While I am not statutorily obligated to explain why I want to inspect these records, I tell you it is for the purpose of informing myself of the historic and current workings of the Town of Gulf Stream and its associated entities, vendors, consultants, advisers, contractors and agents. The records I wish to inspect may also be material to current, anticipated or presently unforeseen legal action. In addition, inspection of these records may be essential to my ability to make informed comments in an upcoming public hearing. The production of any and all responsive records is therefore urgent and must be acted upon in compliance with Florida Statutes and established case law as soon as possible. I make this request pursuant to Article 1, Section 24 of the Florida Constitution and Chapter 119 of the Florida Statutes. I hereby reserve all rights granted to me under the Florida Constitution and Florida Statutes. I ask that you take the following action: Read this entire request carefully and respond accordingly. If you are not the custodian of the public records described herein please determine who that person is and notify me immediately in order that I may make this request to the appropriate person without delay. Reference Florida Statutes and appropriate case law when responding to this record request. Do NOT produce any records other than records responsive to this request. Identify by name the person or persons responding to this request if that person is not the Custodian of Records for your agency as required by 119.07(1)(b). Respond to this public record request in a singular manner and do not combine this request with any other public record requests when responding to this request. Once you have determined that you do or don't have any records in your custody responsive to this request, immediately act to obtain any responsive records that may be in the custody of your contractor(s) or other parties. Provide only those records for inspection that do not require extensive use of information technologies or extensive staff time or both in excess of 15 minutes. • If records responsive to this request are not presently available but you expect that they will soon be available I request that you produce the records as soon as they are available. I ask you to take note of §119.07(1)(c) Florida Statues and your affirmative obligation to (1) promptly acknowledge receipt of this public records request and (2) make a good faith effort which "includes making reasonable efforts to determine from other officers or employees within the agency whether such a record exists and, if so, the location at which the record can be accessed." I am, therefore, requesting that you notify every individual and entity in possession of records that may be responsive to this public records request, including individuals and entities under contract with your agency, to preserve and produce all responsive records on an immediate basis. If you contend that any of the records I am seeking, or any portion thereof, are exempt from inspection or disclosure please cite the specific exemption as required by §119.07(1)(e) of the Florida Statutes and state in writing and with particularity the basis for your conclusions as required by §119.07(1)(f) of the Florida Statutes. Produce for my inspection all responsive records and ONLY redact that portion of the record that you consider exempt. To be clear, if you consider an entire record to be exempt, produce that record in its entirety with all portions redacted that you consider exempt. I specifically ask you to do this in order that I may inspect fully redacted records for the purpose of challenging a particular redaction or establishing a reference for a future request of a record that is only temporarily exempt, as in the case of a public record that was prepared by an agency attorney exclusively for litigation and is only exempt from disclosure until the conclusion of the litigation. If the public records being sought are maintained by your agency or contactors for your agency, in an electronic format please produce the records in the original electronic format in which they were created or received. See §119.01(2)(f), Florida Statutes. Again I ask that you provide only those records for inspection that do not require extensive use of information technologies or extensive staff time or both in excess of 15 minutes. Take note of §119.07(4)(a)3.(d) Florida Statues and if you anticipate that any records exist, the production for inspection of which will require extensive use of information technologies or extensive staff time or both in excess of 15 minutes, then please provide those records that can be produced within the first 15 minutes and advise me of the cost you anticipate to be incurred by your agency for the remaining records prior to incurring this cost. Please do not incur any costs on my behalf without first obtaining my written authorization to proceed. If you produce only a portion of all existing responsive records, please tell me that your response includes only a portion of all existing records responsive to this request. If you anticipate the need to incur any costs that I would be statutorily required to pay in order to inspect these public records which would exceed $1.00 please notify me in advance of your incurring that cost with a written estimate of the total cost. Please be sure to itemize any estimates so as to indicate the total number of pages and/or records, as well as to distinguish the cost of labor and materials. Again, please do not incur any costs on my behalf without first obtaining my written authorization to proceed. A record that does not exist because of its disposition requires the