SUBJECT: ADOPTION OF RESOLUTION NO. 18-5362 APPROVING AND
ADOPTING THE RECERTIFIED AND NEW ENGINEERING AND
TRAFFIC SURVEYS AND RECOMMENDED SPEED LIMITS
RECOMMENDATION:
The City Council is requested to adopt Resolution No. 18-5362 , approving and adopting
the recertified and new Engineering and Traffic Surveys and recommended speed
limits.
BACKGROUND:
1. In April 2010, the City's Traffic Engineer completed a new Engineering and Traffic
Survey (Survey) and recommended posted speed limits .
2 . On August 3, 2010 , the City Council approved and adopted the Survey and
recommended speed limits.
3. On February 5, 2018, Transtech Engineers, Inc. (Transtech) evaluated the City's
Survey and determined that no significant changes in roadway or traffic conditions
have occurred on 24 street segments and certified the Survey (Attachment "B").
4. On March 22 , 2018, Transtech completed a new Survey on 13 street segments
and recommended speed limits (Attachment "C").
ANALYSIS:
Sections 22357 and 22358 of the California Vehicle Code (CVC) authorize local
authorities to establish prima facie speed limits on streets and roads under their
jurisdiction. Prima facie speed limits are specific limits stated in the CVC or specific

limits established on the basis of an engineering and traffic survey authorized by the
eve .
Sections 40801 and 40802 of the CVC require that engineering and traffic surveys
support the prima facie speed limit before speed limits can be enforced by radar. The
law specifies that surveys be conducted every seven (7) years to ensure that posted
speed limits are kept reasonably current. If a registered engineer determines that no
significant changes in roadway or traffic conditions have occurred , the survey applies
for 10 years.
The Engineering and Traffic Surveys were evaluated and conducted , by Transtech, in
strict compliance with guidelines obtained from the CVC and the California Manual of
Uniform Traffic Control Devices. The table below depicts the proposed changes to
speed limits in the City:

This item does not have an impact on the Fiscal Year (FY) 2018 -19 City Budget. The
surveys were completed during FY 2017-18.

RESOLUTION NO. 18-5362
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY APPROVING AND ADOPTING THE ENGINEERING AND TRAFFIC
SURVEYS AND RECOMMENDED SPEED LIMITS
WHEREAS, Pursuant to Sections 22357 and 22358 of the California Vehicle Code (CVC) local
authorities may establish prima facie speed limits on streets and roads under their jurisdiction; and
WHEREAS, Pursuant to Section 40802 of the eve an Engineering and Traffic Survey is valid for 10
years if evaluated and recertified by a Registered Engineer; and
WHEREAS, Pursuant to Sections 40801 and 40802 of the eve an Engineering and Traffic Survey
was conducted to establish prima facie speed limits on streets in the City of Temple City; and
WHEREAS, Section 627 of the eve defines the term engineering and traffic survey and lists the
requirements deemed necessary by the Department of Transportation; and
WHEREAS, the Engineering and Traffic Surveys were evaluated and conducted by the City's Traffic
Engineer, in strict compliance with the guidelines obtained from the CVC and the California Manual of
Uniform Traffic Control Devices.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Temple City approves
and adopts the Engineering and Traffic Surveys and recommended speed limits.
PASSED, APPROVED, AND ADOPTED on this 18th day of September 2018.

