It is understood that if this permit is granted the builder will at all times comply with the zoning, subdivision, flood control, building, fire,
soil and sedimentation, wetlands, marshlands protection and shore protection ordinances and codes whether local, state or federal, including
all environmental laws and regulations when applicable, subsequent owners should be informed that any alterations to the property must be

Yes Jonathan —very similar. The court cases have all held that the law must be construed in favor of a
property owners free use of their property & if ambiguity exist, it must be resolved in favor of the
property owner. That is what courts are required to do when confronted with ambiguous land use
regulations & although the opposing position can be argued, in my view if the issue can be resolved
by resorting to the legal rule to be applied to the situation, we might as well go with it at this stage
than have a court direct us to many dollars down the road. We do however have to watch out for folks
trying to create ambiguities where one does not exist. I think this situation is ambiguous in light of the
front interpretation issues as you know.

For clarification, this type of ambiguity would be to the benefit of the property owner similar to the tie going to the

They way the code has been interpreted in the past with regard to the "front" I think there is certainly
a gray area on this one in particular considering the issue of what would be the front of lot 9 -B. It
cannot realistically be anything except the driveway & this makes the argument that the front of 9 -A
also the easement/ driveway stronger. Although it is not without logical arguments all the way around,
I think the ambiguity goes to the property owner as the general rule would likely control if this matter
were to be litigated.
This is definitely an area of the code that needs clarification. I think one way to help would be to
require all plats to include a reference to the "front" of the structure or lot. I am sure there are issues
doing that but it may help .Incidentally, when a duplex lot is built on a suitable lot & then subdivided,
the plat is to reflect that the lot is only suitable for duplex construction . I assume that legend is still
being placed on the plats.

Just to do my diligence and get your opinion of this issue attached is a letter from Jeff Cramer regarding a proposed pool
variance to allow the pool in what I have determined to be the front yard of the property. After this matter was
recommended to be denied by Planning Commission last week, Jeff Cramer has decided to make this argument in the
attached letter.
Can you please weigh in on this matter at your convenience? I could be way off base with my interpretation but I think
that I am right on.
