HomeMy Public PortalAboutMinutes - 1971/02/10 - Special" PARKING COMMISSION CITY OF TEMPLE CITY Special Meeting February 10, 1971 Chairman Armstrong called to order the special meeting of the Parking Commission on February 10, 1971, at 10:10 a.m. in Council Chambers of City Hall. Commissioner Clark led in the Pledge of Allegiance to the Flag. Roll Call: Present: Commissioners Clark, Millham, Nunamaker, Armstrong, Traffic Engineer Envall, Planning Director Dragicevich, Civil Engineering Assistant Linares, Public Works Absent: Commissioner Kettle It was moved by Commissioner Nunamaker, seconded by Commissioner Millham, and carried, to excuse the absence of Commissioner Kettle for cause. Purpose Chairman Armstrong stated that the special meeting was called for the purpose of reviewing a request from Mr. A. W. Driver, President of Driver Furniture Company, Inc., for use of parking spaces in Parking Lot No. 5, Parking District No. 3, and modifications to Mall 3, located behind the building at 9611 Las Tunas Drive. Applicant's Planning Director Dragicevich stated that Mr. Driver, Request in a letter dated January 21, 1971, addressed to the and Staff Report City Manager, requested that three parking spaces behind the building at 9611 Las Tunas Drive, in Lot No. 5, be modified from present marked parking stalls to a loading zone; that the existing tree within the three -stall area be moved easterly; and a ramp cut in the curb to correspond with the width of the existing loading door at the rear of the building; and that this be accomplished at the expense of the City. The reasons for the request as outlined in Mr. Driver's letter are that the loading zone is necessary to accommodate truck deliveries with large freight; tree relocation is necessary for full clearance for loading from the loading zone; the curb but is to accommodate " Driver's company vehicle ingress and egress into the loading ramp within the confines of the building. Mr. Dragicevich advised that all property owners and tenants in Parking District No. 3 had been informed of Mr. Driver's request and of the special hearing, in a notice mailed on January 27, 1971. Subsequent to this not i ce, a letter from Mr. Jere Martin, Free Travel Service, 9601 Las Tunas Drive, had been received, expressing opposition to the Driver request; and a petition signed by five property owners within Parking District 3 expressing opposition had also been received The Planning Director asked for a report from Traffic Engineer Envall relative to an investigation of the subject location by the Traffic Engineer and Staff members. " Mr. Envall reported that an on -site investigation indicated merchandise will have to be loaded to the mall sidewalk level as there is no loading dock at an elevation differential within the building itself; that two parking spaces would suffice for a commercial loading zone to be used by Driver Furniture Company and other businesses in the immediate area, which could be accomplished by the semi -truck and trailer jack- knifing their rig, blocking only one aiselway within the mall area; that removal of the tree within the two " " " PARKING COMMISSION MINUTES Staff Report Applicant's Presentation In Favor 0 pposed Applicant's " Additional Comments -2- FEBRUARY 10, 1971 parking space area is unnecessary. Summarizing these findings, Mr. Dragicevich stated that the Staff recommends to the Commission: (a) approval of two parking spaces behind the subject building for loading purposes, which may be used by Driver and other merchants in the immediate area; (b) the request for removal of curb and for providing a ramp be denied. Mr. A. W. Driver addressed the Commission stating that to allow the tree to remain in its present location would be dangerous as semi - trucks backing into the .building would knock the tree over, that it should be relocated one full space easterly. The subject building, which he owns, has an existing loading door so that small trucks can be taken into the storage area; that in his type of business there is a need to load smaller pickup trucks from the storage area within the building, as loading is done the night prior to deliveries; that it is essential to load from within the confines of the building during the rainy season; that the storage area is needed to house the small pickup truck; that for these reasons he was requesting a ramp. Traffic Engineer Envall asked the applicant if there was some modification within the dock area being planned as there is insufficient room to maneuver a small truck within the storage area because of the location of the platform which would leave the truck hanging out of the dock area. Mr. Driver replied he thought there was sufficient room for a pickup truck but that he would check the dimensions of the dock area. Chairman Armstrong invited those in the audience who wished to speak to address the Commission. Speaking in favor of Mr. Driver's request, Mr. Dominic Mortellaro, 9629 Las Tunas Drive, stated the merchants would like to have a successful business in town, that Mr. Driver's request for three parking stalls for use as a loading zone should be granted; that there would be no loss of parking stalls in Lot 5 if the planter and ramp in the center section of the lot was removed which would allow for three parking spaces; that, in his opinion, Mr. Driver should not be asked to pay for the modifications to the parking lot inasmuch as he had paid for his share of the mall when he purchased the building. Mr. Erwin Sokol, representing his father who is a property owner in Parking District No. 3, stated he had circulated the petition opposing Mr. Driver's request primarily because he felt that cutting into the curb in the mall would destroy the aesthetic value of the mall; and that he would not like to see the pedestrian walkway blocked in any way. However, after hearing Mr. Driver speak, he felt that the request for a loading zone for deliveries was legitimate for the furniture business in which Mr. Driver was