BE IT ORDAINED by the Council of the City of Lynwood as follows: � Section 1. Definition of V�'ords and Phrases. The follo�ving words and phrases vrhen used in this ordinance shall, for the purpose of this ordinance, have the meanings respectively ascribed to them in this:sectlon. (A) BICYCLE. A vehicle having two (2) wheels set tandem, propelled in whole or in part by human poK�er applied. through pedals, designed for seating and carrying one or more persons -- the number carried being determined by the number of seats.built onto the vehicle by the manufacturer thereof. (this shall not be construed to mean seats other than those built and affixed by the manufacturer as an integral part of I the vehiclets structure. Seats affixed in ar�y manner to any portion of the vehicle►� structure by the owner or operator thereof sYiall be constTUed as illegal and the carrying of one o� more persons upon such shall be an illegal practice). (B) CHIEF OF.POLICE. The nrords ��Chief o f Police" as I used herein shall be deemed to mean the Chief of Police of the City of Lynwood or any member of the police department of the City of Lynwood designated by the Chief of Police to act in his place and stead in carrying out�the provisions of this ordinance. (C) RENTAL AGENCY. Any person, firm, co-partnership, .association or corporation engaged in the business d' offering for rental and renting bicycles for use by the public. (D) OPERATOR. That person vaho is actually engaged in the act of propelling, guiding or handling the vehicle at any given time. -1- i � � � . (E) OVVNER. That person, firm, corporation, company or association in whose name ihe title of said vehicle is vested. (F) REFLECTOR. Any device constructed of any durable substance and/or metal and/or glass which will be visible from all distances within 200 feet directly in front of a motor vehicle at night displaying lawfully lighted headlights, such device to be so constructed as to show a red color when struck by motor vehicle lights as above stated, such device to be aff'ixed to the rear of the bicycle at any point on the frame or mudguard at a heighi betvaeen axis of the wheel and the bottom of the rider's seat. . I Section 2. Re�istration of BicYCles. (A) REQUIRED. From and after April 6, 1945, it shall be unlawful for any person to operate or use a bicycle upon any of the streets, alleys or public highv+ays of the city without first obtaining from the Chief of Police a license therefor. (B) PROCEDURE. The Chief of Police of the city is hereby authorized and directed to issue, upon written applica- tions, bicycle licenses vrhich shall be effective from the 6th day of April, 1945 to and including December 31st, 1945, and thereafter said licenses shall be issued for the calendar year, commencing on the lst day of January of each year and ending on the 31st day of Decer.cber of said calendar year, a�hich licenses, when issued, shall entitle the licensees to operate such bicycles for v,�hich said licenses have been issued, upon all the street,s, • alleys and public highways� exclusive of�,the :sidewalks thereof, in the City of Lynwood. (C) LICENSE PLATES. The city shall provide each year durable license plates, together with registration,cards, said plates and registration cards having numbers stamped thereon in _2_ � � numerical order, beginning with Number 1, and indicating the year for which the �ame are issued, and the letters "L.B.L. stamped thereon. Such license plates shall be suitable for attachment upon the cicycles, by suitable means, and it shall be the duty of the Chief of Police to attach one such plate to eacn bicycle and to issue a corresgonding registration card ' to each licensee upon the payment of the license fee herein provided for. 5uch license plate shall remain attached during the existence of such license. The Chief of Police shall also keep a record of the date of issue of each license, to whom issued, the number thereof, and the number of the cicycle frame. (D) RE-REGISTRATION. Bicycles registered under the provisions hereod shall be re-registered on January lst, 1946, and annually thereafter. The C hief of Police shall affix a new license plate upon each bicycle at the time of such re- I registration thereof. (E) REGISTRATION CERTIFICATE ON PERSON. The owner or I operator on ar�v street or riighway in the city of a bicycle shall carry on his person the certificate of registration of such bicycle and shall produce -same for, inspection wherever . it may be demanded by the Chief of Police or any police officer:s or other person duly authorized to demand its production. (F) INSPECTION. The Chief of Police shall inspect each bicycle presented to him for registration, and he shall have the authority to refuse to register any such bicycle found by him to be in unsafe mechanical condition. ' (G) FRAME SERIAL NUIidBERS. It shall be unlawful for any person to