Invitation to Bid: Fuel Depot Facility
The Office of the Town Administrator for the Town of Brewster, Massachusetts will
receive sealed Bids for the construction of the Fuel Depot Facility until 11:00 a.m. prevailing
time, on Monday April 1, 2019 in the Town Administrator’s Office, Brewster Town Hall, 2198
Main St., Brewster, MA 02631, at which place and time said Bids will be publicly opened and
read aloud.
The project consists of, but is not limited to, furnishing and installation of one (1) 10,000
gallon, split compartment aboveground storage tank (AST). The tank shall be split such as to
accommodate 4,000 gallons of diesel fuel and 6,000 gallons of gasoline. Tank shall be protected
type, double wall steel with secondary containment, vehicle impact protection, and projectile
resistance. Construction shall include furnishing and installing associated fuel piping, vent piping,
vent caps, stage I vapor recovery, dispenser, and all materials and accessories necessary to make a
complete installation ready for use. Work will also include construction of new standby generator,
reinforced concrete pads, paved access road, and other site improvements.
Specifications and bid forms may be obtained at the Office of the Town Administrator
Monday through Friday between 8:30 a.m. and 4:00 p.m. or by email request to Donna Kalinick,
Procurement Officer, dkalinick@brewster-ma.gov.
Pre-Bid Conference and Site Visit will be held at Brewster Recycle Center located at 201
Run Hill Rd., on Friday March 15, 2019 at 10:00 a.m. It is imperative that all prospective
bidders have a representative in attendance.
General Bids must be submitted on prescribed forms, enclosed in a sealed envelope bearing
on the outside the bidder’s name and address, and designated as the “Bid for Fuel Depot Facility”.
Each Bid must be accompanied by a bid security consisting of a BID BOND, CASH, or,
CERTIFIED CHECK issued by a responsible bank or trust company in the amount of 5% of the
bid price.
Successful General bidder must furnish 100 percent Construction Performance Bond and
100 percent Construction Payment Bond.
Every bid bond, every performance bond and every payment bond issued for any
construction work in the Commonwealth shall be the bond of a surety company organized pursuant
to section 105 of chapter 175 or of a surety company authorized to do business in the
Commonwealth under the provisions of section 106 of said chapter 175 and be approved by the
U.S. Department of Treasury and are acceptable as sureties and reinsurers on federal bonds under
Title 31 of the United States Code, sections 9304 to 9308.
All bids for this project are subject to applicable public bidding laws of Massachusetts,
including, but not limited to G.L. c.30, §39M.
Contract substantial completion time shall be 128 calendar days commencing from the date of
Notice to Proceed.
Attention is directed to the minimum wage rates to be paid as determined by the
Commissioner of Labor and Workforce Development and the weekly payroll record submittal
requirements under the provisions of Massachusetts General Laws, Chapter 149, Section 26
through 27D inclusive.
Materials and supplies used or incorporated in the performance of this contract are exempt
from sales and use tax.
Selection of the contractor will be based upon bidder qualifications, including evidence
of past performance in similar projects, and bid price. The contract will be awarded to the bidder
deemed by the awarding authority to be the lowest responsible and eligible bidder.
The bidder agrees that its bid shall be good and may not be withdrawn for a period of 60
days, Saturdays, Sundays and legal holidays excluded, after the opening of the bids.
The Town reserves the right to waive any informalities, to accept or reject, in whole or in
part any or all bids, or take whatever other action may be deemed to be in the best interest of the
Town.
