1 Proposal: Raise the Annual Fire Protection Subscription in Unincorporated Tybee Island from
$85/year to $100/year
2 Purchase 2 VW Passat's at $25,422 each instead of 2 Dodge Chargers for TIPD Patrol Cars — Price
for VW Passat is based in Chattanooga, TN quote which was lowest quote to date. Budget Line

3 Budget Transfer: To request the City Council's approval to transfer $5,844 within the general
fund's operating and capital budget for fiscal year 2013-2014 from the contingency expense line
item to the Police Department's operating and capital budget. This will affect the operating budget
and capital budget by $5,844. The Police Department's vehicle capital line item
(100.3210.54.2200) will increase from $68,000 to $68,844; increase their small equipment line item
(100.3210.53.1600) by $5,000 from $25,000 to $30,000; and decrease the contingency expense
line item by $5,844 from $50,000 to $44,156.
4 Out of State Employee Travel Request. The Police Department is requesting the council's approval
to allow three police department employees permission to travel out of state to Tennessee to pick
up the two new police vehicles

City Council Minutes 20130718
Mayor Buelterman called the special city council meeting to order at 2:00PM on July 18, 2013.
Those present were Paul Wolff, Tom Groover, Jan Fox, Barry Brown and Bill Garbett. Also
attending were Diane Schleicher, City Manager; Bubba Hughes, City Attorney; Angela Hudson,
Finance Manager; George Reese, Water/Sewer Department and Janet LeViner, Clerk of Council.
Mayor pro tern Wanda Doyle was excused as she was on vacation.
Consideration of Bids, Contracts, Agreements and Expenditures
To obtain the City Council's approval through a resolution to amend the Water &
Sewer Fund FY 2013-14 Operating Budget and Capital Budgets by adding a new
capital line item, Sewer Main #3 Replacement for $302,000 and to cover the cost by
re-appropriating $130,000 from the Operating Budget to the Capital Budget; and re-
appropriate funds for two capital projects covering $175,000 to the new capital line
item. Jan Fox made a motion to transfer $302,000 from the Greenspace Fund in the General
Fund to the Water/Sewer Fund to the Sewer Main #3 Replacement line item. Paul Wolff
seconded. Vote was unanimous.
To obtain the City Council's approval to award an emergency contract to BRW
Construction Group, LLC for up to $200,000 total to repair and replace the sewer
force main lines at lift station number 3 in order to ensure the safety of the public's
health, property and environment. Mr. Hughes stated the record needs to reflect that this
meeting is being held as a result of an emergency that poses an imminent threat/danger to the
public health and safety of the residents of Tybee Island as mayor and council are not afforded
the luxury of going through the full Public Works Construction Law with notice, advertisement
and bidding. The emergency is the possible discharge of untreated sewage into marsh and/or
streets. Bill Garbett made a motion to approve the contract as amended to replace the
language "repair" with "replacement". Barry Brown seconded. Discussion: Mr. Hughes
asked that the language be added: "to replace 37001f and not to exceed as cost a total of
$200,000 for pump station #3". Bill Garbett amended his motion, Barry Brown seconded.
Vote was unanimous.
Consideration of Ordinances, Resolutions
First Reading, 25-2013 Amendment to Capital Budget FY2014, Water/Sewer. Jan
Fox made a motion to approve as written. Paul Wolff seconded. Vote was unanimous. Tom
Groover made a motion to adopt the Resolution to accept the contract to replace 37001f with
the contract not to exceed $200,000 as mayor and council are acting on this under emergency
circumstances and using that exception under the Public Works Construction Law. Barry
Brown seconded. Vote was unanimous.
Paul Wolff made a motion to adjourn. Tom Groover seconded. Vote was unanimous.

