MEMORANDUM November 20, 2018 The Honorable City Council Bryan Cook, City Manager " o.v- By: Cathy Burroughs, Director of Parks and Recreation l)JO SUBJECT: REQUEST FROM THE TEMPLE CITY CAMELLIA FESTIVAL FOR SUPPORT AND AUTHORIZATION FOR USE OF STREETS AND FACILITIES FOR THE 2019 CAMELLIA FESTIVAL RECOMMENDATION: City Council support for the 2019 Camellia Festival is requested as follows: 1. Authorize use of City owned facilities including Live Oak Park Community Center, Temple City Park, and the Community Room as identified in the attached letter from the Camellia Festival to the City Manager (Attachment "A"); 2. Authorize use of streets and parking areas including temporary parking bans and street closures for the festival and parade as identified in the attached letter from the Camellia Festival to the City Manager; 3. Approve the permit for use of the Los Angeles County (County) Library parking lot for the 2019 Camellia Festival (Attachment "B") and authorize staff to execute; 4. Approve consumption of alcohol in Temple City Park, pursuant to Section 4-4-0 of the Temple City Municipal Code (TCMC); 5. Authorize Bingo in Temple City Park, pursuant to Section 4-1 F of the TCMC and waiver of the $50 license fee; 6. Authorize sponsor banners in Temple City Park, pursuant to Section 3-50-10 of the TCMC; 7. Authorize placement of banners in City parks and the median located on Broadway at Encinita, pursuant to Section 9-1 L-3C of the TCMC; and 8. Authorize certain local community organizations to sell food, patches, etc. along the parade route. City Council November 20, 2018 Page 2 of 3 BACKGROUND: 1. In 1944, the first Camellia Festival (Festival), sponsored by the Women's Club of Temple City, was held. 2. In 1960, the Festival became a joint venture of the City of Temple City and the Temple City Chamber of Commerce. Festival activities were planned and coordinated by the Temple City Camellia Festival (TCCF) Executive Board (Board), a volunteer organization. Operating expenses for the Festival are funded by the Festival's revenue and the funds are kept separate from the City. 3. In 1990, the City became the sole sponsor of the Festival and continues to sponsor Festival events annually. As the sponsor of the Festival, the City provides insurance, staff support, and facilities for Festival events. 4. On October 20, 2015, the City Council approved a Master Agreement with the TCCF formalizing the relationship between the City and the TCCF clearly defining the responsibilities and obligations of each party. 5. On October 9, 2018, Festival Director, Dawn Tarin submitted a request for City support for the 2019 Camellia Festival to the City Manager. ANALYSIS: In 2014, the Festival expanded moving several rides and attractions from Temple City Park, and the adjacent parking lots, to Las Tunas Drive between Kauffman Avenue and Golden West Avenue. Also in 2014, the Festival began sponsoring a beer/wine garden. The City Council approved these changes in 2014 and has done so each year since. The Festival is requesting similar approvals for the 2019 Festival which will be held February 22-24, 2019. Similar to last year, the Festival is requesting authorization to place a 4' x 8' banner in the median on Broadway at Encinita Avenue. Similar to previous years, staff recommends the City purchase special event insurance for the 2019 Camellia Festival which adds another layer of protection for the City. The coverage provides liability insurance when the City's premises are used for special events such as art festivals, parades, block parties, and member-sponsored events such as street fairs and carnivals. All events must be approved and rated by the insurance carrier. There is no deductible, and the member is added as an additional insured, if entered on the certificate. Liability limits are purchased in $1 ,000,000 per occurrence increments. The estimated premium for the special event insurance this year is $2,500. The City Council is requested to review and approve the requests from the Festival as identified in the letter to the City Manager dated October 9, 2018. City Council November 20, 2018 Page 3 of 3 CITY STRATEGIC GOALS: Approval of the various requests from the TCCF will further the City's Strategic Goal of Quality of Life. FISCAL IMPACT: The City Council as part ofthe Fiscal Year (FY) 2018-19 City Budget has appropriated funds for this event, the majority of which is staff costs in support of the parade and the three day carnival. Funds are available for the special event insurance in account# 01-940-57-4630 R19-07. PERMITTEE SHALL: a. Comply with and abide by all applicable rules, regulations and directions of County and all applicable City and County ordinances and aU State