' The City Council oY the City of Lynwood does ordain as followat - � 8ection 1: That a Depart�ent of Purchasssr. ia hereby ea- tablished for the purpose of making all purekiases and salee, except articles required by.the State codes to be purchased otherwiae and land and permanent improvement thereon, for the City of Lynwood. , The Department of Purchasea will be headed by a Purcha,eing , Agent who will be the City NIanag�er or some City Emnloyee delegated by the City Manager. The Purchasing Agent sha.11 have full authority to purcha.se or provide_Por the purchaseof all materials, supplies and equipment for the use of all Departmenta, Commiasions, and Boords con;prising the .. ,�,_ .,._. .,_, , - _-.. . , City Government, in accordance with the provisions as herein provided. No purchase oP an article, service or thing-sha.11 be made by any De�artment Head independently of the Purchasing Agent except in casea of immediate emergency that occura when the office of the Pur-- chasing Agent is not open for the conduct of the Gity�s buaineas. In such instancea, the Department Head may make the necessary emergency purchase and ahall report the same in writing to the Purchasin� Agent . within twenty-Pour (24) hours, accompanied by a definite statement oP the occasion and reasons for such emergency purchase. The Purchasing Agent shall submit such report;'with recommendations to the City Manager for approval of payment. The City Purchasing Agent, to�ether with the City Manager, shall as soon as conveniently posaible after the ePfective date of i _ thia ordinance prepare, when in the',�udgment of the City Manager it is practicable, apecificationa governing all purchasea of the City of Lynwood ae pronided Por in the budget for recurring expenditures and auppliee and aubmit the same for approval to the City Council, and the specifications �pproved by the City Councfl ahall be adhered to by the City Purchaeing Agent in making purchases upon requisitiona duly approved from the various Departmente of the City of Lqnwood. Section 22. That all purchasea in the amount of One Hundred (�100.00) Dollara or less ahall be made by the City Purchasin� Agent, after giving reasonable notice and opportunity for competitive bidding, by soliciting verbally, by telephone, by telegraph, or letter, as he may determine, not less than three (3) proposals in the event three independent vendora are available, and iP less than three vendore are available, then the Purchasin� Agent shall secure such bida as will, in his �udgment, inaure that the City of Lynwood ia purchaeing the article, service or thing desired to be pur chased, at the lowest posaible coet. In the event the article, aervice or thing to be pur- chased involves an expenditure of One Hundred (�100.00) Dollara or lesa, and there are no previous apecifications approved by,the City Council � as to such article, aervice or thing, the Purchaeing Agent ahall pre- pare apecifications where practicable, sub�ect to the approval of the . City Manager, and the Purcha.sing A�ent sha,ll further have the authority to awar+d such purchase to the lowest and best bidder. 3ection 3: That all purchases amounting Rnore than One Hun- dred (�100.00) Dollara, but lesa than One Thousand ($1,000.00) Dollare, shall be made by the City Purchasing Agent in response to aealed bids received by the CiLy Purchasing Agent and based upon plana and speci&- I cationa Por the article, aervice or thing to be purchased, there�ofore approned by the City Council or City Manager as the aase may be, and certified copiea of these specifications are to be kept in the office of the purcha.sing Agent and open to the public for inapection, Pur- cha,ses involving an expenditure in an amount more than One Hun�red (�100.00) Dollara, but leas than One Thousand (�1,000.00) Dollare, and where there are no previous apeciPications approned by the City Council r S se to such article, service or thing, apecifications shall,be..prepared by the Purchasing Agent and be approved by the City Manager, of which .certified Copiea are kept on file in the office of the Purchasing Agent. The notice inviting bida ahall fix a definite limitation of the time ad thin which bids will be received at not less than three �3) days, . and sha.11 fix a definite time at which the bids will be opened. The `. notice inviting bids for the purchase of the article, service or thing shall be poated upon a bulletin board, provided for that purpoae, outaide oP the City Purchasing Agent�s office, in,the I�unicipal Building in City of Lynwood, and in like manner the award ahall be arinounced by posti,ng a notice thereof upon said bulletin board. The Purchaeing . Agent shall, in addition to posting the apecificationa and intention � to purchase on said bulletin board, send out invitationa to biddera by letter, telephone or telegraph and may cause such apecificationa and , intention to purchase to be published in the of ficial newspaper publi- cation of the City of Lynwood if, in his ,�ud�ment and that oP the City I�anager, it will be to the City's advantage to do so. The sealed bids shall be receined in the office of the City Purchasing Agent and ahall ", be opened by the City Purchasin� Agent who ehall determine the most advantageous bid for the City, and shall, upon the approval of the City B�anager, accept the proposal of the party submitting the lowest, secure bid. If in the opinion of the City Purcha.eing Agent, none of said bide are satisfactory, then he may, with the approval of the City Manager re�ect.all of the bida and proceed to purcYiase the article, service or thing/desired in the open market, sub,ject to the approval of the City blanager: The City E'Ianager may re�ect any and all bids and may direct the Purchasing Agent to reaolicit or readvertise as may be determined , by him. Section 4 0 That all purchases of One Thousand ($1,000.00) Dollara or more, including current supplies, services, contracts or thinga, ahall be based upon apecifications theretofore approned by the � City Council, the original of which shall be filed in the office of the City Clerk, and certified copiea in the office of the City Pur- chasing Agent and open to public for inspection. The notice inviting bids to purchase any suppliea, servicea, contracts or thin�s, shall be advertised upon authority of the City Council and auch advertieement sriall be publiahed in the official newapaperypublication of the City of Lynwood, and in addition invitations to bid may be mailed to pros- pective vendora at the descretion of the City Manager. The bids sub- mitted shAll be received by the City Purcha.aing Agent, to be opened by_him in the presence of the City Clerk at the time degignated. The opened bids will be available at all times for public inspection from the time opened until the award has been made by the City Council. The Purchasing Agent sha.11 tabulate all bida received and the City Manager ahall recomatend to the City Council which in his opinion is the best and lowest bid. The City Council shall thereupon determine the most advantageoua bid for the City and shall aecept the lowest and best bid and if in the opinion of the City Council none of said bids are satiafactory, then the Governing Body may re�ect all of the bida and the City Purchasing Agent may be authorized to proceed to purchase the article, aervice or thing desired in the open market, sub�ect to the appronal of the City n4anager er City Council as the case , may be. The City reaerves the right to re�ect any and all bida and to read.vertise as may be determined in the discretion of the officera authori2ed to pass upon the proposed purchase as aet forth in this or� dinance. Section 8 : `1'nat tne fletails of procedure and forms to be foilowed in tne isauance oi' requisitions and in discnarging tne dutieei: placed upon the City Purchasing Agent and the purchaae of articles, ae well as in the sale of personal property, shall be prescribed� by the City NIanager eub,�ect to the provisiona of this ordinance. Section 9 : All ordinancea on this matter heretoflore enacted are expresaly repealed. y Section 10: The City Clerk if hereby ordered and directed to certify to the passage of thia ordinance and to cause the same to be publlshed once in the "Lynwood Presa", a newspaper of general circulation, printed, published and circulated in the City of Lqnwood. This ordinance ahall be effective thirty days after peasage.