that th e spee d of a vehicle may be calculated by sec urin g the time it takes the ve hicle to tr avel the known distance.
(2) A particular sec ti on of a highway with a prima facie speed limit that is provided by this code or by local ordinance under paragraph (1)
of subdivision (b) of Section 22352, or established under Section 22354, 22357, 22358, or 22358.3, if that prima facie speed limit is
not jus tified by an engineer ing and traffic survey conducted within five years prior to the date of the alleged violation, and enforcement
of the speed limit involves the use of rad ar or any other elec tronic device that measures the speed of moving objects. Th is paragraph
does not apply to a local street, roa d, or school zone.
(1) For purposes of this section, a local street or road is one that is functionall y classified as "local" on the "Cal ifornia Road Sys tem
Maps ," that are approved by the Fede ral Hi ghway Admin istration and maintai ned by th e De partment of Transportation. When a street
or road does not appear on the "California Road System Maps," it may be defined as a "local stree t or road " if it primari ly provide s
access to abuttin g res idential property and mee ts the fo ll owi ng three condi tion s:
(A) Roadway width of not more than 40 fe et.
(B) Not more than one-half of a mile of uninterrupted lengt h. Interrupt ions sha ll include officia l traffic co ntro l signa ls as defined in
Secti on 445.
(C) Not more than one traffic lane in each dire ction.
(2) For purposes of this sec tion, "school zone" me ans that area approaching or pass ing a school building or the grounds the reof that is
co ntig uous to a highway and on which is pos ted a standard "SCHOOL" warning sign , while children are going to or leaving the school
ei th er during schoo l hours or during the noon recess pe riod. "Schoo l zone" also includes the area ap proaching or passin g any school
grounds th at are not separated fro m the highway by a fence, gate , or other physical barrier whi le the grounds are in use by chi ld ren if
that highway is pos ted with a sta ndard "SC HOOL" wa rn ing sign.
(1) When all of the following criteria are met, paragraph (2) of this subdivision shall be applicabl e and subdivisio n (a) shall not
be applicable:
(A) When radar is used, the arrestin g officer has success fu lly comple ted a radar opera tor course of no t less than 24 hours on the
use of police traffic radar, and the co urse was approved and ce rti fied by the Co mmission on Peace Officer Standards and
Training.
(B) When laser or any other electronic devi ce is use d to measure the speed of moving objects, the arresting officer has
successfu lly comple ted the training required in subparagraph (A) and an additional training course of not less than two hours
approved and certified by the Commission on Peace Officer Standards and Training.
(C)
(i) The prosecution prov ed that th e arresti ng offi ce r com pli ed with subparagraphs (A) and (B) and th at an eng ineer in g and
traffic survey has be en con ducted in accordance with su bp arag raph (B) of paragraph (2). The prosecu ti on proved that,
prior to the officer issuing the notice to appear, the arresti ng officer established tha t the radar , laser, or other electronic
dev ice co nformed to the requireme nts of subparagraph (D).
(ii) The prosecution proved th e speed of th e accused was unsafe for the condi tions present at the time of allege d viola tion
un less the ci tat ion was for a violation of Section 22349, 22356, or 22406.
(D) The radar, laser, or other electro nic device used to measu re the speed of th e accused meets or exceeds the minimal
operational stan dard s of the Natio nal Highway Traffic Sa fety Ad minis tration, and has been cal ibrated withi n the three years
prior to the date of the alleged violation by an independent certified laser or rada r repair and test ing or ca libratio n faci lity.
(2) A "speed trap " is either of the following:
(A) A part icular sect ion of a highway mea sured as to distance and with bo und aries ma rked, des ignated, or otherw ise determ ined
in order that the spe ed of a vehicle may be ca lculated by sec uring th e tim e it takes the vehicle to travel the kn own di stan ce.
(B)
(i) A particular se ctio n of a hi ghway or state hi ghwa y with a prima fa cie speed limit th at is prov ided by this code or by loca l
ordinan ce under parag raph (1) of subdivision (b) of Sec ti on 22352, or establ ished under Secti on 2235 4, 22357, 22358,
or 223 58.3, if t hat prima facie speed limit is no t justif ied by an engineering and traff ic survey conducted wi thin
one of the foll owi ng time pe ri ods, prio r to the date of the alleged viol at ion, an d enforcement of the speed limit
involve s the use of radar or any oth er elec tronic device th at me asures the speed of moving objects:
(I) Excep t as spec ified in subc lause (II), seven yea rs.
(II) If an en gineering and traffic survey was co nducted more than seve n years prior to the date of the alleged
vi olation, and a regi stered enginee r evalu ates the section of the high way and determ ines th at no sign ifica nt
cha nges in ro adway or traffic co nditi ons have occ urre d, incl uding, but not limited to , changes in adjoi ni ng
propert y or land use, roadway width , or traffi c volu me, 10 years.