and Federal laws, and in the course thereof obtain and keep in effect all permits and licenses required to conduct the permitted activities on the premises. b. Provide custodial services to the premises and maintain the area occupied in a clean and sanitary condition to the satisfaction of County. Repair or replace any and aU County property lost, damaged, or destroyed as a result of or connected with the conduct or activities of the Permittee. Should Permittee fail to promptly make repairs, County may · have repairs made and Permittee shall pay costs. Pay charges for installation and service costs for all telephones used for the conduct of the permitted activities, such activities must be stated within this permit. c. Conduct the permitted activities in a courteous and non-profane manner, operate without interfering wlth the use of the facilities by County or the public, except as herein permitted, and remove any agent, servant or employee who fails to conduct permitted d Assume the risk of loss, damage or destruction to any and all fixtures and personal property belonging to Permittee that are installed or placed within the area occupied e Restore the premises prior to the termination of this Permit to the satisfaction of CoLinty to the conditions that existed prior to the commencement of the permitted activities, other than for ordinary wear and tear or damage or destruction by the acts of God beyond the control of Permittee. This shall include removal of all rubbish and debris, as well as structures placed on the premises by Permittee in order that the premises will be neat and clean and ready for normal use by County on the day following the termination of this Permit. Should Permittee fail to accomplish this, County may perform the work f. Allow County to enter the premises at any time to determine compliance with the terms of this Permit, or for any other purpose incidental to the performance of the responsibilities of the Chief Executive Office. g Provide all security devices required for the protection of the fixtures and personal property used in the conduct of the permitted activities from theft, burglary or vandalism, provided written approval for the installation thereof is first obtained from the Chief Executive Office. h Prohibit all advertising signs or matter from display at the premises and unless otherwise stated in this permit; prohibit the marketing and promotion of literature and products of any kind; and prohibit the serving of food and alcohol on i. INDEPENDENT STATUS: The Permit is by and between County and Permittee and is not intended and shall not be construed, to create the relationship of agent, servant, employee, partnership, joint venture or association as between County and Permittee. Permittee understands and agrees to bear the sole responsibility and liability for furnishing Workers' Compensation benefits to any person for injuries arising from or connected with services performed on behalf of Permittee pursuant to this Permit. 7. EMPLOYEES: All references to the "Permittee" in the Permit are deemed to include the employees, agents, assigns, contractors, and anyone else involved in any manner in the exercise of the rights therein given to the undersigned Permittee. 8. LIMITATIONS: It is expressly understood that in permitting the right to use said premises, no estate or interest in ·real property is being conveyed to Permittee, and that the right to use is only a nonexclusive, revocable and unassignable permission to occupy the premises in accordance with the terms and conditions of the Permit for the purpose of conducting the permitted activities. 9. ASSIGNMENT: This Permit is personal to Permittee, and in the event Permittee shall attempt to assign or transfer the same in whole or part all rights hereunder shall immediately terminate. 10. AUTHORITY TO STOP: In the event that an authorized representative of the County finds that the activities being held on the premises unnecessarily endanger the health or safety of persons on or near said property, the representative may· require that this Permit immediately be terminated until said endangering activities cease. 11. DEFAULT AND CANCELLATION: Permittee agrees that if default shall be made in any other terms and conditions herein contained, County may forthwith revoke and terminate this Permit. The County reserves the right to cancel this Permit upon giving written notice of one day to Permittee without incurring 12. ALTERATIONS AND CONDITION OF PREMISES: Permittee has examined the premises and knows the condition thereof. Permittee accepts the premises in the present state and condition and waives any and all demand upon the County for alteration, repair, or improvement thereof.
