A RESOLUTION OF THE TEMPLE CITY PLANNING COMMISSION APPROVING A
CONDITIONAL USE PERMIT (CUP) FOR THE ESTABLISHMENT OF A MONEY
TRANSFER BUSINESS INSIDE THE SUPERMARKET (VALU MART) AT 6340
ROSEMEAD BOULEVARD.
SECTION 1. The Planning Commission has considered all of the evidence submitted into
the administrative record which includes but is not limited to:
1. Reports and presentations of project -related data and analysis prepared by the
Community Development Department; and
2. The Temple City Municipal Code, General Plan, Subdivision Map Act, and all other
applicable regulations and codes; and
3. Public comments, both written and oral, received or submitted at or prior to the
public hearing; and
4. Testimony and comments submitted by the applicant and representatives in both
written and oral form at or prior to the public hearing; and
5. All other related documents received or submitted at or prior to the public hearing.
SECTION 2. This resolution is made with reference to the following prefacing facts as
more fully set forth in the administrative record:
1. On January 3, 2019, the applicant submitted the application.
2. On January 31, 2019, the application was deemed complete.
3. On March 12, 2019, the Planning Commission held a public hearing to consider the
application.
4. Notice of the Planning Commission public hearing was posted at the Council
Chambers.
5. Notice of the Planning Commission public hearing was published in a newspaper
of general circulation at least ten days prior to the hearing.

6. Notice of the Planning Commission public hearing was mailed to property owners
within 500 feet of the property at least ten days prior to the hearing.
7. Notice of the public hearing satisfied the noticing requirements set forth in
Government Code Sections 65090 and 65091.
8. The project site is located in the C-2, General Commercial Zone of the Temple City
Zoning Code.
9. The project site is designated Commercial by the General Plan.
SECTION 3. Based upon the information above, the Planning Commission finds:
1. That the site for the proposed use is adequate in size, shape, topography and
circumstances.
The site is regular in shape, level in grade, and the existing supermarket building
already contains a vacant office space which had previously been used by another
money transfer business. Therefore, this finding can be made.
2. That the site does have sufficient access to streets and highways, adequate in
width and pavement type to carry the quantity and quality of traffic generated
by the proposed use.
The property is located at the corner of Longden Avenue and Rosemead Boulevard.
There are three access driveways to the property - one on Longden Avenue and two
on Rosemead Boulevard. The existing shopping center includes a supermarket and
several retail businesses and restaurants. The supermarket had an un -permitted
money transfer business inside that is now closed. Customers will primarily be
supermarket customers. There has not been a noticeable decrease in visitors to this
shopping center since the previous money transfer business closed, therefore it can
be concluded that allowing a new business to operate at this location will not
significantly increase traffic to the center. Therefore, this finding can be made.
3. That the proposed use will not have an adverse effect upon the use, enjoyment
or valuation of adjacent or neighboring properties or upon the public welfare.

A commercial unit shared by more than one business requires a conditional use
permit. The existing supermarket has had this type of incidental business for an
unknown number of years. The previous business had operated without any
complaints known to the City and it can be concluded that a similar business using
the same sized space will not cause any adverse impacts to the surrounding
community. Operating hours will be limited to those of the supermarket. No changes
will be made to the existing space or to the shopping center parking lot. The existing
facilities can accommodate this business. There is adequate parking on-site for the
business. Several conditions of approval have been recommended to ensure that no
enlargement of the existing facilities or reduction in parking will result from this
project. Therefore, this finding can be made.
SECTION 4. This project is Categorically Exempt from CEQA pursuant to Section 15301
(Existing Facilities) of the CEQA Guidelines.
SECTION S. Accordingly, File No. PL 19-1653, a request for a Conditional Use Permit (CUP)
to operate a money transfer business at 6340 Rosemead Boulevard is approved, subject
to the applicant complying with all requirements of the Temple City Municipal Code and
the conditions as set forth in Exhibit A of this Resolution.
SECTION 6. The Secretary shall certify to the adoption of this Resolution.

Project Specific Conditions
1. Hours of operation for the money transfer business shall be limited to 8:00 a.m.
until 8:00 p.m., daily.
2. The number of employees for the money transfer business shall be limited to 2.
3. The site plan, floor plan, and parking plan must be consistent with the submitted
plan dated January 3, 2019. Any proposed change to the plans must be submitted
to the Community Development Department for review and approval.
4. Prior to issuance of a business license, the supermarket owner shall repair or
replace the existing exterior grocery store exterior sign on the building.
5. All exterior wall signs for the money transfer business shall be located in the lower
50 percent of the building fagade and be limited to no more than six square feet
in size. In lieu of a wall sign, the applicant may place an A -frame sign near the
entrance to the grocery store. All signs are subject to the review and approval of
the Community Development Department.
General Conditions
6. Any construction work beyond interior/exterior painting shall be
reviewed/approved by the Planning Division and may require a building permit.
7. All activities and functions of the site shall be subject to the City's Noise Ordinance.
Any violation of the City's Noise Ordinance as contained in Section 9-1I-0 through
9-1I-8 shall be grounds for revocation of this conditional use permit.
8. Disposal of Waste: No waste material of any kind, including plaster, cement, paint,
mud, or any other type of debris or liquid shall be allowed to be disposed of in the
street or gutter, storm drain or sewer system. Failure to comply with this condition
will result in charges being filed with the District Attorney (TCMC 3-4-A-0 — 3-4A-
11).
9. All repair/maintenance work shall be limited to the hours between 7:00 a.m. to 6:00
p.m. Monday through Friday, and between 8:00 a.m. to 5:00 p.m. on Saturdays.

10. The applicant shall comply with all conditions of approval and is subject to
monitoring by Temple City Community Development staff. The City reserves the
right to inspect the property to determine compliance with the conditions of
approval. The applicant shall pay the Community Preservation inspection fee as
determined by the fee schedule in place at the time of the inspection.
11. The conditional use permit shall expire six months after the discontinuation of the
use.
12. This conditional use permit approval shall expire 24 months from the date of
approval. If the project is not commenced prior to the expiration date, the
applicant may apply in writing for an extension of time at least forty (40) days
before the expiration date.
13. This Resolution shall not become valid until such time that the applicant and
property owner have signed the Acceptance of Project Conditions.
14. The applicant and property owners, and their successors in interest, shall indemnify
and defend the City of Temple City and its officers, employees and agents from and
against all liability and costs relating to the City's actions concerning this project,
including (without limitation) any award of litigation expenses in favor of any person
or entity who seeks to challenge the validity of any of the City's actions or decisions
in connection with this project. The City shall have the sole right to choose its counsel
and property owners shall reimburse the City's expenses incurred in its defenses of
any lawsuit challenging the City's actions concerning this project.