creation of a disposition record. In all instances where you determine a record does not exist please determine if the record once existed and in its replacement provide the disposition record for my inspection. As background to this request I call your attention to Ord. 16/02 amending Sec. 66-1. - Definitions. Waterway shall mean any permanent body of water including the Intracoastal Waterway, Atlantic Ocean, canals, coves and basins. I understand from this ordinance that the publicly owned area known as Polo Cove and all other bodies of water which are defined in Sec. 66-1 of the Town of Gulf Stream's Municipal Code to be a Waterway. I request to inspect the following public records* in the Town of Gulf Stream's** custody: Records related to the Florida Inland Navigation District (F.I.N.D.) AND minor accessory structures, as defined by Town code 70-51(7), in areas defined by Town Code to be a Waterway. AND The Florida Inland Navigation District (F.I.N.D.) The Clerk administered the Oath to Mr. Inman, Mr. Farach and Mr. Durrance. Commissioner Devitt declared a continued conflict with the Hedberg application in that his mother has the property under contract for sale. Town Clerk Taylor asked if there were any exparte communications to declare. There were none. VII. PUBLIC HEARING. A. Applications for Development Approval 1. An application submitted by Manuel Farach, as Agent for Donald Hedberg, the owner of property located at 700 Wrightway, Gulf Stream, Florida, which is legally described as Lot 1, H. V. Pope Subdivision. (Postponed from 2-13-04) CONTINUED FROM MARCH 12, 2004. Mr. Farach called Mr. Durrance to the stand to explain the result of the bathometry survey that was done. Mr. Durrance displayed surveys of the property and explained that the original location of the lift further south on the seawall has a depth of 3.4 feet, which would not allow the boat to float off of the boatlift. The existing location of the boatlift, off the dock, allows 3.5 feet, which would allow the boat to float off of the lift. Attorney Farache asked if it is possible to dredge providing for one foot of clearance. Mr. Durrance said it is possible but the permitting process through the Corps of Engineers and the Department of Environmental Protection would be very difficult. Mr. Durrance referred to a section from the Corps Administrative Code. He added that if sea grass is present, the agency would not approve a permit for dredging. Commissioner Orthwein asked why the dock couldn't be moved to the south. Mr. Durrance stated that there would not be sufficient clearance with the neighbor to the south for navigation. Town Manager Thrasher asked if a dredging permit has been applied for to date. Mr. Durrance said no. Mr. Inman stated that if there were five or more people on the boat during low tide, it would be too shallow for the boat to float off of the lift. Mr. Buckley, the prospective buyer, stated that he plans to use his boat frequently and he is willing to explore the possibility of dredging, but in the meantime he wants to be able to use his boat. Attorney Randolph advised that final decision could be deferred until the property owner has the opportunity to obtain a dredging permit or prove a hardship for the variance and the Town could abate enforcement. Attorney Randolph counseled that if the Commission believes the applicant does not meet the requirements of a variance currently, the applicant should be aware that if they are unsuccessful in obtaining a dredging permit, there is no assurance that the variance request would be approved. Regular Meeting & Public Hearing Town Commission Page 3 April 8, 2004 Commissioner Hopkins stated that he is not comfortable making a decision. Commissioner Orthwein believed that at this time, the criteria for a variance has not been met and deferring the application until a dredging permit is applied for does not guarantee the variance request would be approved. Town Manager Thrasher offered his assistance to the applicant in applying for the dredging permit a. VARIANCE to allow a boatlift to remain that is attached to a dock rather than the seawall which is in violation of Section 66-369(6)f, and which was installed without a permit being applied for. Commissioner Orthwein moved and Commissioner Lynch seconded to defer further consideration of this application in order to give the applicant an opportunity to make application for dredging permit within the next six months, during which time the applicant shall return to the Commission with what information is available regarding the dredging, and during this time the Town will abate enforcement of the Building Permit Violation and the Zoning Violation that is alleged to exist on the property at 700 Wrightway to afford the opportunity to move forward. The Commission made it clear that this action is not to be construed that a hardship exists or has been proven, and the applicant must appear before the Commission and prove a hardship on all eight criteria at the next hearing. Mr. Farach acknowledged that he understood the applicant must still prove a hardship. b. VARIANCE to allow a dock that was installed without obtaining a building permit, a 12' long portion of which exceeds the maximum permitted width of 5' as provided in Section 66-369(6)b., by 212". THIS VARIANCE REQUEST WAS WITHDRAWN BY AGENT AT ARPB HEARING. c. LEVEL 3 ARCHITECTURAL/SITE PLAN REVIEW to allow to remain, a nonconforming boatlift which was installed without a permit being issued. VIII. Reports. A. Town Manager Town Manager Thrasher asked for direction regarding the recommendation that Urban Design Studio made on suggested code changes relating to boat docks. The Commission determined that