(a) No evidence as to the speed of a vehi cle upon a highway sha ll be admi tted in an y court upon the trial of any person in any prosecution under
thi s code upon a charge involving the spee d of a vehicle when the evidence is based upon or obtai ned from or by the mai ntenance or use of
a spee dtrap.
(b) In any prosecutio n under this code of a charge involvin g the speed of a ve hicle, where en forcement invo lves the use of rada r or other
elect ronic devices which meas ure th e speed of movi ng objec ts, th e prosecution shall establi sh, as pa rt of its prima facie case , that the
evide nce or tes timon y presen ted is not based upon a speed trap as defi ned in paragra ph (2) of subdivision (a) of Sec tion 40802.
(c) When a traffic and enginee ring survey is requ ire d pursuant to pa ragra ph (2) of subdivision (a) of Section 40802, evi dence that a traffic and
enginee rin g survey has been co ndu cted within fiv e years of th e date of th e all ege d viol ation or evidence tha t th e offense was commi tted on a
local street or roa d as defined in pa rag raph (2) of su bdivision (a) of Sec tion 40802 shall cons tit ute a prima facie case th at th e evid ence or
tes timony is not based upon a spe ed trap as defin ed in paragra ph (2) of subdivisio n (a ) of Section 40802 .

witness if the tes ti mony is based upo n or obtai ned from or by the ma intenance or use of a speed trap.
(b) An offi cer ar res tin g, or parti cipating or assis tin g in the arres t of, a person so cha rged while on duty for the exclusive or main purpose of
enforci ng the prov isions of Divisions 10 (commenci ng with Sec tion 20000) and 11 (comme ncin g with Secti on 21000) is incompeten t as a
witness if at th e time of that arrest he was not wea ring a distinctive uniform, or was using a motor vehicle not painted the disti ncti ve color
specif ied by the com miss ioner.
(c) Th is section does not app ly to an offi ce r assign ed exc lusively to the duty of investiga ting and sec uring evid ence in refere nce to th e theft of a
veh icle or failure of a perso n to stop in the eve nt of an acci dent or violation of Sectio n 23109 or 23109 .1 or in refe rence to a felo ny cha rge or
to an officer engaged in serving a warrant when the officer is not engaged in patrolling the highways for the purpose of enforcing the traffic

INTRODUCTION
Engineering an d Tra f fic Surveys have be en pre p ared for 13 street segments in the City of Temple
City. The purpose of this project is to prepare an Engineering and Traffic Survey at these pre-
determined location s to establish updated speed limits th at can be enforc ed using radar.
Applicable sections of the California Vehicle Code {CVC) and Depa rtm ent of Transporta tion
California Manual on Uniform Traffic Control Devices {CAMUTCD), as read Ja nuary 1, 2012, with
upd at es to the CAMUTCD in November 2014 and March 2018 has been followed so that the
posted spe ed limits can be upheld by the co urts a nd do not constitute a "Speed Trap " as defined
by CVC Section 40802.
The fol lowing street segments were included in this Engineering an d Traffic Survey:

