L ERK TOWN HALL, ROOM B Board members present: Carmen Scherzo, DVM, Chairman; Annette Graczewski , MT (ASCP), Vice Chair an, Hausser Holeman, MPH , MA, MS and Nancy Leach, PharmD Board members absent: Joe Ford Others present: Nancy Ellis Ice, MPH , CHO, RS, Health Director and Tammi Mason, Senior Department Assistant 1 . Chairman 's announcements The Brewster Police Department received a Child Passenger Safety grant which will be used to purchase child safety Seats . People can contact the Police Department for more information . The Massachusetts Department of Public Health is developing a 10 million dollar Gun and Youth Violence program which should be up and running this spring . The Massachusetts Department of Environmental Protection Bureau of Waste site Clean Up will be conducting an audit at 1399 Freeman' s Way, potential future of home of Cape Grow Lab , 2 . J . M . O ' Reilly & Associates Inc . — approval of a Definitive Subdivision Plan for WH Besse Cartway John O' Reilly presented this to the Board . He is working with the Open Space Committee and the Town of Brewster to develop this subdivision . This was a Town Meeting article . There will be 3 residential parcels . All have private wells and Title 5 septic systems . The subdivision will not impact any of the current residential parcels . The property is being divided in such a way that a septic system could be installed 300 feet away from the pond . Mr. O' Reilly told the Board that they are required to review and approve this subdivision request. The owners and the town have agreed to put town water on parcel 5 . Motion : Accept the subdivision plan as presented by John O' Reilly. Motion : Annette Graczewski Second : Penny Hausser Holeman Vote: 4 -0 - 0 Action : Motion carried i 3 . Discussion on proposed Marijuana regulations Dr. Scherzo thanked Ms . Holeman for bringing back information from the MAHB meeting she went to . Ms. Holeman asked if it would be helpful if the Board looked at what Brewster has proposed so far. Dr. Scherzo stated that there are new rules coming out next month and the Board should probably wait and see what they come out with . Mrs. Grazcewski believes that there are already conflicts with the bylaws and Town Meeting vote and thinks WWW.BREWSTER-MA . GOV BOH 1 / 16/2019 Minutes, Page 2 moving on with regulations at this point would not be necessary This will remain on hold until there is some resolution with the lawsuit. 4. Discussion on Private Well regulations There was a brief discussion as to why this was here , Mrs . Ice had brought it to the Board ' s attention originally because she thought the section that required abutter notification was not needed as the State had removed it from their model regulation . Dr. Scherzo wanted to look at the entire regulation because he noticed differences . He specifically asked what Brewster required for testing . Mrs . Ice will bring back the list of what the lab test for so the Board can look at it. 5 . Discussion on the Financial Hardship regulation Dr. Scherzo went online and found an inflation calculator and the current poverty levels . Dr. Scherzo is recommending that the Board change the " Farmers Home Administration " to state "the government poverty Levels from the US Department of Health & Human Services and to also index the $ 120.000 with regards to inflation . Motion : Adopt the changes proposed by Dr. Scherzo to the 1993 Financial Hardship regulation . Motion : Annette Graczewski Second : Penny Hausser Holeman Vote: 4 -0 - 0 Action : Motion carried 6. Discussion on Dogs Banned from Beaches regulation Chris Miller was present to help with the discussion . Dr. Scherzo stated that he had talked to Jim Gallagher about this issue with regards to who has authority where and also looked at data about whether or not there was a health reason why these beaches were closed to animals during the specified times but did not see any health issues in surrounding towns . Mrs . Graczewski did state that the Town has a very active shell fishing program . Dr. Scherzo wanted to propose that dogs are not allowed on specific beaches ( Paine's Creek, and on the west beaches to the Dennis town line, Crosby landing beach and Linnell landing from April 1St to Sept 15th Mrs , Ice asked Mr. Miller about the signs that were put up last year at the beaches . He stated that there may be issues with making changes to them . Mrs . Graczewski isn't in favor of changing the dates . There was talk about enforcement of the regulations , Dr. Scherzo stated that it needs to be discussed at a later date because it is a problem . The Board agreed to continue this discussion until the full Board is present. BOH 1 / 16/2019 Minutes, Page 3 7. Discussion on the Tobacco Regulation Bob Collette was present. Dr. Scherzo asked if the new tobacco law prevented the online ordering of vaping products . Mr. Collette stated that it will K be harder and the age verification process will be different. Mr. Collette stated that he will be checking the establishments for the correct signage . Mrs . Ice asked about section M (any flavored tobacco product), definition section, it says " other than menthol and mint tobacco . Mr. Collette stated that there are currently lawsuits going on because of towns banning those flavors . Mrs . Graczewski stated that she is ok with leaving menthol, mint and wintergreen in the regulation . Ms . Leach stated that she assumed the exception was for adults using the products and asked if these are abused flavors by children . Mr. Collette stated that kids are more apt to be in favor of using the fruity flavors and that mint, etc , are flavors so he believes that they should be included . Motion : Adopt the proposed regulations as drafted into our tobacco regulations . Effective date to be May 1 , 2019 . Motion : Penny Hausser Holeman Second : Annette Graczewski Vote: 4- 0- 0 Action : Motion carried 8 . Topics the Chairman did not anticipate None . Informational items were noted .
