Board members present: Carmen Scherzo , DVM , Chairman ; Annette Graczewski , MT (ASCP) , Vice Chairman , Joe Ford ,
Penny Hausser Holeman , MPH , MA, MS and Nancy Leach , PharmD

1 . Chairman's announcements
The Massachusetts Substance Abuse Help Line number is 1 -800-327-5050 . All calls are confidential .
Private well owners in Brewster can have their well water tested through the STEEP program . There are currently 14
homeowners participating and they are still accepting participants . Residents can call Laurel Schaider at 617-3324288
ext. 224 .
As of December 31 , 2018 under state law, vaping is now prohibited in all public places subject to the No Smoking in Public
Places law. Examples are : Schools , bars , restaurants and taxis .
2 . Public hearing on revision to the Regulation Prohibiting Smoking in Workplaces and Public Places
Dr. Scherzo reminded the Board that they had added a section to the regulation that no smoking was allowed in public
parks , playgrounds , etc.
Dr. Scherzo read the email from Mark O ' Brien opposing any ban on the golf course .
Motion : Amend the regulation to allow the golf course to decide whether or not to ban smoking .

Mrs . Grazcewski asked if the golf course was considered a park. Mrs . Ice stated that she didn 't believe it was . Dr.
Scherzo questioned whether or not children (what percentage) played on that course . Mrs . Ice suggested asking Town
Council if the golf course met the definition .
Mr. Ford retracted his motion .
The Board agreed to ask Town Council if the golf course meets the definition of a public park or if different language is
needed .
3 . Ryder & Wilcox - variance request for 450 Lower Road (continued from 1 /2/2019)
Stephanie Sequin presented this to the Board . They are going to be upgrading an existing leaching field . They were not
able to do a perc test and that is why they had to come back to the Board again . A sieve analysis was done and it did
confirm that the receiving layer is a class 1 soil . Using effluent loading rates , you take the slowest perc rate for whatever
soil class you ' re designing for. It is an 8 minute per inch perc rate for this SAS . This did go before the Conservation
Commission and was given approval . Ms . Sequin stated that she did redo the plan to show the variance request for the
sieve analysis and handed them out to the Board along with a revised letter.
Mrs . Grazcewski stated that she is still concerned with the fact that they are using observed groundwater instead of
adjusted groundwater and asked if they would consider using an I/A system . She asked what the adjusted groundwater
level was . Ms . Sequin stated it was a 1 . 4 foot adjustment which would make it 2 . 6 ' from groundwater to the SAS .
Dr. Scherzo asked about using a pressure dosed system . Ms . Sequin stated that it would give better treatment without the

expensive cost of an I/A system . Mrs . Graczewski stated that she would like to see an I /A system put in and if that is to
expensive than she would like to see the system be raised .
Motion : Approve the following variances :
1 . To allow the proposed SAS to be sixty six (66) feet from a wetland
2 . To allow no adjustment to the observed groundwater elevation
3 . To allow the proposed SAS to be eleven ( 11 ) feet from a foundation crawl space
4 . To allow the proposed SAS to be five (5) feet above the observed groundwater elevation
5 . To allow the use of a sieve analysis in lieu of a percolation test
This approval is conditioned on the system being a pressure dosed system .

4 . Bass River Engineering - variance request for 59 Spring Lane (continued from 11 /7/2018)
Tom McLellan presented to the Board . This is a home built in 1964 , In 1974 a septic upgrade was done and has
failed . They will be re- using the existing septic tank and adding a pump chamber.
Mr. McLellan is asking for the following variances :
1 . To allow the proposed SAS to be less than 10 ' from a lot line
2 . To allow the proposed SAS to be less than 20 ' from the crawl space
3 . To allow the proposed SAS to be less than 1 00 ' from an intermittent stream
Mr. McLellan stated that this would be a vast improvement over the existing system . They will be moving it from the center
of yard . Conservation Commission has approved this plan .
Dr. Scherzo asked if there was a cellar. Mr. McLellan stated that there was only a 4' crawl space .
Motion : Finding that this is a vast improvement over the current system , it is the only spot available on the lot and it will be
further away from the stream , grant the variance requests as written .

5 . J . M . O' Reilly & Associates Inc. - variance request for 72 Johnson Cartway
This item was postponed until April .
6 . J . M . O' Reilly & Associates , Inc . - variance request for 72 Griffiths Pond Road
Matt Farrell presented this to the Board . He is requesting that the existing SAS be allowed to remain 120 feet from Griffiths
Pond . The septic system was inspected for a renovation and it found that it was too close to pond . Groundwater is
flowing from pond to SAS . The system is in good working order. The plan shows the 300 foot buffer zone and the only
place to put a new SAS would be in the electric easement, which is not allowed .
Dr. Scherzo stated that the leaching pit is H2O rated .
Motion : Finding that the groundwater flow is away from the pond and the location of the septic is as far away as possible
and the system is 13 feet above the groundwater elevation , approve the variance to allow the SAS to remain 120
feet from Griffiths Pond .

