HomeMy Public PortalAbout20041115REGULAR COUNCIL MEETING NOVEMBER 15, 2004 1 CALL TO ORDER The Regular Council Meeting of November 15, 2004, was convened at 6:00 P.M. by President Pro Tempore Edith Vogel in the absence of Mayor John Landwehr. Prayer was offered by Councilman Jonathon Schnitzler, followed by the Pledge of Allegiance. ROLL CAL The following Council Members were present for the roll call: Present: Berry, Brown, Crane, Ferguson, Harvey, Schnitzler, Viessman, and Vogel Absent: Martin A quorum was declared present. PUBLIC HEARINGS Preliminary & Final PUD Plan for 1907 Boggs Creek Road - City Planner Janice McMillan presented background information regarding the proposed plan. Following her presentation, no one present requested to speak in favor of, or opposition to, the proposed Preliminary and PUD plan. President Pro Tempore Edith Vogel declared the public hearing concluded. Special Exception Permit for Outdoor Storage at 1700 Oil Well Road - City Planner Janice McMillan presented background information regarding the requested special exception permit. Following her presentation, no one present requested to speak in favor of, or opposition to, the request. President Pro Tempore Edith Vogel declared the public hearing concluded. President Pro Tempore Edith Vogel stated the Council had indicated they wished to take up for consideration the two bills associated with these public hearings at this time in the meeting. Bill 2004 -93, sponsored by Councilman Brown, entitled: REGULAR COUNCIL MEETING NOVEMBER 15, 2004 2 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING THE PRELIMINARY AND FINAL PUD PLAN FOR 1907 BOGGS CREEK ROAD, LOCATED ON LOT 437 IN LANDWEHR HILLS SUBDIVISION, SECTION 11. Bill 2004 -93 was read third time by title, placed on final passage and passed by the following roll -call vote as Ordinance 13800: Aye: Berry, Brown, Crane, Ferguson, Harvey, Schnitzler, Viessman, and Vogel Nay: None Bill 2004 -94, sponsored by Councilman Brown, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A SPECIAL EXCEPTION PERMIT FOR OUTDOOR STORAGE AT 1700 OIL WELL ROAD, LOCATED IN SECTION 9, TOWNSHIP 44 NORTH, RANGE 11 WEST, JEFFERSON CITY, COLE COUNTY, MISSOURI. Bill 2004 -94 was read third time by title and placed on final passage. A motion was made by Councilman Michael Berry to approve Bill 2004 -94 subject to the amendments made to the plan since the bill's introduction at the November 1 Council Meeting. The motion was seconded by Councilman Kevin Brown and approved unanimously. Bill 2004 -94 was then passed, as amended, by the following roll -call vote as Ordinance 13801: Aye: Berry, Brown, Crane, Ferguson, Harvey, Schnitzler, Viessman, and Vogel Nay: None MINUTES AND REPORTS RECEIVED AND FILED President Pro Tempore Edith Vogel announced that the following minutes and reports have been received and are on file and may be reviewed in the City Clerk's office: a. CAMPO Technical Committee, September 2, 2004 b. Transportation & Traffic Commission, September 9, 2004 c. Housing Authority Board of Commissioners, September 28, 2004 d. Planning & Zoning Commission, October 14, 2004 COUNCIL LIAISON REPORTS There were no liaison reports given at this time. ANNOUNCEMENTS OF OTHER UPCOMING MEETING AND EVENTS REGULAR COUNCIL MEETING NOVEMBER 15, 2004 3 No announcements were made at this time. APPOINTMENTS BY THE MAYOR There were no appointments to come before the Council at this time. PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS Dr. Gary Kremer, 705 Briarwood Court, made a presentation regarding the release of his most recent book, "Heartland History, Volume 3." He thanked the City for their contribution to the publication of this book, and indicated the book was a Jefferson City project from beginning to final publication since the author, graphic artist, printer, and binder, and retail distributor were all located in Jefferson City. Following his remarks, he presented a signed copy of the book to the City. PRESENTATIONS FROM THE GALLERY Mr. Clyde Angle, 3618 W. Gordon Drive, made comments regarding the Katy Trail annexation. He distributed a list containing numerous questions concerning the issue. COUNCIL COMMENTS IN RESPONSE TO PRESENTATIONS FROM THE GALLERY Councilman Kenneth Ferguson made a motion that staff be directed to respond to Mr. Angle's questions, seconded by Councilman Jonathon Schnitzler and approved unanimously. Councilman Michael Berry commented that he believes this Council is the first one in many years to address the issue of annexation with the needs of the future versus immediate needs in mind. CONSENT AGENDA The following items were on the agenda for Council approval by Consent: a. Minutes of Council Meetings: October 29 Brown Bag, November 1 Pre - Meeting and Regular Meeting REGULAR COUNCIL MEETING NOVEMBER 15, 2004 4 Bid 2037 (RENEWAL - Year3), Uniform Cleaning, Police, Animal Rescue, Transit, Parking, and Fire Depts. A motion was made by Councilman Mike Harvey to approve the Consent Agenda as presented, seconded by Councilman Jonathon Schnitzler, and approved unanimously. BIDS OVER $25,000 Sole Source