SECTION 1: OVERVIEW
California Vehicle Code:
Speed limits in Ca lifornia are governed by th e California Vehicle Code {CVC), Sections 22348
through 22413. Th e st atutes establish or provide means of es t ablishing speed limits by:
1. Basic speed limit law.
Section 22350 of the eve provides that no p ers on shal l drive a vehicle upon a highway at a
speed greater than i s rea sona ble or prudent havin g due regard for weather, vi si bi lity, traffic

and the surface and width of the highway, and in no event at a spee d which endangers the
safety of persons or property. Thi s is th e basic speed limit law.
2. Prima facie speed limits specified by statut e or established by t he State or local authorities
within their respective jurisdictions on the basis of an engineering and traffic survey.
Prima facie speed limits a re specific limits stated in the eve or specific limits estab li shed on
the ba sis of an engineering and traffic survey authorized by the eve. Th e prima facie speed
limits are preempted by the basic speed limit law when the conditions in eve Section 22350
are met.
Section 22352 of th e eve establishes prima facie speed limits as follows:
a. Fifteen miles per hour.
• At a railroad grade crossing with an obstructed view.
• At an uncontrolled hi ghway inte rsectio n with an obstructed v i ew.
• On an alley.
b. Twenty five miles per hour.
• On any highway other than a State hi ghway in any business or residence district, eve
Sections 235 and 515 define a "business district" and a "residence district"
respectively. Section 240 of eve prescribes a method for determining whether a
hi ghway is within a bu sine ss or re sid ence district.
Unl ess a different limit is established by procedures described elsewhe re in the code.
• In a sc hool zone.
• When passing a facility primarily used by sen ior citizens and contiguous to a street
other than a State highway.
Local Authority to establish Prima Facie Speed Limits:
Sections 22357 and 22358 of eve authorize local authorities to establish prima facie speed limits
on streets and roads under th ei r jurisdiction on the basis of an engineering and traffic survey .
Speed Trap:
Section 40802 2B{i) of the eve provid es that prima facie spee d lim its established under Sections
22352, 22354, 22357, 22358 and 22358.3 may not be enforced by radar unless the speed limit
has been justified by an e ng in eering and traffic survey conducted within one of the following

time periods; within the last 7 years; if an engineering and traffic survey was conducted more
than 7 years prior to the date of the alleged violation, and a registered engineer evaluates the
section of the highway and determines that no sign ificant changes in roadway or traffic
conditions have occurred, including, but not limited to, changes in adjoining property or l and use,
roadway width, or traffic volume, the survey applies for 10 years. This section does not apply
to local streets, roads or schoo l zones which have been set at the Prima Facie speed limit.
Engineering and Traffic Survey:
Sect ion 627 of CVC defines the term engineering and traffic survey and lists its requirements.
Section 627 states : "An engineering and traffic survey shall include, among other requirements
deemed necessary by the Department of Transportation, consideration of all of the following:
prevailing speeds as determined by traffic engineering measurements; accident records; highway
traffic and roadside conditions not readily apparent to the driver."
The Eng in eering and Traffic Survey should conta in sufficient information to document that the
conditions of eve Section 627 have been comp li ed with and that other conditions not read ily
apparent to motorists are properly id entifi ed.
In determining the speed limit, which most appropriately faci litates the orderly movement of
traffic and is reasonable and prudent, important factors such as prevailing speeds, unexpected
condition s, and co llision records are examined.
Determination of posted speed limits will follow the latest CAMUTCD Po licy dated Janu ar y 1,
2012 with updates in 2014 by the State of Ca lifornia Department of Transportation . Speed li mits
shall be round ed to the nea re st (5 mph) in creme nt of the 85th percen t il e speed of free flowing
traffic. However, in cases in w hich the speed limit needs to be rounded up to the nearest five
mil es per hour increment of the 85th perc e ntil e spee d, the Departm ent of Tran sp o rtation or a
lo ca l authority may decide to in stead round down the speed limit to the lower f ive miles per hour
in crement, but then the Department of Transportation or a loc al authority shall not re duc e the
speed limit any further for any rea so n eve 21400(4)(b).
An example of the application of thi s speed limit criteria is as follows:
• If the 85th percentile spee d in a speed su rvey is (37 mph) th en th e speed limit would be
post ed at 35 mph or optiona lly reduced to 30 mph. However,
• If th e 85th percentile speed in a sp ee d su rvey is (38 mph} then the speed limit would be
posted at 40 mph or optionally reduced to 35 mph.