the ARPB review the recommendation from Urban Design Studio and make a decision to bring back for final decision. Town Manager Thrasher reported that he has obtained quotes for repairing the seawall at the bird sanctuary. The lowest quote to date is Regular Meeting & Public Hearing Page 4 Town Commission April 8, 2004 $110,000. He added that he would be working in conjunction with Palm Beach County, who would be moving fill material from a nearby dredging project in an attempt to acquire the fill for the seawall project. The Town Manager requested approval to proceed with the project with a cap of $140,000 coming from unappropriated funds. Town Manager Thrasher explained the Town is no longer receiving cable/telephone tax; it is now receiving a combined telecommunication tax. Commissioner Lynch asked if there was anything out of the ordinary. The Town Manager Thrasher said he is concerned about capital projects that were not anticipated and may require a budget adjustment in the future. He is also concerned about the water fund due to the rate increase from Delray and the installation of new water meters. Mayor Koch asked how many water meters have been change out. Activity for March 2004 Chief Ward asked that the report be accepted as submitted, if there were no questions, and added that Palm Beach County Regional Alert and Notification System is offering an alert notification system to municipalities and other entities that wish to participate. Regular Meeting & Public Hearing Page 5 Town Commission April 8, 2004 The Chief explained that participation would allow Gulf Stream residents high speed, high capacity alert notification in the event of an emergency. Chief Ward assured the Commission that each municipality would have a separate and private database, which would allow for a separate bulletin board system. The cost for participation would be $3000 annually, which would include support and training. Mayor Koch agreed that the alert system would be helpful in an emergency situation. Commissioner Orthwein complimented the outstanding job the Police department is doing. Commissioner Hopkins was concerned about privacy and maintenance costs and requested more information. IX. Items for Commission Action. A. Contract award for paving in Place Au Soleil Town Manager Thrasher explained that the 2003/04 budget provided funds for repaving the entrance of Place Au Soleil. The proposed project includes the relocation of two stop signs, modifying the configuration of the entrance and adding topsoil, grass and irrigation. The Town Manager requested permission to proceed with the project using the lowest quote of $14,640 that was presented by Carr Driveways, Inc. Commissioner Orthwein moved and Commissioner Lynch seconded to approve the contract award of $14,640.00, for paving in Place Au Soleil, to Carr Driveways, Inc. Roll Call: Comm. Devitt; AYE, Comm. Request for a contribution increase -Place Au Soleil Town Manager Thrasher reported that the Place Au Soleil Home Owners Association is requesting an increase in their annual contribution for every day expenses. Q • • • • • SOUTH FLORIDA WATER MANAGEMENT DISTRICT CHAPTER 4nE4, SURFACE WATER MANAGEMENT (RULES ADOPTED FOR DEP BY REFERENCE) 40E4.042 Formal Determination of Wetlands and Other Surface Waters. (1) In accordance with subsection 373.421(2), F.S., a real property owner, an entity that has the power of eminent domain, or any other person who has a legal or equitable interest in real property may petition the District for e formal determination of the landward boundaries of wetlands and other surface waters an that property as defined in chapter 62-340, F.A.C., and ratified by section 373.4211, F.S. (2) The Executive Director is delegated the authority of the Governing Board to take final action on petitions for formal wcdand and other surface water determinations. (3) The process and procedures for tiling a petition for a formal determination of wetlands and other surface waters are set forth in Section 4.5 of the Basis of Review for Environmental Resource Permit Applications Within the South Florida Water Management District -August 1995 and are incorporated by reference in this rule. (4) A formal determination shall be binding for five years provided physical conditions on the property do not change so as to alter the boundaries of the wetlands or other surface waters during that period. (5) In accordance with Section 373.421(4), F.S., a formal determination may be revoked upon a finding that the petitioner submitted inaccurate information to the District. Specific Authority 373.043, 373.113, 373.421(2) F.S. L,aw Implemented 373A21(2) F.S. History—New 10-3-95. Snbstariti 1 Rewording of Rule 40EA.051. See Florida Administrative Code for present text). Exemptions From Permitting. Exemptions from permitting under Chapters 40E4, 40E40 and are set forth below. The performance of activities pursuant to the provisions of the exemptions set forth in this section does not relieve the person or persons who are using the exemption or who am constructing or otherwise implementing the activity from meeting the permitting or performance requirements of other District rules. Nothing in this section shall prohibit the Department from taking appropriate enforcement action pursuant to Chapter �— 403, F.S., to abate or prohibit any activity otherwise exempt from permitting pursuant to this section if the Department can demonstrate that the exempted activity has caused water pollution in violation of Chapter 403, F.S. (1) Pipes or Culverts. The repair or replacement of existing functional pipes or culverts the purpose of which is the discharge or conveyance ofstornwatcr. In all cases, the invert