7 . Winston Steadman , All Cape Engineering - discuss non -compliance of O & M contract at 160 Old Red Top Rd
Winston Steadman was present. He stated that this system slipped through the cracks . The contract is now up to date .

He is asking that the BOD requirement be lifted . Testing is for total nitrogen and field testing still has to be done . If the
field test fails , he would have to test for BOD & TSS .
Mrs . Grazcewsi asked how long it had been since testing was done . Mr. Steadman stated that it had been about 1 year.
But testing was just done . Mrs . Ice asked about the status of the O & M contract. Mr. Steadman stated it was all set.
Ms . Leach asked if this site had a history of failing tests . Mr. Steadman said it did not. E
Motion : Allow the standard state testing 4 times a year. If nitrogen comes back high he will test for BOD and TSS .

8 . Jo-Ann Belmonte - Food Service permit application for 1187 Main Street ( Sea Meadow Inn)

Jo-Ann Belmonte is purchasing the Sea Meadow Inn . She did pass the Serve Safe exam yesterday . There will be no
changes to what is there now .
Motion : Approve the Food Service permit application conditioned on the Assistant Health Director' s recommendations
being met .

9 . Whitewater Water & Wastewater Solutions - annual report for Wingate
No one present. No questions from board .
Motion : Accept report.

10 . Bennett Environmental to annual report for Maplewood
Joe Smith presented this to the Board . Winston Steadman was also present. Mr. Smith stated that they are still having
the same problems with Quaternary Ammonium . He stated that the permit limits were exceeded 7 times for BOD and 5
times for TSS . The system manufacturer came down to see what was going on . The facility is being proactive with
pumping out the tank and they are working with the facility on what is going in to the system .
Dr. Scherzo spoke about the education information that was given to the residents of Kings Landing which has been
having problems with that also . Winston said that Kings Landing is still having issues , but it is slowly getting better. They
came up with an idea to get a vacuum truck to get the flushable wipes out of the tank which a normal septage hauler
cannot do . David Bennett spoke up and said that his company is putting a lot of work into an education program .
Motion : Accept the report and have them submit a report in 6 months with an update .

11 . Bennett Environmental - annual report for Pleasant Bay Health & Living Centers
Joe Smith presented . He stated that the system is performing very well and only had 1 exceedance .

12 . Winston Steadman/Joe Henderson - annual report for Kings Landing
Winston Steadman told the Board that there were no reports back yet but the clarity is getting better. This will be
continued until the next meeting .

13 . J . M . O' Reilly & Associates Inc . - annual report for White Rock Commons
This item was postponed until the next meeting .
14 . Coastal Engineering - Annual report for Brewster Landing
No report was submitted . David Michniewicz was present. There have been no real issues . Operating fine . It was
mentioned to make sure all of the unit owners know what they can and cannot be put down the drain .
Send report to Health Department and if there are any questions you can come back. But no need if everything is working
fine .
15 . David Ahlin - discuss options for septic upgrade at 89 Weathervane Way
This item was postponed indefinitely .
16 . Discuss "Summary of Implementation Issues" ( Brewster's Advanced Onsite Septic System Program)
Dr. Scherzo told the Board that this was something that Mrs . Ice was given at a meeting she attended . It has to do with
the Pleasant Bay Alliance ( PBA) . Chris Miller and Mark Nelson presented it. Dr. Scherzo gave a history of this to
the Board . He thinks that someone from the Board of Health should be included in any more discussion on this proposal
because septic systems are the Board 's purview. He would like to send a letter to the Town Administrator and the
Select board chairman saying that the Board believes that the health director should be a member of the PBA.

17 . Discuss letter from DEP re : Kings Landing
Dr. Scherzo asked if the Board wanted to send a letter stating that they have met 5 times to discuss performance issues .
Also state that the Board is waiting on an annual report from them and that they have been doing an education program
For the residents there .

Board is waiting on an annual report and that Kings Landing has been doing an educational program for the
residents there .

22 . Topics the Chairman did not anticipate
Ms . Leach spoke about the dog park in Hyannis and what they used for the ground material . They used small gravel that
urine can drain through . Dr. Scherzo asked her to write a letter to Tom Lincoln ( Dog Park Committee member) .
Mrs . Graczewski spoke about Water Quality Review Committee and its discussion on the Cape Cod Grow Lab with
regards to the use of pesticides on the external area of building . The WQRC Committee will be given a list of what they are
using and they will keep the committee informed about any changes .

Meeting adjourned at 9 : 15PM