The 85th percentile speed is often referred to as the critical speed. Pace speed is defined as the
10-mile increment of speed containing the largest number of vehicles. Speed limits established
on the basis of the 85th percentile conform to the consensus of those who drive highways as to
what speed is reasonable and prudent, and are not dependent on the judgment of one or a few
individuals.
Basic speed law states that no person shall drive at a speed greater than is reasonable or prudent.
The majority of drivers comply with this law. Speed limits set at the 85th percentile speed provide
law enforcement officers with a means of controlling drivers who will not conform to what the
majority considers reasonable and prudent.
When roadside development results in traffic conflicts and unusual conditions which are not
readily apparent to drivers, speed limits somewhat below the 85th percentile may be justified.
Section 2B.13 CAMUTCD: Reduction of 85th Percentile Speed by Justification of an Engineering
and Traffic Study and Approved by Civil or Traffic Engineer.
Standard:
12a: When a speed limit is to be posted, it shall be established at the nearest 5 mph increment
of the 85th-percentile speed of free-flowing traffic, except as shown in the Option below.
Option:
The posted speed may be reduced by 5 mph from the nearest 5 mph increment of the 85th-
percentile speed, in compliance with eve Sections 627 and 22358.5. See Standard below for
documentation requirements.
Standard:
12b: If the speed limit to be posted has had the 5 mph reduction applied, then an E& TS shall
document in writing the conditions and justification for the lower speed limit and be approved
by a registered Civil or Traffic Engineer. The reasons for the lower speed limit shall be in
compliance with eve Sections 627 and 22358-22358.5.

1. A. If the 85th percentile spe ed in a speed su rvey for a location was 37 mph, then the speed
limit wou ld be establi she d at 35 mph si nce it is the closest 5 mph increment to the 37
mph speed. As indicate d by the option, this 35 mph established speed limit cou ld be
reduced by 5 mph to 30 mph if the conditions and justification for us i ng this lower speed
limit are documented in the E& TS and approved by a registered Ci v il or Traffic Engineer.
The fundamenta ls used to establish speed limits recognize that the majority of drivers behave in
a sa fe and reasonable manner, but need to be advised of conditions which may not be readily
apparent. For this reason, collision hi story, roadway condit ion s, traffic characteristics, and land
use must be analyzed along with speed measurements to determine speed limits. Speed limit
changes are usually coordinated with vi si bl e changes in roadway conditions or roadside
developments .
In genera l, speed limits cannot b e successfully enforced without voluntary compliance by a
majority of drivers. Consequently, only the driver whose behavior is clearly out of line w ith the
normal flow of traffic is considered a violator for enforcement purposes.
DATA COLLECTION
Data was obtained regarding the prevailing speed of vehicles, traffic collis ions, visibility
restrictions, roadway conditions, ped estrian activities, on-street parking and land use adjacent
to the roadways. Radar spee d mea suremen t s were conducted during the months of February
and M arc h 2018.
Highway, traffic and roadsid e l and uses were analyz ed for conditions not readily apparent to
motorist s. The criteria and procedures describ ed below were applied when usin g the electronic
radar to measure vehicle speeds on selected streets wit hin the City of Tem ple City. Traffic volume
and speed in both directions was recorded.
Th e hours of radar operation were res tricted to off-peak periods fo r heav ily traveled streets, and
to non -c ongested peak periods on li ghtly traveled streets on a weekday. All surveys were
conducted in clear weath er. Th e radar measurements were taken from an unmarked vehicle so
as not to alter or impede the free flow of traffic .
A total of 100 samp le s we re obtained for eac h street segment surveyed. In no case were sam pl e
sizes less than 50 veh icl es for each direction. For l ower volume loca l streets, samples of free
flowing speed s were taken over seve ral periods/days in order to gather the requ i red amou nt of
survey sa mpl es .