engaged, and he was particularly favorable to a loading zone which could be used by other merchants within the immediate area. He advised the Commission he wished to go on record as withdrawing his opposition to Mr. Driver's request for the loading zone. At this time, Mr. Driver advised the Commission he would be willing to provide, at his expense, a removable ramp for his company truck to cross over the mall, and that access over the mall would be only for this lighter truck. PARKING COMMISSION MINUTES -3- FEBRUARY 10, 1971 Applicant's Referring to an article in a recent issue of the Los • Additional Angeles Times regarding the City's interest in Comments attracting new businesses to the community, Mr. Driver stated that the City should expect to make some con- cessions if it wishes to bring business to its doors; and inasmuch as he will be bringing a built -in clientele to Temple City he felt the cost to the City for placement of loading zone and relocating a tree is compar'itively small. Continuing, the applicant stated that he will continue to operate his store in Alhambra, that he has the option of either occupying his building at 9611 Las Tunas Drive if conditions are met, or of leasing the building. In conclusion, Mr. Driver stated he will not pay for the modifications to the parking lot which he is requesting. • • I n Favor of Applicant Commission Discussion Commissioner Nunamaker stated that new business is needed in the City but questioned if exception should be made for Mr. Driver relative to his request for modifications at the expense of the City, and that loss of parking spaces in this particular lot should be considered carefully because of the limited number of parking stalls at the present time. Mr. John Gates, Manager, Chamber of Commerce, stated that recent studies by an engineering firm of existing and projected use of this lot, showed that it was primarily used by all day parkers, employees and tenants of adjacent businesses, which could be controlled by enforcement of posted two -hour parking restrictions. He indicated that Mr. Driver's request for a loading zone would not affect any deficiency of available parking space; that the applicant should not have to pay for the modifications being requested because the City will recover any costs involved in the proposed modification through increased revenue from business generated from Driver's Furniture Company. Mr. Carl Ludlow, Stoppel's of California, 9615 Las Tunas Drive, spoke in support of Mr. Driver, concurring with statements made by Mr. Mortellaro. He noted that while furniture stores are not necessarily a "down town" type of business primarily because of delivery problems, and inasmuch as Mr. Driver has agreed to furnish his own portable ramp, he felt the City should agree to the other modifications, Emphasizing that he would not want to have the sidewalk area in the mall blocked for periods of time, or trucks parked all day in the loading zone which would block adjacent frontages, he felt Mr. Driver should be given the amount of space he needs for flexibility in the management of his business. Commissioner Millham stated that much time and monies had been expended by the merchants and the City to create the mall concept, and removing the sidewalk for ingress and egress to Mr. Driver's building would not lend itself to the mall concept, that a portable ramp would be more acceptable. Taking exception to the request for three spaces to be allocated as a loading zone, Mr. Miliham stated he favored only two spaces for this purpose, based on the Traffic Engineer's investigation and report. The Commission discussed each portion of Mr. Driver's request separately, taking into consideration all of the information and testimony which had been offered, with some disagreement about the amount of space required for the loading zone, and the City's responsi- bility for assuming the costs for the modifications. PARKING COMMISSION MINUTES -4— FEBRUARY 10, 1971 Commission Recommendation Time for Those in Audience to Speak Adjournment: Following Commissioner Millham's recommendation that two parking spaces be allocated as a loading zone, the motion dying for lack of a second, Commissioner Nunamaker moved to recommend to the City Council: (a) three public parking stalls behind the business located at 9611 Las Tunas Drive in Lot No. 5 of Parking District No. 3, be designated as a loading zone with marked time limits; (b) the existing tree in the mall within the three spaces be relocated at the City's discretion and expense; (c) the planter and ramp in the center of Lot No. 5 be removed and three stalls provided in this area; (d) access over the pedestrian . mall be granted to Mr. A. W. Driver, the applicant to furnish at his expense portable ramp over the pedestrian mall if he so desires; (e) the applicant accepts all liability for personal injury and for any damage done to public property. The motion was seconded by Commissioner Clark and carried by the following roll call vote: Ayes: Commissioners Armstrong, Clark, Nunamaker Noes: Commissioner Millham Commissioner Millham stated his only opposition to the motion was on the basis that he felt two parking stalls should be recommended for a loading zone, a third stall if it proved necessary. The Commission emphasized that only the smaller company owned truck would be permitted ingress and egress over the mall. Planning Director Dragicevich advised Mr. Driver that the Parking Commission recommendation would be con- sidered by the City Council at their regular meeting held on February 16, 1971. Mr. Dominic Mortellaro, 9629 Las Tunas Drive, thanked the Commission for their recommendation for use of public parking lots for the Children's Pet Zoo which was open to the public for a two -week period, reporting that it had been a successful undertaking. There being no further business, the meeting was adjourned at 11:35 a.m. to the next regular meeting on February 17, 1971, 3:00 p.m., at City Hall. ATTEST: City Clerk
