and WHEREAS, the Applicant has requested a variance to reduce the front parking setback from 25 feet to 13 feet and has also requested approval of a site plan review in order to expand the parking lot on the Property; and WHEREAS, the Planning Commission reviewed the requested variance and site plan at a duly noticed public meeting January 13, 2015 and recommended approval; and WHEREAS, the City Council held a public hearing on the requested variance and reviewed the request at the February 3, 2015 meeting and reviewed the request again at the March 17, 2015 meeting; and WHEREAS, based on the written and oral record before the Planning Commission and City Council on the above dates as well as all additional testimony submitted to the City, the City Council makes the following findings of facts in regards to the variance request: 1. The proposed variance is consistent with the Comprehensive Plan and in harmony with the general purposes and intent of the Zoning Ordinance, subject to the conditions noted below. 2. The Applicant proposes to put the Property to a reasonable use which is permitted in the district. 3. The plight of the Applicant is due to limited amount of parking which was constructed on the Property, which was approved by the City but which has proven to be inadequate based upon changing parking needs related to the allowed uses on the Property. The plight of the Applicant is relatively unique to property on which the parking needs of uses have changed over time and has not been created by the landowner. 5. The proposed variances do not confer special privileges which are not afforded to owners of other lands, structures, or buildings in the same district and will not alter the essential character of the neighborhood. 6. The Applicant has established that there are practical difficulties in complying with the requirements of the Zoning Ordinance. NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota hereby approves a variance to reduce the front parking setback from 25 feet to 13 feet. BE IT FURTHER RESOLVED, that the City Council of Medina, Minnesota also hereby approves the Site Plan Review. BE IT FURTHER RESOLVED that the approvals granted herein shall be subject to the following terms and conditions: 1) The Applicant shall submit final construction plans for review and approval by the City Engineer. The construction plans shall include a grading plan which shall depict the grading on the subject site related to the reconstruction of Tower Drive. 2) The Applicant shall install a sump catch basin in order 'to capture sediment from the hardcover on the site. The Applicant shall enter into a stormwater maintenance agreement with the City related to maintenance of the catch basin. 3) The Applicant shall install replacement trees as landscaping as described on the plans received by the City on January 8, 2015 and January 9, 2015. The Applicant shall submit a financial guarantee for the landscaping as required by City Code. 4) The Applicant shall utilize the variance within one year of approval, or the variance shall be considered null and void. 5) The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the variance, site plan review, and other relevant documents.