v�rillfully or maliciously remove� destroy, mutilate � or alter the number of any bicycle frame licensed pursuant to this ordinance. It shall also be unlawful for any person to -3- . � • remove, destroy, mutilate or alter any license plate or registration card during the time in K'hich such license plate or registration card is operative; provided; however, that nothing in this ordinance shall prohibit the Chief of Police from stampir� number.s on the frames of bicycles on which no serial number can be found or on vrhich .said number is illegible � or insufficient for identification purposes. (H) FEES. The annual license fee to be paid for each bicycle shall be fifty cents. Al1 license fees shali be paid � in advance, and, pursuant to Section 3 of this ordinance, such license may be transferred when the ovmership o f said bicycle is transferred, and a fee of twenty-five cents shall be paid for the registration of such transPer. Al1 license•fees collected under this ordinance shall be collected by the Chief of Police of the city and paid by him into the General Fund of the City of Lynwood. Section 3. Transfer of License. (A) INDIVIDUALS. It shall be the duty of every person who sells or transfers ownership of any bicycle to report such sale or transfer ivithin ten days thereafter by returning to the Chief of Police the registration card issued to such person as licensee thereof� together �vith the name and address of the person to tivhom said bicycle was:sold or transferred; and it shall be the duty of the purchaser or transferee of such bicycle to applyfor a transfer of registration thereof within ten day.s of said sale or transfer. � l i (B) DEALERS. All persons engaged in the business of � buying second-hand bicycles are hereby required to make a weekly report to the Ghief of Police, giving the name and address of the person from rrhom each bicycle is purchased, the description of each bicycle purchased, the frame number thereof, and the -4- . . ` � , number of the license plate found thereon, if any. ATl persons engaged in the business of selling new and second-hand bicycles are hereby required to make a weegly report to the Chief of Police, givin� a list of all sales made by such dealer,s, the kind of bicycle sold, together with a description and frame number thereof, and the number of the licence plate attached thereto, if any. All persons purchasing second-hand bicycles shall retain the same in their possession for a period of ten days. (C) DIS�dANTLING. Within ten days after any bicycle registered hereunder shall have been dismantled and taken out of operation, sach information sha13 be reported to the Chief of Police by the person iu whose name the bicycle has been registered. Section 4. Rental A�encies. (A) SUPEfiVISION. It snall be the dUty of the Chief of Police to make periodic inspections of bicycles offered for rental by all persons engaged in the business of renting bicycles to the public; and all persons so engaged in the business of renting bicycles shall be responsible for the condition of all bicycles offered for rental by them, and also sha11 be responsible for equipping said bicycles tivith proper lights and other safety equipment as required elsewhere in this ordinance. Section 5• ProPer Use. ` No person shall ride or propel a bicycle upon any street, public highway or other lane of travel in the city or upon any part thereof in violation of the follovaing provisions, and observance of such provisions are herein imposed under this ordinance. -5- , . . (A) No person.shall~ride or propel a bicycle on a street, lane of travel or other public highway of the city with another person on,the handlebars or in any position in front of the operator. (B) No bicycle shall be ridden or propelled faster than is reasonable and proper, but every bicycle shall be . , operated with reasonable regard to the safety of the operator and other persons upon the streets and other public highways + of tne city. . (C) Persons riding or propelling bicycles shall observe and obey all traffic signs, traf£ic lights, traffic signals, and other existing traffic regulations, and shall stop at all stop signs and signals. (D) No person shall ride or propel a bicycle upon any street or other public highway in the city, maintainir� a _---- �. . riding position abreast of any other person riding or propelling a bioycle.. Persons riding or propelling a bicycle must ride or propel such bicycle in single file manner and at a safe and proper distance behind any preceding bicycle. (E) Every person riding or propelling a bicycle upon any street, lane of travel or other public highway in the city shall observe and obey all traff'ic rules and regulations applicable thereto, signal for all turns, ride at the right- hand side of the lane of travel� street or highway, pass to the left when passing overtaken vehicles and indiuiduals that are slower