Acci den t data was obtained from th e computerize d accident records system mai ntained by the
State of California Statewide Integrated Traffic Records System {SW IT RS). For purposes of th is
study, in formation availab le for the most rece nt 4 year period was used to develop the accident
statistics as a part of the Engin ee ring and Traffic Su rveys. Accident data was obtained for the
years 2014, 2015, 2016 and 2017.
Average Daily Traffic {ADT) data was obtained from counts taken by a private traffic counting
firm, in February of 2018 . These counts were taken on a Tuesday, Wednesday or Thursday while
schoo l was in session. Any unusual counts were checked and redone in order to verify the
amount of traffic each segment carries. ADT counts were taken by NDS Services.

PROCEDURES
The radar equipmen t used to collect speed m easu rements for this survey wa s a Mode l Phantom
Traffic Radar, operating frequency K, 1682 seria l number, manufactured by Astra Products. The
unit was calibrated before each series of measurements were taken. Tes t s of the un it wa s
con du cted in accordance w ith the manufacturer's specifications. The ra dar gun was certified by
RHF, Inc. in December of 2017. Th e Certificate of Calibration is valid for one yea r. A copy of the
current "Ce rtificate of Calibration" of the radar gun use d for this study is attached.
The re sults of the radar speed measurements were computed, ana lyzed and summarized on
st andard Traffic Survey Forms . Significant va lu es ob t ain ed from the computat ions ar e as fo l lows:
• The Cr itica l Speed or 85th perc entile speed , is that speed at which 85 percent of the traffic
is moving. The Cr itica l Speed is the prim ary g uide in determining what the majority of
drivers believe is safe and reasonab le. Speed l imits se t hi gher than the Critica l Speed are
not considered reasonab le and safe. The accepte d practi ce is to set the speed limit at the
nearest 5 mph increment to the Cr itical Speed or 85th percentile spee d, un l ess other
factors require a lower li mit.
• The 5 or 10 mph pace is a measure of th e dispersion of speeds with i n the survey sam pl e
and is that 5 o r 10 mph in crement containing the hi ghest percentage of speeds in the

ex pected to occur on stree t s and hi ghways of the sa me cha rac t e ri st ics. Th ese anticipated
accide nt rates have been d eve loped by Los Angeles County and are applicab le for use i n the City
o f Temple City. Th e accident rat es use d for this study are as fo llo ws:

4. Frequency of intersections, driveways, and on-street parking .
5. Location of stop signs, traffic signals, and other regulatory traffic control devices.
6. Visibility obstructions .
7. Land use and the proximity of schools.
8. Uniformity with existing speed zones in adjacent jurisdictions.
9. Any other unusual condition not readily apparent to the driver.
10. Location of any uncontrolled Crosswalks.
11. Bike lanes, bike routes.
SECTION 2: SUMMARY OF RECOMMENDATIONS
The Engineering and Traffic Survey summaries presented in this report illustrate the results of a
thorough evaluation of the data collected and provides a recommended speed limit for each
street segment surveyed. In each case, the recommended speed limit is consistent with the
prevailing behavior as demonstrated by the radar speed measurements.
The Legislature, in adopting Section 22358.5 of the California Vehicle Code, has made it clear that
it is their intent that physical conditions such as width, curvature, grade and surface conditions,
or any other condition readily apparent to a driver, in the absence of other factors, would not
require special downward speed zoning. The basic rule of Section 22350 is sufficient regulation
as to such conditions.
The recommendations contained in this report were intended to establish prima facie speed
limits. Prima Facie limits advise the motorist and enforcement agencies of the reasonable speed
for a particular section of highway for prevailing conditions. They are not intended to be
absolute. All violations of these speed limits are actually violations of the basic speed law (Section
22350 of California Vehicle Code). This statute states that a person shall not drive a vehicle at a
speed greater than is safe having regard for traffic, roadway and weather conditions . A prima
facie limit merely suggests a safe speed under normal conditions.