Mayor Buelterman called the special city council meeting to order at 6:00PM on July 29, 2013.
Those present were Mayor pro tern Wanda Doyle, Paul Wolff, Tom Groover, Jan Fox, Barry
Brown and Bill Garbett. Also attending were Diane Schleicher, City Manager; Bubba Hughes,
City Attorney; Tommy Branch, Callaway, Braun, Riddle and Hughes, PC; Angela Hudson,
Finance Director; and Janet LeViner, Clerk of Council.
Consideration of Bids, Contracts, Agreements and Expenditures
Elkins Constructors, Construction Manager at Risk. Paul Wolff made a motion to approve as
written. Jan Fox seconded. Voting in favor were Paul Wolff, Tom Groover, Jan Fox, Wanda Doyle,
and Bill Garbett. Voting against was Barry Brown. Motion carried 5-1.
Merit Pay: To obtain the City Council's approval of the one-time lump sum merit
payment. Jan Fox made a motion to grant the one time lump sum merit payment and take from
the fund balance. Wanda Doyle seconded. Voting in favor were Tom Groover, Jan Fox, Wanda
Doyle, Barry Brown and Bill Garbett. Voting against was Paul Wolff. Motion carried 5-1.
Time Clocks: Approval to increase the General Fund's Operating budget by $3,600 in
order to purchase time clocks. We are requesting to increase the IT FY14 budget by
$3,600 from $415,330 to $418,930; and to increase the General Funds revenue line item
prior year fund balance by $3,600. No vote taken.
Water/Sewer Budget Increase: To obtain the City Council's recommendations for
funding the Jones Avenue water line replacement and re-paving of the road this is
estimated to cost $1,200,000. Currently, the Jones Avenue water line replacement
project is budgeted in two funds, Water & Sewer Fund, $570,000 and the SPLOST 2008
Fund, $630,000. The Water & Sewer Fund's budget includes a revenue line item of
$660,000 to cover the cost of the project with the proceeds being borrowed from the
Georgia Environmental Authority. The re-paving part of the Jones Avenue project is also
budgeted in the SPLOST 20087 budget for $178,000. No action taken.
Amend Water & Sewer Fund's FY 2014 Budget by Resolution. To obtain the City
Council's approval by resolution to amend the Water & Sewer Fund's FY 2014 budget by
$119,000 for the water & sewer rate increase effective August 1, 2013. Jan Fox made a
motion to approve the budget increase. Tom Groover seconded. Vote was unanimous.
Consideration of Ordinances, Resolutions
FY 2013-14 Millage. Jan Fox made a motion to approve the millage rate at 4.158. Paul Wolff
seconded. Vote was unanimous.
Ratification of Budget Ordinance 22-2013 (Capital Budget). Jan Fox made a motion to
ratify the capital budget for FY 2014 with the budget adjustment of moving the AMR project from
the water/sewer fund to the SPLOST fund in the amount of $630,000 and moving the same amount

from the Jones Avenue water line project back to the water/sewer fund. Wanda Doyle seconded.
Vote was unanimous.
Ratification of Budget Ordinance 23-2013 (Operating Budget). Jan Fox made a motion to
approve the operating budget for FY 2014. Paul Wolff seconded. Vote was unanimous.

waive the $500 water/sewer deposit. Paul Wolff seconded. Vote was unanimous.

Permits and Rentals Summary
Our total revenue for this quarter,is down a bit
from the same quarter in 2012.
The number of Guard House rentals were down
from this time last year,which is most of the
difference.
Also,there wasn't as many weddings this
quarter,as in the past.
More than normal coming in August.
'As you can see in the previous slide,Karen has
been very busy with processing applications and
permits for the upcoming quarter.

Summary of the Wastewater Treatment Plants Activities for the Past Quarter
1 April, 2013 thru 30 June, 2013
Grounds Maintenance
The trash was picked up daily and the grass was cut.
Operations and Process Control
Digesters were filled and decanted from daily. pH samples were collected from the Influent and Effluent on a daily basis.
The press was run 7days a week since may, because of the higher flows. It was run for at least 12 hours each day. The
plant is checked out at least once each day. On weekends it is checked by Richard Harnage and myself. The plant is
running very good and we are still getting low numbers on our tests. The percentages on the sludge cake solids are very
high.
The average Effluent flow for the quarter was .835 MGD
Maintenance
Clarifiers and Digesters were hosed off daily. The UV contact chamber was cleaned daily as well. Buildings were cleaned
and all other equipment is inspected daily. Some springs were replaced on the Press's conveyer and a new air
Compressor was installed. Preventive maintenance is done according to schedule. We are now using a computer
maintenance program to track and report all maintenance.
Laboratory
Lab results outline the fact that the plant is at peak running condition. All test results are well within permit limits.
Microscopic examination shows that there is a healthy variety of organisms within the system.

The wells are in good shape and there have been very few problems with them. The new water meters are
being installed and the installation should be complete by November. There have been a total of 350
installed so far. The new sewer line is also going well, with a total of 2,000 feet installed so far. There are
no major problems to report.

