CALL TO ORDER: Pursuant to Agenda posted on March 31, 1989, Mayor Swain called the meeting of the City Council to order at 7:30 P.M. on Tuesday, April 4, 1989. 2. The invocation was given by Pastor Douglas Edwards, Westminster Presbyterian Church, 9642 East Live Oak Avenue. 3. The Pledge of Allegiance to the Flag was led by Mayor Swain. 4. ROLL CALL: Present: Councilmen Atkins, Breazeal, Gillanders and Swain Absent: None Also Present: City Manager Koski, City Attorney Martin, Community Development Directors Dawson, Public Works Coordinator Peterson, Parks & Recreation Director Kobett, Special Coun- sel Parrington, Temple City Times Staff Writer Estrada, Pacesetter Staff Writer Holtzclaw and SGV Tribune Staff Writer Medve. 5. CONSENT CALENDAR: Councilman Gillanders requested Item D be removed from the Consent Calendar. On motion by Councilman Atkins, seconded by Councilman Breazeal, the remainder of the Consent Calendar was approved as presented. A. APPROVAL OF MINUTES - Regular Meeting of March 21, 1989. Council approved as written. B. RECOMMENDATION FROM THE PARKS & RECREATION COMMISSION REGULAR MEETING OF MARCH 15, 1989 - REQUEST FOR USE OF LIVE OAK PARK BY TEMPLE CITY CAMPFIRE GIRLS. Council approved the use of Live Oak Park by the Temple City Campfire Girls on Sunday October 29th from 6:00 A.M. to 1:30 P.M. for their annual Pancake Breakfast subject to the required Certificate of Insurance and adherence to established rules for use of the Park. MUNICIPAL CODE AMENDMENT: ORD. 89 -647 (2ND READING) ESTABLISHING A TRANSIENT OCCUPANCY TAX - Council waived further reading and adopted Ordinance No. 89 -647, AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING A NEW PART D TO CHAPTER 3 OF ARTICLE 5 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO A TRANSIENT OCCUPANCY TAX. E. TEMPORARY BANNER PERMIT: FIRST LUTHERAN CHURCH AND SCHOOL APRIL 24, THROUGH MAY 1, 1989 - Council approved First Lutheran Church's request to hang a temporary banner across Temple City Blvd. and Las Tunas Drive intersection from April 24, through May 1, 1989 to promote their annual festival, subject to the required Certificate of Insurance. F. PLANNING COMMISSION ACTIONS FROM THEIR REGULAR MEETING OF MARCH 28, 1989 - Council received and filed. G. RESOLUTION NO. 89 -2848 - APPOINTMENT OF PERSONNEL - Council adopted Resolution No. 89 -2848 approving the employment of budgeted personnel. H. RESOLUTION NO. 89 -2849: APPROVAL OF PAYMENT OF BILLS - Council adopted Resolution No. 89 -2849 allowing Warrants and Demands in the amount of $271,611.56. D. AUTHORIZATION OF TRAVEL EXPENSES TO SACRAMENTO - Councilman Gillanders requested a clarification on what they were approving. Was it a request for blanket ap- proval for Councilmembers representing the City before a legislative committee or just a blanket approval for Councilmembers traveling to Sacramento on City business? He did not want unlimited approval for any purpose other than representation before a legislative committee. He suggested a phone call survey of Council would be ade- quate for other City business travel to Sacramento. Councilman Gillanders moved to approve a standing travel authorization for City Councilmembers traveling to Sacramento to represent the City before a legislative committee and all other trips to Sacramento for City business to be subject to phone calls to Councilmembers; seconded by Councilman Atkins and unanimously approved. 1 1 1 1 1 1 City Council Minutes, April 4, 1989 - Page 3 6. UNFINISHED BUSINESS: A. PROPOSED DUES INCREASE - LOS ANGELES COUNTY DIVISION, LEAGUE OF CALIFORNIA CITIES - Mayor Swain indicated Council has received information relating to the dues schedule and proposed increase. It is recommended that this item be postponed until budget time. Councilman Breazeal again questioned the benefit received from the Los Angeles County Division of the League of California Cities. He would also like to see this item deferred until Council receives a copy of the League's budget. Councilman Atkins moved to defer this item until the 1989 -90 budget session and until they receive a copy of the League's budget substantiating this increase, sec- onded by Councilman Breazeal and unanimously carried. Mayor Swain, because of the anticipated time element involved in Item 7 A, took Item 9 out of sequential order on the Agenda. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: William Bretz, 8723 Hermosa Drive, San Gabriel, asked Council to look into the situation at the northwest corner of Rosemead Boulevard and Broadway. Mr. Bretz discussed the piles of dirt covered with plastic and the fact that the plastic is now gone and children are riding bicycles up and down the piles of dirt. Because they were originally covered with plastic, he was concerned there might be some hazardous substance involved. Mayor Swain asked Community Development Director Dawson to check out the site as requested. 