WEDNESDAY FEBRUARY 20 , 2019 AT TOOPM TOWN HALL , ROOM A k Board members present: Carmen Scherzo , DVM , Chairman ; Annette Graczewski , MT (ASCP ) , Vice Chairman ; Joe Ford ; Penny Hausser Holeman , MPH , MA , MS and Nancy Leach , PharmD Others present: Nancy Ellis Ice , CHO , RS , MPH , Health Director and Tammi Mason , Senior Department Assistant i 1 . Chairman 's announcements The Massachusetts Substance Abuse Help Line number is 1 - 800-327-5050 . All calls are confidential . Cannabis Control Commission launched a public awareness campaign in August of 2018 . Information on the " More about Marijuana " campaign can be obtained at the Town of Brewster website . The Massachusetts Association of Health Boards has also been following this closely . July 133, 2019 is Brewster Conservation day . 2 . J . M . O ' Reilly & Associates Inc. - variance request for 72 Johnson Cartway Continued until the April 3 , 2019 meeting . 3 . J . M . O' Reilly & Associates Inc. - annual report for White Rock Commons John O ' Reilly was present. Annual report was submitted to the Board . Mr. O ' Reilly stated that part of last year had great results . In November adjustments were made . It is a 12 house development. There are only 6 occupied currently . Hopefully in the next few months the other 6 units will be occupied . It is only receiving about half the flow it needs to run properly. Dr. Scherzo asked if they routinely test for Quaternary Ammonium . Mr. O ' Reilly stated that they did not routinely test for that, but that owners were notified about being careful about what they put down the sink. Mrs . Graczewski asked if any testing was done in 2019 . Mr. O ' Reilly stated that they had tested in January and that total nitrogen was 20 . Mrs . Graczewski suggested to the Board that an update be given in 6 months . Mr. O ' Reilly will provide the Board with an update in 6 months . Motion : Accept report with a request that a summary of the lab results of the first 6 months be provided in June . Motion : Annette Graczewski Second : Joe Ford Vote : 5-0-0 Action : Motion carried 4 . Coastal Engineering - annual report for Brewster Landing Dr. Scherzo stated that he did notice that there was a lot of wipes and clogging in the system . Motion : Accept the annual report. David Bennett ( Bennett Environmental Associates) discuss the public awareness/education information about Quaternary Ammonium David Bennett talked about this issue . Public education is very important. Ms . Leach spoke about the problem in the nursing homes and stated that management should be guiding the residents not to put these things down the toilets . Dr. Scherzo asked Mr. Bennett if he thought the board should have a regulation banning the wipes . Mr. Bennett believes that watching the Small Wastewater Treatment Facilities reports and keeping up with what they are doing is best. He thinks enforcement of a regulation would be impossible . Public education is very important and would be the best way of handling this . Mrs . Graczewski suggested inviting the administrators into these meetings so that they know what is going on also and be able to hear what the Boards concerns are . Mr. Bennett believes that there will be increasing regulations with regards to this . Mr. Ford also believe that a regulation would be hard to enforce . Thinks all we can do is continue the education Motion : Put educational information up on our website and send it to high occupancy buildings in town (assisted living , etc . ) . Motion : Joe Ford Second : Penny Hausser Holeman Vote : 5-0 - 0 Action : Motion carried 6 . Discuss Marijuana education Mr. Ford stated that all this information is already on our website . It is right on the top link which brings you to the Cannabis Control Commission page and goes over all the educational information . The Board thinks that Brewster is doing what it need to do as far as education goes . Motion : Leave educational items up on the website . No need at this point to do anymore . Motion : Joe Ford Second : Annette Graczewski Vote : 5- 0- 0 Action : Motion carried 7 . Laura Kelley - POCCA - discuss possible regulation banning Glyphosate products Laura Kelley , POCCA ( Protect Our Cape Cod Aquifer) was present to speak to the Board . She spoke about the issues with glyphosate products and asked the town to volunteer not to use of this product on town owned land . She also asked the board to write a town regulation . It gives the town more teeth . She spoke about Eversouce's YOP plan and asked the Board to write a fact based letter urging them not to spray in our town . Mr. Ford asked if the Town already volunteered to not use this . Mrs . Ice stated that the Town is not using this product. Chris Miller stated that most town departments don 't use any chemicals (or very little) . Mrs . Graczewski stated that the board had previously agreed that a regulation wasn 't necessary because the Town already voluntarily doesn 't use the chemical . Motion : Send another letter to Eversource stating that the Town doesn 't use Glyphosate products on Town property and they would like Eversource to commit to not using it on any right of way in Town . Mr. Ford retracted his motion and will bring up at a later date . Motion : Annette Graczewski Second : Joe Ford Vote: 4.0- 1 Ms . Hauuser Holeman asked if the Board could get a copy of the proclamation that the Select Board made in 2013 . Ms . Kelley voiced her dislike of the motion and stated that every other town has agreed to write a regulation . 8 . Discuss enforcement of Pets on Beach regulation Dr. Scherzo read what the police chief emailed him about the enforcement of this regulation and that the Chief believes his force cannot enforce the regulation because it is not a bylaw. Dr. Scherzo believes that the ACO (Animal Control Officer) should be enforcing this regulation . Mrs . Ice spoke about the fact that this regulation was reviewed by Town Counsel and they had no issue with the statement in the regulation that the police could be responsible for enforcement. Mr. Miller stated that most officers start with education and don 't write tickets . Mrs . Graczewski stated that maybe Mr. Scherzo could talk with the chief outside a meeting and ask if it was a bylaw would they enforce it. Discuss potential date changes for Pets on the Beach regulation (continued from 1 / 16/ 19) Mr. Ford asked Mr. Miller about the shellfish beds . Dr. Scherzo spoke about fecal contamination (from dogs) and humans . There is no documentation that there is a Correlation between waste and human sickness . He stated that he feels it is a nuisance problem . Kathy Chamberlain , Brewster resident who originally asked the Board to make the date change spoke about her reasons for wanting the change . Mrs . Graczewski stated that she is comfortable with leaving the dates as they are now. There was a brief discussion on the signs at the beach . Motion : Change the dates that pets are not allowed on the beach to May 15th through September 15tH Motion : Joe Ford Second : Nancy Leach Vote: 4- 0- 1 Action : Motion carried 10 . Discuss letter from DEP re : Nickerson State Park Mrs . Ice explained this to the Board . DEP is cracking down and requiring a groundwater discharge permit. Discuss letter from Eversource Motion : Comment period is until April , continue this until the next work meeting . Motion : Joe Ford Second : Annette Graczewski Vote: 5-0- 0 Action : Motion carried 13 . Topics the Chairman did not anticipate Mrs . Ice stated that she would be unavailable for the March 201h meeting . The Board agreed to not meet on that date . Mrs . Ice stated that she will attend the Pleasant Bay Alliance meeting on February 27 , 2019 Mr. Ford asked that the substance abuse hotline be added to our website . Mrs . Graczewski stated that the WQRC-accepted all the BOH recommendations for the CC Grow Lab . Informational items were noted . Meeting adjourned at 9 : 15PM
