The City Council of the City oY Lynwood does ordain as follows: Section 1: That Section 11 of Ordinance No. 440, the Sales Tax Ordinance, 13 hereby amended to read as follows: Section 11: Due Date. The taxes imposed by this ordin- ance are due and payable to the City Treasurer either monthly or quarterly, the choice lying with the retailer who should determine - the date period on the basis oY the period he submits sales tax returns to the State. All taxes payable monthly and all taxes payable quarterly hereunder ahall be deemed delinquent if not paid or poatmarked on or before the cloae of business on the la.st day of the month follovaing the monthly or quarterly period for which the tax is payable. Taxea payable hereunder Por perioda other than ' monthly or quarterly periods ahall be deemed delinquent at the times designated by the City Treasurer in his rulea and regulations v�hen- ever any tax reQuired to be paid by thie sec.tion is not paid on or before the date on which it becomea delinquent, a penalty of 10 per cent of the amount due shall be imposed and an additional penalty oP 5 per cent of the original tax ehall be added at the close of business on the last day of each calendar month thereafter. Every penalty shall become a part of the tax imposed by this section. In no ca.se, however, shall the total penalty exceed 50 per cent of the - ori�inal tax. The City Treasurer, for �ood cause, may extend for not more than 30 days the time for making any return or paying any sum required to be paid hereunder. The extension may be granted at any _1_ time provided a written request therefor is Piled with the City Treasurer prior to the delinquency date. , Section 2: This ordinance is urgently required for the immediate preservation of public peace, health, and safety in the City of Lynwood and advancement of the general w.elfare and shall be in effect August 5, 1947. The following is a apecific statement of the emergency of this ordinance. The State oY California has recently cha.nged the Sales � Tax delinquent date from the lOth and 15th to the laet day of the month following the monthly or quarterly period for which the tax is payable. It is neceasary and. desirable that the City�s collection period corresponds to the State. Im�ediate enactment and enforce- ment of this ordinance is necessary to inaure such uniformity.