elevation, the diameter, and the length of the culvert shall not be changed. However, the material used for the culvert may be different from the original material. This exemption docs not authorize the repair, replacement, or alteration of dam's spillways or appurtenant works, nor construction activities or procedures that cause violation of water quality standards as set forth in Chapter 62-302 and Rule 624.242, F.A.C. (2) Maintenance of Systems. (a) The performance of maintenance dredging of existing manmade canals, channels, basins, berths, and intake and discharge structures, where the spoil material is to be removed and deposited on a self-contained, upland spoil site which will prevent the escape of the spoil material and return water from the spoil site into wetlands or other surface waters, provided no more dredging is performed than is necessary to restore the canal, channels, basins, berths, and intake and discharge structures to original design specifications, and provided that control devices arc used at the dredge site to prevent turbidity and toxic or deleterious substances from discharging into adjacent waters during maintenance dredging. This exemption shall apply to all canals constructed before April 3, 1970, and to those canals constructed on or after April 3,1970, pursuant to all necessary state permits. This exemption shall not apply to the removal of a natural or manmade barrier separating a canal or canal system from adjacent wetlands or other surface waters. Where no previous permit has been issued by the Board of Trustees of the Internal Improvement Taut Fund, the Department, the District or the United States Army Carps of Engineers for construction or maintenance dredging of the existing manmade canal, channel, basin, berth or intake or discharge structure, such maintenance dredging shall be limited to a depth of no more than 5 feet below mean low water. (b) The maintenance of functioning insect control structures, and the maintenance of functioning dikes and functioning irrigation and drainage ditches, including roadway drainage ditches, provided: I. The spoil material is deposited on a self-contained upland spoil site which will prevent the escape of Elrativc 10/3/95 Page 5 6tU14u,e SOUTH FLORIDA WATER MANAGEMENT DISTRICT CHAPTER 40124, SURFACE WATER MANAGEMENT (RULES ADOPTED FOR DEP BY REFERENCE) the spoil material and return water into wetlands or other surface waters. 2. In the case of insect control structures, if the cost of using a self-contained upland spoil site is so excessive as determined by the Department of Agriculture and Consumer Services, pursuant to Subsection 403.088(1), F.S., that it will inhibit the proposed insect control, existing spoil sites or dikes may be used, upon notification to the District. In the case of insect control where upland spoil sites arc not used pursuant to this exemption, turbidity control devices shall be used to confine the spoil material discharge to that area previously disturbed when the receiving body of water is used as a potable water supply, is designated as approved, conditionally approved, restricted or conditionally restricted waters for shellfish harvesting by the Department, or functions as a habitat for commercially or recreationally important shellfish or frnfish. 3. In all cases, no more dredging is to be performed than is necessary to restore the dike or irrigation or drainage ditch to its original design specifications. 4. This exemption shall apply to manmade tenches dug for the purpose of draining water from the land or for transporting water for use on the land and which are not built for navigational purposes. (c) Maintenance of minor silvicultural surface water management systems as described in subsection 40E400.500(4), F.A.C., which were permitted under Part IV of Chapter 373, F.S. or were constructed prior to the requirements for a permit under this part, provided such maintenance is conduc(cd in accordance with the performance standards set forth in section 4011400.500(5), F.A.C. (d) The restoration of less than 100 feel in length of existing insect control impoundment dikes and the connection of such impoundments to tidally influenced waters. Such impoundments shall be connected to tidally influenced waters for at least 6 months each year, beginning September I and ending February 28 if feasible, or operated in accordance with an impoundment management plan approved by the District. The connection shall be of sufficient cross-sectional area to allow beneficial tidal influence. Restoration shall involve no more dredging than needed to restore the dike to original design specifications, and the final elevation of the dredge area shall be within two feet of immediately adjacent bottom elevations. For the purposes of this paragraph, restoration shall not include maintenance of `— impoundment dikes of insect control impoundments. (3) Docking Facilities and Boat Ramps. (a) The construction, replacement or repair of mooring pilings and dolphins associated with private docking facilities. (b) The construction of private docks of 1000 square feet or less of surface area over wetlands or other surface waters or 500 square feet or less of surface area over wetlands or other surface waters for docks which are located in Outstanding Florida Waters. This exemption shall include the construction of structures above the dock arca, such as boat shelters and gazebos, provided such structures arc not enclosed with walls and doors, are not used for residential or commercial purposes, or storage of materials other than those associated with recreational use, and provided the structures do not exceed, together with the docking facility, the total area limitations