THE CITY OF BEL AIRE, KANSAS
ORDINANCE NO. ;:( 9.2..
AN ORDINANCE CONCERNING THE DISCHARGE OF
CERTAIN TYPES OF WATER INTO THE SANITARY
SEWER SYSTEM; ESTABLISHING INSPECTION
PROCEDURES; ESTABLISHING CORRECTION
PROCEDURES; AND ESTABLISHING A
DISCONNECT/RECONNECT FEE.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE,
KANSAS:
Section 1. Discharae
No person shall, either directly or indirectly discharge into the sanitary
sewer system of the City of Bel Aire, Kansas any groundwater; surface water;
subsurface drainage water; roof, yard, court or areaway water; condensing
water from any refrigerating units having a capacity of over one ton; or any
water from any air conditioning unit having a capacity of over three tons.
Section 2. Sumps and Sump Pump Pits
No sump or sump pump pit may be connected to or discharged into the
sanitary sewer system of the City of Bel Aire, Kansas.

Section 3. Insoection
A representative of the City of Bel Aire, Kansas shall have the right and
privilege to enter upon any property connected, or to be connected, to the
sewer system of the City of Bel Aire, Kansas, within reasonable hours, for the
purpose of making inspections for the enforcement of this ordinance.
Section 4. Notice
Upon discovery of a violation of the provisions of this ordinance, the City
of Bel Aire, Kansas shall serve a notice to correct the violation within fifteen
(15) days of the date on the notice. Such notice shall be served upon the
sewer customer or occupant of the premises, personally or by registered mail.
Failure to correct the violation within fifteen (15) days as directed will result in
the disconnection of water and sewer service to the property found to be in
violation. Service shall not be reconnected until the violation is corrected and
a disconnect/reconnect fee of $20.00 has been paid.
Section 5. Hearing Process
Any person wishing to contest the notice to correct a violation has the
right to a hearing by the City Administrator. Such hearing must be requested
in writing and the request must be received at the Bel Aire City Hall, 4551 N.
Auburn, Bel Aire, Kansas, no later than three (3) working days prior to the
fifteen (15) day deadline for correction.
The decision of the City Administrator may be appealed to the City
Council. The appeal must be in writing and the appeal must be received at the
Bel Aire City Hall, 4551 N. Auburn, Bel Aire, Kansas, no later than three (3)
working days after the hearing by the City Administrator.
Section ,. Effective Date
This Ordinance shall be published once in the official city newspaper and
take effect and be in force from and after April 1, 1998.
