Forbes, AICP , Community Development Director By: Hesty Liu , AICP , Associate Planner SUBJECT: FINAL SUBDIVISION MAP APPROVAL FOR PARCEL MAP NO. 71298, A CONDOMINIUM SUBDIVISION AT 5702 TEMPLE CITY BOULEVARD RECOMMENDATION: The City Council is requested to: 1. Review and approve the final subdivision map for Parcel Map No . 71298 (Attachment "A "); 2. Accept the dedication of the ·project at the southwest corner for the right-of-way of Temple City Boulevard for a corner cut-off; and 3 . Authorize the City Clerk to certify Parcel Map No . 71298 . BACKGROUND: 1. On September 25, 2012, the Planning Commission approved Tentative Parcel Map No. 71298. The approval granted an initial life of two years with the expiration date set as September 25 , 2014 . 2. On July 11, 2013, AB 116 was signed into law. AB 116 stipulated that any tentative map approved after January 1, 2000 would be granted an automatic extension of two years. As a result, the expirat ion date of Tentative Parcel Map No. 71298 was automatically extended to September 25, 2016. 3. On August 24, 2016, before the exhaustion of the legislative extension , the applicant submitted a request for a time extension . City Council December 4, 2018 Page 2 of 3 4. On October 11, 2016, the Planning Commission held a public hearing and approved the time extension. The Planning Commission granted a one-year extension with the expiration date set as October 11, 2017. 5. On April17, 2017, the Los Angeles County Fire Department notified the City that the final map review was concluded and the map was approved. 6. On September 11, 2017, before the exhaustion of the first time extension, the applicant submitted the second request for a time extension. The applicant indicated that although the final map had been approved for its mathematic accuracy, additional time would be needed to satisfy other conditions of approval. 7. On November 28, 2017, the Planning Commission reviewed and approved the second time extension request. The approval granted another year with the expiration date set as October 11, 2018. 8. On September 21, 2018 and pursuant to the state Subdivision Map Act, the applicant submitted the third request for a time extension. According to the state Subdivision Map Act, the submittal of a time extension automatically extends a map for 60 days until a decision is made by the City. As a result, the expiration of the tentative map was extended to December 10, 2018. 9. On November 16, 2018, the CC&Rs prepared for the subdivision were approved by the City Attorney's Office. 10. On November 21, 2018, the applicant completed demolition of the existing structures on the property, fulfilling the last requirement conditioned for the final map. ANALYSIS: The tentative parcel map is for the development of two detached condominium units. The map was approved based on the finding that the development would be consistent with the General Plan and the Zoning Code. After the approval of the tentative map, the applicant has made steady progress toward the final map, including review and approval of the final map by the Los Angeles Fire Prevention Division and Public Works (which acted as the City Engineer for this project). The Covenants, Conditions, and Restrictions have been reviewed by the City Attorney. The demolition of the existing structures on the property has been finished. With the conclusion that the applicant has satisfied all requirements, and the final map is consistent with the tentative map and the state Subdivision Map Act, staff requests that the City Council approve the final map.