moving, and sha11 pass vehicle.s to the right when meeting. (F) No person shali ride or propel a bicycle on the . sidewalks of the City of Lynwood. (G) No person shall ride or propel a bicycle on a lane of travel� street or other public highway of the city in.a reckless or dangerous manner or in a manrier without reasonable regard to the safety of the operator and other persons upon _ . , . ., . , the lane of travel, street or other highway. (H) Persons riding or propelling bicycles :shall ride in a straight line of travel, turning only in accordance with traffic requirements and shall not weave in and out of such traffic, nor snall such bicycle rider operate or propel his bicycle in a circle or turning manner crossing path of oncoming or meeting � vehicular traffic. (I) No person shall ride a bicycle from the.sidewalk or driveway into the street, lane of travel or other public highway l i without first halting such bicycle and bring such bicycle to a complete stop before entering the lane of vehicular traffic. (J) No bicycle shall be permitted on any lane of travel, street or other public highv�ay of the�..city or upon any part � thereof, between thirty minutes after sunset and thirty minutes before sunrise, without a vahite headlight visible under normal atmospheric conditions from the front thereof for a distance of not less than 300 feet indicating the approach or presence of the bicycle, attached to such bicycle and properly lighted. Every bicycle shall also be equipped with and exhibit a red light on the rear visible under normal atmospheric conditions and during the period set forth above,'from a distance of at least 200 f'eet to the rear, except that a red reflector meeting the requirement of this section may be used in lieu of the rear light. (K) No person shall ride or propel a bicycle on ar�y lane of travel, street or other public highway unless such bicycle is equipped with a bell or.other device capable of giving a signal audible for a distance of at least 100 feet, except that no bicycle ,shall be equipped with, nor shall any person use upon a bicycle, any siren or v�histle. (L) No person riding upon arLy bicycle, coaster, roller skates or toy vehicle shall attach the same or himself to any _7_ T � � i � . I vehicle on the street, lane of travel or public highway in the city. (M) No person .shall deface, mutilate or remove any identification tag, number of other attachment or equipment placed upon ar�v bicycle, nor shall any person take any bicycle for the purpose of riding or propelling the same upon the street, lan�e of travel or other public highway without the consent of the owner. (N) The parent of any child and the guardian of ar�y ward or any employer shall not authorize or knowingly permit any such child or ward or employee to violate any of the pro- visions o•f this article or section. . � (0) Ridin� While Intoxicated. It shall be unlawful for any person to operate a bicycle upon any ,street or highway. of the city while under .the inf•luence of intoxicating liquor or drugs. Section 6. Authoritv to Revoke or Suspend Licenses and Imnound Bicvcles. (A) Procedure. The Chief of Police is hereby authorized and empovrered to administer the provisions of' this ordinance, and all police oificers are hereby cYiarged with the duty of en- forcing the provisions hereof. The Chief of Police is hereby empov�ered to suspend or revoke any license issued under the � provisions of this ordinance for any violation thereof; or of I any of the ordinances of the city relating to street traffic insofar as the same are applicable. The Chief of Police is also ' I empowered to impound any unregistered or improperly registered i bicycle. The action of the Chief of Police as to any of the matters referred to in this section shall be conclusive and final. No license shall be issued to or for any person who has had a � license revoked until the expiration of one year from the date I of revocation. (A) Every person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of , misdemeanor and upon conviction sha11 be punishable by a fine of not more than Three Hundred Dollars ($300.00), or by imprison- ment in the City J�il a period o£ not more than three months, or b5r both such fine and impri,sonment. Section 8. Repeal of Conflictin�.Ordinances.. (A) If any clause, sentencg, paragraph or part of this ordinance shall for any reason be ad�udged or deemed to be in- - valid by any court of competent �urisdiction, such �udgment or decree sha11 not affect, impair or invalidate the remainder af this ordinance, but sha11 be confined 3n,its effect to,the clause, sentence, paragraph or part thereof directly involved in.the controversy in which said judgment.or decree shall have been rendered. „ " Section 9• Ordinance in Force. (A) This ordinance shall be in force utta effect from and after its passage and publication as provided by Charter.