above. To qualify for this exemption, any such dock and associated structure: I . shall be used for recreational, non-commercial activities; 2. shall be constructed or held in place by pilings, including floating docks, so as not to involve filling or dredging other that necessary to install the pilings; 3. shall not substantially impede the now of water or create a navigational hazard; and 4, shall be the sole dock constructed pursuant to this exemption as measured along the shoreline for a minimum distance of 65 feet, unless the parcel of land or individual lot as platted is less than 65 feel in length along the shoreline, in which case there may be one exempt dock allowed per parcel or lot. For the purposes of this paragraph, multi -family living complexes and other types of complexes or facilities associated with the proposed private dock shall be treated as one parcel of property regardless of the legal division of ownership or control of the associated property. Construction of a private dock under this exemption does not require the District to issue a subsequent permit to construct a channel to provide navigational access to the dock. Activities associated with a private dock shall include the construction of structures attached to the pier which are only suitable for the mooring or storage of boats (i.e., boadifts). (d) The replacement or repair of existing docks or mooring piles, provided: I. No fill material other than the piles is used; 2. The replaced or repaired dock or mooring pile is in the same location and orthe same configuration and dimensions as the dock or mooring pile being replaced or repaired; and 3. The dock or mooring pile must be functional and able to provide access to boats moored at the dock or pile before this exemption may be used unless such dock or mooring pile has been rendered non-functional by a discrete event such as a storm, flood, accident, or fire. (e) The construction and maintenance to design specifications ofboat ramps on artificial bodies of water where navigational access to the proposed ramp exists, or the construction and maintenance to design specifications of boat ramps open to the public in any wetlands or other surface waters where navigational access to the proposed ramp exists and where the construction of the proposed ramp will be less than 30 feet wide and will involve the removal of less than 25 cubic yards of material from the wetlands or other surface waters, and the installation of docks with an arca of 500 square feet or less over wetlands or other surface waters that arc associated with and adjoining the boat ramps constructed pursuant to this exemption. All material removed shall be placed upon a self-contained upland site so as to prevent the escape of the spoil material and return water from the spoil site into the wetlands or other surface waters. For the purpose of this exemption, artificial bodies of water shall include residential canal systems, canals permitted by a Distri r Section 373.069, F.S., and artificially created portions of the Florida Intracoastal Waterway. (4) ore Stabilization. a Construction orseawalls or ripmp, including only that backfilling needed to level lie land behind seawalls or ripmp, in artificially created waterways, where such construction will not violate existing water quality standards, impede navigation or adversely affect flood control. An artificially created waterway is derrncd as a body of water that has been totally dredged or excavated and which does not overlap natural wetlands or other surface waters. For the purpose of this exemption, artificially created waterways shall also include existing residential canal systems. This exemption does not apply to the construction of vertical seawalls in estuaries or lagoons unless the proposed construction is within an existing man-made canal where the shoreline is currently occupied in whole or in part by vertical seawalls. (b) The restoration of a seawall or ripmp at its previous -location or upland of or within one fool rwa us previous location. No filling can be performed except in the actual restoration of the seawall or ripmp. No construction shall be undertaken without necessary title or leasehold interest, especially where private and public ownership boundaries have changed as a result of natural occurrences such as accretion, rcliction and natural erosion. Restoration and repair shall be performed using the criteria set forth in Section 373.414(5), F.S. This exemption shall be limited to functioning seawalls or ripmp. This exemption shall not affect the permitting requirements of Chapter 161, F.S. (c) The construction of private vertical seawalls in wetlands or other surface waters, other than in on estuary or lagoon, and the construction orriprap revetments, where such construction is between and adjoins at both ends existing seawalls or ripmp, follows a continuous and uniform construction line with the existing seawalls or ripmp, is no more than 150 feet in length, does not violate state water quality standards, impede navigation, or adversely affect flood control. However, this exemption shall not affect the permitting requirements of Chapter 161, F.S. Construction shall be in accordance with Section 373.414(5), F.S. (5) Transmission and Distribution Lines and Utility Poles. (a) The installation of subaqueous transmission and distribution lines laid on, or embedded in, the bottoms of wetlands or other surface waters, except in Class I and Class 11 waters and aquatic preserves, provided that no dredging or filling is necessary. (b) The replacement or repair of subaqueous transmission and distribution lines laid on, or embedded in, the bottoms of wetlands or other surface waters.