7. NEW BUSINESS: A. JOINT PUBLIC HEARING: CITY COUNCIL AND THE COMMUNITY REDEVELOPMENT AGENCY ON THE PROPOSED DISPOSITION AND DEVELOPMENT AGREEMENT FOR THE SALE OF REAL PROPERTY IN THE ROSEMEAD BOULEVARD REDEVELOPMENT PROJECT TO CHAMPION DEVELOPMENT CO. City Council Minutes, April 4, 1989 - Page 4 RECESS TO JOINT PUBLIC HEARING WITH CRA: At 7:40 P.M. the City Council and the Community Redevelopment Agency held a joint public hearing on the proposed Disposi- tion and Development Agreement for the sale of real property in the Rosemead Boulevard Redevelopment Project to Champion/ - LBS Associates Development Company; Council /Agency adopted Resolutions 89 -2850 and CRA 359 making the necessary environ- mental findings for the proposed Disposition and Development Agreement and Resolutions 89 -2851 and CRA 360 approving the sale of real property pursuant to the proposed Disposition and Development Agreement. The Minutes of the joint meeting are set forth in full in the Agency's records. At 8:45 P.M. Chairman Swain called a short recess. CONVENE AS CRA At 8:55 P.M. the City Council met as the Temple City Commu- nity Redevelopment Agency; approved the Minutes of the regu- lar meeting of March 21, 1989 and adopted Resolution CRA 89 -358 allowing Warrants and Demands in the amount of $1,177.30. The Minutes of the Agency are set forth in full in the Agency's records. RECONVENE AS CITY COUNCIL 8. COMMUNICATIONS: None 10. ACTION ON REQUEST BY CRA: None 11. MATTERS FROM CITY OFFICIALS: A. SUMMARY OF JOINT STUDY SESSION - PLANNING COMMISSION/ - TRAFFIC COMMISSION HELD MARCH 28, 1989 - Councilman Gillanders, referring to staff's summary of the joint study session of the Planning Commission /Traf- fic Commission regarding driveways serving semi -sub- terannean parking, stated he considers this a step in the right direction. The whole idea of sub - terannean parking is a cheap way to get a third story. He objects to vehicles coming out of these sloped driveways because of the safety hazard to pedestrians. He also questioned the safety factor at night when there is almost no visibil- ity. Another safety factor to be considered is the fire hazard to all the bedrooms on the third floor. Sprin- klers have an effect but not on the third floor. He favored throwing the whole idea out rather than allowing this type of construction. 1 1 1 1 City Council Minutes, April 4, 1989 - Page 5 Councilman Breazeal said he was not aware of any of these problems being associated with the development on the corner of Temple City Boulevard and Broadway. Councilman Gillanders said the development on Broadway cannot be compared to the site on Cloverly. The Broadway driveway is much wider and affords better visibility. Councilman Atkins stated his disappointment with the joint study session's suggestions on the flag lot issue. He still feels they should be eliminated. He shares Councilman Gillanders' convictions on the semi- subterra- nean driveways and is beginning to think the reason these are occurring is too much density for the zoning. He suggested getting back to the General Plan and look at the density and why they have to build these subterranean driveways. The public made it very clear they wanted lower density. A permanent cure would be to take R -3 density down to where it would take away the desirability of this type of construction. Mayor Swain stated the density on R -3 zoning was lowered from 36 to 24 units per acre. She suggested it might be an opportune time to assign an ad hoc committee in the community to study the feelings on density and on the safety factors of subterranean driveways. Councilman Froehle asked if it was realistic to build this way taking into consideration the slope coupled with the height. Councilman Gillanders said costs go up drastically when you go to a third floor. There are different require- ments, including firewalls, etc. With the semi- subterra- nean construction, they are getting a three -story structure with two -story construction standards. Councilman Gillanders moved to hold a joint study session with the Planning Commission on the subject of density on Monday, April 10, 1989; seconded by Councilman Breazeal and unanimously carried. Councilman Atkins moved to add the subject of flag lots to the agenda for the study session with the Planning Commission on April 10, 1989; seconded by Councilman Breazeal and unanimously carried. City Council Minutes, April 4, 1989 - Page 6 Councilman Breazeal expressed his approval that a letter has been sent to County Counsel from City Attorney Martin questioning whether or not SCAG is legally constituted, whether it has sufficient number of members to meet its Charter, whether or not a quorum participated in the vote on the air pollution control plan and if the plan was passed by an Executive Committee, were they legally constituted with sufficient members present. Councilman Gillanders, referring to a letter from Pacific Legal Foundation to Chief Justice Lucas and Associate Justices of the State Supreme Court in support of the pending property tax litigation, felt this is the first written document by anybody that understands what is going on. He requested a letter of thanks be sent to PFL and expressed thanks to Councilmen Breazeal and Froehle who joined Council midstream in this case. He also expressed thanks to Councilman Atkins, Mayor Swain, Bill Dennis and the late Jack Tyrell for their support. Coun- cilman Gillanders then briefly explained to those present the current property tax situation and how it effects Temple City. The State Supreme Court refused to hear this case due to full calendar this session so it will go to Superior Court in San Bernardino. 12. ADJOURNMENT: On motion by Councilman Froehle, seconded by Councilman Atkins, the meeting of the City Council was adjourned at 9:30 P.M.
