KOCH, JR. COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. Call to Order. Mr. Kent was asked to preside as Acting Chairman and Mr. Kent called the meeting to order at 8:30 A.M. II. Roll Call. Minutes of the Regular Meeting and Public Hearing of 7-28-16. Mr. Rubini moved the approval of the minutes as presented and Mr. Dockerty seconded the motion with all voting AYE. IV. Additions, withdrawals, deferrals, arrangement of agenda items. There were no changes to the agenda. V. Announcements. A. Meeting Dates 1. Regular Meeting & Public Hearing a. October 27, 2016 @ 8:30 A.M. b. November 17, 2016 @ 8:30 A.M. c. December 15, 2016 @ 8:30 A.M. d. January 26, 2017 @ 8:30 A.M. e. February 23, 2017 @ 8:30 A.M. Both Mr. Roach and Mr. Rubini advised they would be unable to attend the meeting on October 27, 2016. VI. PUBLIC HEARING. A. Declaration of Ex -Parte Communication There were no ex -parte communications declared. B. Administer Oaths The Town Clerk administered the Oath to Mark Marsh, Clint Oster, Dave Bodker, and Candace Friis. C. Applications for Development Approval 1. An application submitted by Mark Marsh as Agent for Richard Viens & Patricia Werhahn, owners of property located at 1424 N. Ocean Blvd., Gulf Stream, Florida, ARPB Regular Meeting & Public Hearing 9-22-16 @ 8:30 A.M. which is legally described as Lots 10 & 10A, McLouth Subdivision, Gulf Stream, Florida. Mark Marsh advised that Mr. & Mrs. Viens have decided that they prefer to have a more natural style of landscaping using more native material from this particular area than the more formal design that was previously approved. Mr. Marsh then pointed out that they are asking to relocate the driveway entrance farther to the east to give a meandering Oappearance to the entrance and want to change the configuration of the swimming pool to a free form design. He then introduced Clint Oster from General Landscaping to explain this revised plan. Mr. Oster said that they will be replacing a number of the Coconut Palm Trees with Sable Palms and there will be heavy planting at the edges of the property but not as hedges. The planting will be heavy groupings and all of the sodded areas will be Zoysia grass. Mr. Marsh explained that the driveway will be a tabby concrete, the motor court, clay pavers and the pool deck, cast stone. The final change he explained was a 4 ft. high aluminum picket fence on top of a low wall on each side of the 6 ft. high matching gate and piers to define the entry. The Town Clerk advised that there had been no comment from the neighbors. a. Level 2 Architectural/Site Plan Review to permit new landscape, hardscape, and pool designs, and the re -location of the driveway that received a previous approval on ARPB Application number 15-9 on October 9, 2015. Mr. Dockerty moved to approve the Level 2 Architectural/Site Plan based on a finding that the proposed new landscape, hardscape pool designs, and the relocation of the driveway meet the minimum intent of the Design Manual and applicable review standards with the following conditions: 1.All chain link fence shall be screened on the outside with appropriate hedge material. 2. Any planting in the utility easements requires a removal agreement prior to permitting. Mr. Rubini seconded the motion and all voted AYE at the roll call. 2. An application submitted by Dave Bodker, Landscape Architect as agent for 3501 NOC Blvd., GS FL LLC, owner of property located at 3501 North Ocean Blvd., Gulf Stream, Florida 33483, legally described as All of Plat of MMW BEACHHOUSE LOT, ACCORDING TO THE Plat thereof on file in the Office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, recorded in Plat Book 63, Page 10; said lands situate, lying and being in Palm Beach County, Florida. Mr. Bodker distributed photographs of the property and displayed a sample of the white shell rock pavers that will be used on the surface of the driveway. He said they will be re -plastering the white 4 ARPB Regular Meeting & Public Hearing 9-22-16 @ 8:30 A.M. wall and replacing the iron gate with an aluminum cross rail pattern for which Mr. Kupi had received an earlier approval. Mr. Bodker gave a detailed description of the landscape material, its locations, pointing out that the new landscaping will screen the property from North Ocean Blvd. and the properties to the north and south. C The Town Clerk advised that no comments had been received with regard to this application. a. Land Clearing Permit to permit relocation of some existing plants and trees, removal of those in poor condition and the re -landscaping along the existing walls on both sides of the property. Mr. Rubini moved to approve the Land Clearing Permit and the motion was Seconded by Mr. Dockerty with all voting AYE. b. North Ocean Boulevard Overlay Permit to allow re- landscaping within the North Ocean Boulevard Overlay District, re -plastering existing wall, installation of an aluminum 6' gate and paver brick driveway. Mr. Rubini moved to approve the North Ocean Boulevard Overlay Permit based on the finding that the proposed re -landscaping, re -plastering the existing wall, installation of an aluminum 6 ft. gate and paver brick driveway meet the minimum intent of the Design Manual and applicable review standards. This motion was seconded by Mr. Dockerty with all voting AYE at the roll call. 3. An application submitted by Candace Friis as agent for 3565 North Ocean, LLC, owner of property located at 3565 North Ocean Blvd., Gulf Stream, Florida 33483, legally described as the N 40 ft. of Lot 7 & the S 70 ft. of Lot 8, Gulf Stream Ocean Tracts. Mrs. Friis, speaking on behalf of the owners, advised that this is a vacant lot that gives the appearance of a parking lot and vehicles have been parking there. She said the owners want to improve the appearance and are asking for permission to install a Green Island Ficus hedge along the inside of the front property line, along the inside of the wall on the north side of the property and along the north side of the 10 ft. easement on the south side of the property. Mrs. Friis further stated C, that the irrigation system is being repaired and the lot will be covered with grass. Mr. Dockerty called attention to a low spot on the lot that fills with standing water, noting that there have been complaints from the area. Town Clerk Taylor reported that she had also received comments about it. Mrs. Friis said that problem will be solved with the improvements that are planned. In answer to a question from Mr. Rubini, she also advised 3 ARPB Regular Meeting 6 Public Hearing 9-22-16 @ 8:30 A.M. that the 10 ft. pedestrian easement on the south side of the lot will remain as the hedge is 2 ft. north of that 10 ft. line. a. NORTH OCEAN BOULEVARD OVERLAY PERMIT to allow the installation of a Green Island Ficus hedge along the inside of the front property line, approximately 110 ft., and along the north side of the 10 ft. wide pedestrian walkway, approximately 248 ft., on the south side of the property. Mr. Dockerty moved to approve the North Ocean Boulevard Overlay District Permit and Mr. Roach seconded the motion with all voting AYE. VII. Items by Staff. There were no items by staff. VIII.