Out of the 13 segment and based on the 2018 Engineering and Radar Speed survey results, it was
determined that 8 speed limits are proposed to be changed.
Per Section 2B.13 CAMUTCD: Reduction of 85th Percentile Speed by Justification of an Engineering and
Traffic Study and Approved by Civil or Traffic Engineer as follows:
Standard:
1 2aWhen a speed limit is t o be pos ted, it sha ll be established at the ne arest 5 mph increment of the 85th-
percenti le speed of free-f lowing traffic, except as shown in the Option be low.

1. The posted speed may be reduced by 5 mph from the nea res t 5 mph increment of the 85th-
percentile speed, in compliance wit h CVC Sections 627 and 22358.5. See Standard be low for
documentation requirements.

12b If the speed limit to be po sted has had the 5 mph reduction applied, then an E& TS shall document in
writing the cond itions and ju stificat ion for the lower speed limit and be approved by a registered Civ il or
Tr affic Engineer. The reasons for the lower speed limit shall be in compliance with CVC Sections 627 and
22358 .5.

A. Usin g Option 1 above a first step is to round down: If the 85th percentile speed in a speed survey for a
location was 37 mph, then the speed limit wou ld be es t ab lish ed at 35 mph since it is the closes t 5 mph
increment to the 37 mph speed. As indicated by the option, this 35 mph established speed li m it co uld be
reduced by 5 mph t o 30 mph if the conditions and justification for using this lower speed li mit are
documented in theE& TS and approved by a re gis tered Civil or Traffic Engineer.

Per California Vehicle Code {CVC) Section 21400.
(a) (1) The Department of Transportation shall, after consultation with local agencies and public hearings, adopt
rules and regulations prescribing uniform standards and specifications for all official traffic control devices placed
pursuant to this code, including, but not limited to, stop signs, yield right-of-way signs, speed restriction signs,
railroad warning approach signs, street name signs, lines and markings on the roadway, and stock crossing signs
placed pursuant to Section 21364.
(2) The Department of Transportation shall, after notice and public hearing, determine and publicize the
specifications for uniform types of warning signs, lights, and devices to be placed upon a highway by a person
engaged in performing work that interferes with or endangers the safe movement of traffic upon that highway.
(3) Only those signs, lights, and devices as are provided for in this section shall be placed upon a highway to warn
traffic of work that is being performed on the highway.
(4) Control devices or markings installed upon traffic barriers on or after January 1, 1984, shall conform to the
uniform standards and specifications required by this section.
(b) The Department of Transportation shall revise the California Manual on Uniform Traffic Control Devices, as it
read on January 1, 2012, to require the Department of Transportation or a local authority to round speed limits
to the nearest five miles per hour of the 85th percentile of the free-flowing traffic. However, in cases in which the
speed limit needs to be rounded up to the nearest five miles per hour increment of the 85th-percentile speed,
the Department of Transportation or a local authority may decide to instead round down the speed limit to the
lower five miles per hour increment, but then the Department of Transportation or a local authority shall not
reduce the speed limit any further for any reason .

Per the California Manual of Uniform Traffic Control Devices (CAMUTCD) Section 28.13 and CVC Sections 627
and 22358:
12aWhen a speed limit is to be posted, it shall be established at the nearest 5 mph increment of the 85th-
percentile speed of free -flowing traffic, except as shown in the two Options below.
Option:
1. The posted speed may be reduced by 5 mph from the nearest 5 mph increment of the 85th-percentile
speed, in compliance with eve Sections 627 and 22358.5. See Standard below for documentation
requirements.
2. For cases in which the nearest 5 mph increment ofthe 85th-percentile speed would require a rounding up,
then the speed limit may be rounded down to the nearest 5 mph increment below the 85th percentile
speed, if no further reduction is used. Refer to CVC Section 21400(b).