SS2109 - Software Maintenance, Police Dept. - A motion was made by Councilman Kevin Brown for approval of the bid as presented, seconded by Councilman Brian Crane and approved unanimously. BILLS INTRODUCED Bill 2004 -98, sponsored by Councilmen FERGUSON and Harvey, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE DOCUMENTS WITH AMERENUE FOR STREETLIGHTS IN THE ALGOA ANNEXATION AREA. BILLS PENDING Bill 2004 -95, sponsored by Councilman Ferguson, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A CAPITAL ASSISTANCE GRANT AGREEMENT WITH THE MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION PROVIDING FUNDING FOR BUS REPLACEMENT, FACILITIES IMPROVEMENTS, AND EQUIPMENT (PROJECT MO -03- 0109). Bill 2004 -95 was read third time by title, placed on final passage and passed by the following roll -call vote as Ordinance 13802: Aye: Berry, Brown, Crane, Ferguson, Harvey, Schnitzler, Viessman, and Vogel Nay: None Bill 2004 -97, sponsored by Councilmen CRANE and Martin, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THOMAS P. RACKERS REGULAR COUNCIL MEETING NOVEMBER 15, 2004 5 CONSULTING L.L.C. Bill 2004 -97 was read third time by title and placed on final passage. City Counselor Nathan Nickolaus explained that he had spoken with the contractor about the Council's request to make the contract term August 1 to July 31, and that he was amenable to that. Mr. Nickolaus stated the contract has been amended to reflect that requested change, but that no amendment to the body of the bill itself was necessary. Bill 2004 -97 was then passed by the following roll -call vote as Ordinance 13803: Aye: Berry, Brown, Crane, Ferguson, Harvey, Schnitzler, Viessman, and Vogel Nay: None INFORMAL CALENDAR Bill 2004 -84, sponsored by Councilmen VOGEL, Schnitzler, Berry, Brown, Crane, Ferguson, Harvey, Martin, Viessman, and Weber, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE EXTENSION OF THE CITY LIMITS OF THE CITY OF JEFFERSON, MISSOURI BY ANNEXING AND INCLUDING UNINCORPORATED REAL PROPERTY LOCATED IN THE COUNTY OF CALLAWAY, STATE OF MISSOURI, LYING NORTH OF THE PRESENT CITY LIMITS REFERRED TO AS THE KATY TRAIL AREA. Councilman Michael Berry requested that Bill 2004 -84 be removed from the Informal Calendar and placed on final passage at this time. Bill 2004 -84, having previously been read third time by title, was placed on final passage. A motion was made by Councilman Jonathon Schnitzler to accept the Substitute Bill 2004 -84 which had been distributed in the November 12 Council packets, seconded by Councilman Brian Crane and approved unanimously. Bill 2004 -84 was passed, as substituted, by the following roll -call vote as Ordinance 13804: Aye: Berry, Brown, Crane, Ferguson, Harvey, Schnitzler, Viessman, and Vogel Nay: None Bill 2004 -89, sponsored by Councilman Ferguson, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE CITY OF JEFFERSON, MISSOURI AND THE JEFFERSON CITY AREA CHAMBER OF COMMERCE GOVERNING THE DEVELOPMENT OF PROPERTY LOCATED SOUTH OF WEST EDGEWOOD DRIVE. Councilman Kenneth Ferguson requested that Bill 2004 -89 remain on the Informal Calendar. REGULAR COUNCIL MEETING NOVEMBER 15, 2004 6 Bill 2004 -96, sponsored by Councilmen VIESSMAN and Crane, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTION 19 -401 (STREETS AND HIGHWAYS), SCHEDULE G, (STOP INTERSECTIONS), SUBPARAGRAPH (B), (OTHER SPECIFIED INTERSECTIONS), OF THE CODE OF THE CITY OF JEFFERSON. Councilman Roy Viessman requested that Bill 2004 -96 remain on the Informal Calendar. SCHEDULED REPORTS President Pro Tempore Edith Vogel announced that, due to the absence of Councilman Dean Martin, the report on City Bidding Procedures and Policies will be postponed. NEW BUSINESS Councilman Roy Viessman announced that he does not plan to run for re- election to the City Council and urged anyone interested in representing the Third Ward to file for election with the City Clerk's office before the November 23 deadline. Councilman Kevin Brown announced the Central East Side meeting will be held tomorrow, November 16, at 6:00 P.M. He also announced the Public Works & Planning Committee meeting is schedule to be held Thursday night, November 18, at 5:30 P.M. Councilman Brian Crane announced that the next meeting of the Ad Hoc JCTV committee will meet on December 7 at 6:00 P.M. Councilman Jonathon Schnitzler announced the next meeting of the Economic Development Advisory Board will be Wednesday, November 17, at 5:30 P.M. Councilman Brian Crane announced the Council Rules committee will hold its next meeting at 6:00 P.M. on Monday, November 22. UNFINISHED BUSINESS There was no unfinished business brought before the Council at this time. GO INTO CLOSED SESSION President Pro Tempore Edith Vogel stated that, pursuant to Sec. 610.021 of the Revised Statutes of Missouri, the Council will go into Closed Session to discuss the following: REGULAR COUNCIL MEETING NOVEMBER 15, 2004 7 Personnel [Sec. 610.021(3)] A motion was made by Councilman Mike Harvey to go into Closed Session, seconded by Councilman Kevin Brown, and approved unanimously by the following roll -call vote at 6:40 P.M..