APPLICATION: Special Review
COMMUNTTY CHARACTER MAP: Arts,Eats,Eco-business Corridor
PROPOSAL: The applicant represents the Tybee Lights Condominium Association. The request is removal of
vegetation at 106 through 116 Butler Avenue. The applicant also stated a request to remove trash. Staff advised
that city approval or a permit were not required for trash removal.
ANALYSIS: Mr. Brad Gane of the Department of Natural Resources Coastal Resources Division recently issued
a Letter of Permission(LOP)to the Tybee Lights Condominium Association. The LOP allows pruning of existing
vegetation adjacent to the building (oleander and pampas) and permanent removal of an invasive species known
as salt cedar. All work is to be accomplished using hand tools. Herbicide would be used to destroy the salt cedar.
Per the LOP,because the work would occur during turtle nesting season the condo association must consult with a
DNR Sea Turtle worker prior to beginning the project. Staff has provided the applicant with the name and phone
number of the local DNR Sea Turtle coordinator.
Special Review approval of the proposed project is required by Land Development Code (LDC) Section 3-100;
Beach,Dunes, or Vegetation Disturbance/Crossover Maintenance and Construction:
It shall be unlawful for any person in any manner to damage, destroy, remove, or alter in any way the
beach, dunes or vegetation thereon in the area within the jurisdiction of the Department of Natural
Resources under the Shore Protection Act (O.C.G.A. 12-5-230, et seq) without having first obtained the
proper federal, state and local permits. Special review shall be required for any alteration, construction
or disturbance of beach, dunes or vegetation thereon including the alteration or construction of dune
crossovers;provided, however city projects, approved special events or the maintenance of existing dune
crossovers, including the replacement of supports, decking boards, pilings and or handrails, for
placement in the same location as then currently exist, shall not require special review.
Within any area within the jurisdiction of the Department of Natural Resources under the Shore
Protection Act (0.C.G.A. 12-5-230, et seq.), there shall be a ten (10)foot setback measured from the
landward toe of the landward-most dune as delineated by the Georgia Department of Natural Resources.

Section 5-070, Standards for Special Review
Land uses listed in Article 4 of this Land Development Code that are permitted after special review
must follow an administrative procedure prior to the issuance of any land development permit.

(A) Review criteria. The planning commission shall hear and make recommendation upon such
uses in a district that are permitted after special review. The application to establish such use
shall be approved by the mayor and council on a finding that:
(1) The proposed use will not be contrary to the purpose of this Land Development Code;
(2) The proposed use will not be contrary to the findings and recommendations of the master
plan;
(3) The proposed use will not be detrimental to the use or development of adjacent properties
or the general neighborhood or adversely affect the health and safety of residents and
workers;
(4) The proposed use will not constitute a nuisance or hazard because of the number of
persons who will attend or use such facility, vehicular movement associated with the use,
noise or fumes generated by or as a result of the use, or type of physical activity
associated with the land use;
(5) The proposed use will not be affected adversely by the existing uses of adjacent
properties;
(6) The proposed use will be placed on a lot which is of sufficient size to satisfy the space
requirements of said use;
(7) The parking and all development standards set forth for each particular use for which a
permit may be granted will be met.
(B) Additional mitigation requirements. The planning commission may suggest and the mayor and
council may impose or require such additional restrictions and standards (i.e., increased
setbacks, buffer strips, screening, etc.):
(1) As may be necessary to protect the health and safety of workers and residents in the
community; and
(2) To protect the value and use of property in the general neighborhood.
(C) Adherence to requirements. Provided that wherever the mayor and council shall find in the
case of any permit granted pursuant to the provisions of these regulations, noncompliance of
any term, condition, or restrictions upon which such permit was granted, the mayor and
council shall rescind and revoke such permit after giving due notice to all parties concerned
and granting full opportunity for a public hearing.
(D) Permit longevity. If a building permit or other preparations or conditions are required prior to
implementing special review approval granted by the mayor and council such permitting or
other preparations or conditions must occur within 12 months from the date of special review
approval. Such approval is based on information provided in the application. Building permits
may only be granted for plans consistent with the approved application. Any deviation from the
information submitted will require separate approval by planning commission and mayor and
council. In the event of a hardship or other extenuating circumstance the permit holder may
apply to the designated city official for a one-time extension of permit approval. Permit
extensions may not be approved in extenuating circumstances for a period of no more than 180
days. Should the permit not be exercised in the extension period it will expire.

The general character of the area surrounding the Tybee Lights property is fully developed residential, including
single-family and multi-family dwellings. The Tybee Lights condominiums have views of the Atlantic Ocean.
Located near"the curve,"the adjacent dune field is smaller than that of most other oceanfront properties.
The property is within the R-T,Residential Tourist District. Section 4-050(D) of the LDC describes the district:
The purpose of this district is to provide for areas where tourists and residents are mixed. Development
