HomeMy Public PortalAbout1992-08-11 Special Meeting106 COUNCIL MINITES SPECIAL MEETING - AUGUST I1, 1992 The special meeting of the Bat Harbour Village Council was held on Tuesday. August 11. 1992 in the Council Chamber at Hai Harbour Village Hall. The meeting was called to order at 5:_10 p.m. by Assistant Mayor Hirsch!. The roll was called and those present were: Also Present: Assistant Mayor Andrew R. Hirschl t_ounciIman Matthew B. Blank Councilman James E. Boggess Carole S. Morris. Village Manager Jeanette Horton. Village Clerk Richard J. Weiss, Village Attorney Absent: Mayor Estelle Stern Councilman soi M. Tapiin As a quorum was determined to be present the meeting commenced. 2. Landscaping Proiect./Col_lins _ venue Med_ians_: Mrs. Morris explained that at the last regular meeting of the Council the hid was awarded to Vila & Son and she was directed to send the plans back to the Resort Tax Committee for their review. The Committee has recommended substantial changes to those plans and we have endeavored to put a cost on the vegetation as well as a time limit and cost perimeters on what would be involved in changing the plans. To summarize the Village is looking at a cost of .$10.000 and three weeks in time to revise the landscape plan, revise the electrical plan and to revise and negotiate the necessary change with Vila & Son. Additional cost of S-0,000 and $106,000 for: changes that would be required to the vegetation, such as different trees etc, Mr. O'Leary's professional fees not to exceed $12,240, electrical engineer fees not to exceed $5,175 and Craig Smith fee not to exceed $4,000. Therefore the Village would be incurring the total additional cost of $21.415 for professional fees for project installation. Light fixtures are on order from Sterner. The purchase order is in the amount of $116,810. Originally Mr. O'Leary felt the Village may be able to do with less fixtures due to the clustering of the palm trees, but. Sterner disagrees. They feel that it would not have the same effect if less fixtures are used. Mr. Whitman was successful in getting the Department of Transportation to permit the Village to cluster the trees. Mr. O'Leary is very concerned with liability on his behalf and Mrs. Morris distributed a copy of his letter that was sent to her and Mr. Weiss. Special Council Meeting 8/11/92 Mrs. Morris reported that Mr. Vila is prepared to start Monday. August 17. with the removal of existing vegetation on Collins Avenue. If the decision of the Council is to proceed with the amendment of the plans as they were bid. the completion date will have to be negotiated with the bidder as part of the change order. Assistant Mayor Hirschl explained to the Council that the Resort Tax Committee's consensus is to cap the project at $750,000, which was the original cost set by the Council for this project. That parameter still remains and he would like Council to understand that the Committee does not want to increase the cost of the project which was under budget initially. When Mr. O'Leary based his estimates it was on 40 more trees. but there are 77 more palm trees that will be necessary if the plans are amended. As well as using only one kind of groundcover the cost would be increased therefore at this time have not proceeded with the revision of the plans or amending the electrical plans, irrigation plans to reflect the proposed the amendment because those costs exceed $2500 which requires C'ouncil's approval. Until the plans are finalized. Mr. Vila's change order cannot be finalized. Discussion followed as to the increase in the cost of the project and where the funds would be budgeted. Mrs. Morris explained that the Beach Fund is separate and the project would be funded from Resort Tax. She further stated that the project, if amended would cost approximately $850.000. Assistant Mayor Hirschl stated that this is a show piece of a project and the Council should not be penny foolish at this point. Councilman Boggess stated he had no objection to amending the plans if the funds are available. A motion was offered by Councilman Blank and seconded by Councilman Boggess to modify the plans and contract documents and to proceed with the changes. The motion carried 13-0). with Mayor Stern and Councilman Taplin absent. 3. Scheduling of Budget Workshop Meeting: Mrs. Morris stated that the Public Hearings are scheduled for September 15 and September 30, and this would be the appropriate time to schedule a budget workshop meeting. It was the consensus of the Council to schedule the meeting for August 25. at 4:00 p.m. 4. Other Business: Mrs. Morris requested Council's approval to proceed with expenditure to W. Jackson Construction in the amount of $2800. which is the Broward County bid price. This expenditure is for cleaning and lamping of the storm drain lines in the residential district. A motion to approve this expenditure was offered by Councilman Boggess and seconded by Councilman Blank. The motion carried (3-0) with Mayor Stern and Councilman Taplin absent. It was the consensus or the Council to continue issuing civil violations. Racetrack_ Mrs. Morris reported that Bay Harbor Islands has issued an Request for Proposals seeking a noise impact study. There has been 21 race dates proposed. Cafe' Tulipe: Mrs. Morris explained that the code require Council's approval for an occupational license can be issued. A motion was offered by Councilman Boggess and seconded by Councilman Blank to approve the license for Cafe' Tulipc. The motion carried (3-01. with Mayor Stern and Councilman Taplin absent. 5 Adjourn: There being no further business to come before the Council. a motion was offered be Councilman Blank and seconded by Assistant Mayor Hirschl to adjourn.
