AN ORDINANCE OF CITY OF LYNl�Y00D PROVIDING
FOR THE CARE� RESTITUTION, SALE AND DESTRUCTION
OF UNCLAIn4ED PROPERTY IN THE P03SESSION OF THE
POLICE DEPARTn�ENT.
The City Council oP the City of Lynwood does hereby ordain
ae follo�ve:
Section li It�ie the duty oP every Police OfYicer of the
City of Lyn�rood, recovering lost, abandoned, or stolen property of
any kind, nature, or deacription, including money, and it is the duty
oP every employee and officer oY the City of Lynvcood who shall find
any loat, abandoned, or atolen property of any kind, nature, or deacrip-
tion, including money, while enga�ed in the perFormance of his dutiee
or in or upon any public grounds, highways, road, public building,
place or property of the City, to deliver the same to the ofYicer or
person in charge of the plaae where euch money or property Se Pound,
- or to the head of the department in which auch officer or ie
employed, together with a statement in writing, if required by the
Chief oY Police of the City oP Lynwood as hereinaPter pro"vided, stating
fully the circuiastances of the finding, including the time and the place
of the finding and the name and the addreas of the person beliened to
be the owner, if known.
Section 2: The person •�to whom such money or proper.ty is
delivered,shall deliver or cauae the eame to be delivered into the
custody oP the Chief of Police of the City oP Lynwood who sha.11 care
� for and protect all auch property coming into his posaession and ahall
restore auch property to its true owner upon proof of ownerehip satis-
factory to hlm, upon the payment of all necessary oosts incurred in the
care and protection of auch property. The Chief of Police may require
a statement in writing from the-person finding such property, as pro-

vided. in Section 1 hereof, 3hould any such property remain unclaimed
by ita true owner for a peri'od,oP eix months from the date of the
finding or recovery oY such property, said ChieP oP Police ie hereby
authorized and directed to cause eaid property to be sold at public
auction to the higheet and best bidder. Notice of eueh sale ahall be giee;
bq said Chief of Police at leaet ten (10) days before the time fixed �
for such sale, by publication at least twioe in the le�al nevaspaper
in the City of Lynwood at the time authorized to publish official
printing for the City oP Lynwood. Such notice ahall contain a statement
of the time and place fixed for auch sale, together with a achedule oP
the property to be offered for sale. Immediately upon the completion
of any such sale, the Chief of Police ahall report to the Gity Mana�er,
the City Clerk, and the City Treasurer, the necessary expenaes of any
euch sale actua.11q incurred, and a atatement of the proceeda thereof,
and shall forthwith pay the balance of auch proceeds to the City Clerk
" for depoait in the General blznd.' If there be no bida for any euch
property offered for sale at such auction, the property ahall a�ain
be offered for sale together with other euch unclaimed property at the
next auction sale. If such property Se not solcl at the next auotion
� eale, it sha.11 be turned over to the City Manager who ehall make dis-
gosition thereof, including the power to give it a�eay, in the public
interest as he sha.11 deem fit.
Seotion 30 Any person, firm, or corporation violating any
of the provisions of this ordinance shall be deemed guilty of a miade-
meanor and upon conviction thereof shall be puniahable by a fine of not
to exceed Pive hundred dollars (�`500.00) or imprieonment in the City.
Jail of the City of Lynwood or the County Jail oY Los Angeles County,
State of Calif ornia, Por a period of time not to exceed six months, or
by both such fine and impriaonment.

Each suoh person, firm or oorporation shall be deened guilty
of a separate ofPense for every day during any portion of which violstion
of any provieion of thie ordinance ia committed, continued, or permitted
by such person, firm or oorporation, and ehall be puniahable therefor
as provided by this ordinance.
SeCtion 4: The City Clerk ehall certify to the pa.ssage and
adoptlon of this ordinance and sk�all cause the same to be publiahed once
in the Lynwood Preas, a weekly newapaper published, printed, and cir-
culated in the City of Lynwood, California, and which eaid newspaper
is hereby designated for tha.t purpose.
