Mayor Man called the City Council Special Meeting to order at 6:30 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLLCALL PRESENT: Councilmember-Chavez, Yu, Sternquist (6:33 p.m.), Fish, Man ABSENT: Councilmember-None ALSO PRESENT: City Manager Cook, Assistant City Attorney Murphy, City Clerk Kuo Mayor Pro Tern Fish made a motion to excuse Councilmember Sternquist. Seconded by Councilmember Yu. 3. PUBLIC COMMENTS Wendy Poon, Feng Lan Liu, Jung Ho, Hubbert King, Cindy Lee, Betty Ren, Temple City resident, spoke against City of El Monte's cannabis facility project. Jody Yu, San Gabriel resident, spoke against City of El Monte's cannabis facility project. Betty Ren, Temple City business owner, spoke against City of El Monte's cannabis facility project. Qiang Bak, Rosemead resident, spoke against City of El Monte's cannabis facility project. Gabriel Ramirez, El Monte resident, spoke against City of El Monte's cannabis facility project. 4. Purpose: Potential Cases: Authority: Representatives: Employee Performance Evaluation City Manager Government Code Section 54957 City Council Anticipated Litigation One (1) Government Code Section 54956.9(d)(2) City Attorney City Council Minutes January 15, 2019 Page 2 of 2 City Council recessed to closed session at 7:07 p.m. and reconvened with all members present at 7:54 p.m. CLOSED SESSION STATEMENT Assistant City Attorney Murphy reported that City Council continued Item 4A, "Employee Performance Evaluation" to a future meeting. Before Assistant City Attorney Murphy reported out on Item 4B "Anticipated Litigation", he made a statement, as directed by the City Council, reiterating that City Council made a unanimous decision to send two of their members (i.e., Mayor Man and Councilmember Yu) to represent Temple City at the El Monte's Council meeting on December 18, 2018. Three Councilmembers (i.e., Councilmember Chavez, Councilmember Sternquist, and Mayor Pro Tern Fish) volunteered to stay behind and conduct their own meeting on the same night. City Council did act together and agree on what the two councilmembers would say at the El Monte's meeting. Reporting out on Item 4B "Anticipated Litigation", Assistant City Attorney Murphy shared that City Council has directed the City Attorney's office to file a lawsuit against City of El Monte with respect to their recently approved project (i.e., cannabis cultivation and processing facility at 4400 Temple City Blvd.) based on their violation of the California Environmental Quality Act. The lawsuit will be filed within the week. Assistant City Attorney Murphy also stated that the City has received many statements by the public with respect to the El Monte's project, many are matters that cannot be carried forward by the City. He informed the public that if any person who feels that they have been wronged or had their rights violated in regards to the El Monte's project, and would like to pursue further legal actions, they would need to hire their own attorney and take action on their own. City of Temple City will not be able to address the individual complaints or file a lawsuit on their behalf. 5.
