A Regular Meeting of the Mayor and Council of the Borough of
Carteret was called to order by Mayor Daniel J. Reiman at 6:00
P.M., Thursday, November 18, 2010, Council Chambers,
Memorial Municipal Building, 61 Cooke Avenue, Carteret, New
Jersey.
Upon individual roll call vote the following were noted present:
Councilmember Vincent Bellino
" Jorge Diaz
" Randy Krum
" Susan Naples
" Joseph W. Sitarz
Noted absent was Councilmember Dennis DiMascio and Kathleen
M. Barney, Municipal Clerk.
Also noted present was Linda A. Rivera, Assistant Municipal
Clerk and Robert J. Bergen, Borough Attorney,
The Assistant Clerk stated on January 4, 2010 the 2010 Annual
Notice was mailed to The Home News Tribune, The Star Ledger
and posted on the Bulletin Board. It was published in The Home
News Tribune on January 6, 2010 and in The Star Ledger on
January 8, 2010.
Upon MMS &C by Councilmembers Sitarz and Krum and
unanimous affirmative vote of the five (5) Councilmembers
present, the Minutes of November 4, 2010 were approved and
transcribed and engrossed by the Assistant Clerk.

ORDINANCE #10 -13 The Assistant Clerk stated that Ordinance #10 -13 was introduced
"Capital and adopted on First Reading at an Agenda Meeting of the
Improvement, Borough Council of the Borough of Carteret held on November 4,
Appropriating 2010. It was duly published in The Home News Tribune on
$400,000 for
Various Capital November 9, 2010 with notice that it will be considered for final
Improvements" passage after Public Hearing to be held on November 18, 2010 at
6:00 P.M. The Ordinance was posted on the Bulletin Board and
copies were made available to the general public and according to
law, she read the Ordinance by title.
Public Hearing Upon MMS &C by Councilmembers Naples and Diaz and
unanimous affirmative vote of the five (5) Councilmembers
present the Mayor declared the Public Hearing to be opened.
There were no questions or comments.
Hearing Closed There being no further comments or objections to the Ordinance,
the Mayor declared the Public Hearing to be closed upon MMS &C
by Councilmembers Sitarz and Krum and unanimous affirmative
vote of the five (5) Councilmembers present.

Upon MMS &C by Councilmembers Diaz and Sitarz and
unanimous affirmative vote of five (5) Councilmembers present,
the public portion on Resolutions /Agenda Items and New Business
was opened to the public.
The Assistant Clerk then read the names of anyone who had
signed the book to speak at the public portion of the meeting.
TheAssistant Clerk then called upon Thomas Kaminsky.
Thomas Kaminsky then spoke. He asked what was the disposition
of his son.
Mayor Reiman explained to Mr. Kaminsky that he would like to
answer that but as be knew from prior hearings or prior Council
Meetings it is considered a personnel and confidential matter. He
said he can say that they have not received any determination from
the judge yet relative to that case.
Mr. Kaminsky asked the Mayor if he knew bow long it would be.
Mayor Reiman explained be did not.
Attorney Bergen explained that final briefs have been submitted
and the judge will write his decision and it will be whenever he
reaches his decision .
Mayor Reiman said he had hoped to have something settled prior
to, long prior to, but it has yet to be resolved.

Cent: Mr. Kaminsky said his car had been vandalized and someone stole
the PBA Sign off his lawn.
Mayor Reiman said be would speak to the Chief tomorrow but be
is sure they will increase the patrols within the area.
The Assistant Clerk then called upon Kevin Urban.
Kevin Urban Kevin Urban then spoke. He said he read the Classified Ads for the
West Carteret, " Memoes" that 1.7 million dollars is being bonded
for a gas station/convenience store.
Mayor Reiman explained that the city is not bonding for anything
and told Mr. Urban lie was talking about the Redevelopment
Agency.
Mr. Urban asked if "Memoes" is a Carteret property.
Mayor Reiman said he believed so and once again explained to
him that lie was talking about the Redevelopment Agency and
what he was referencing was the `Build America Bonds ", that
were issued as part of Federal Government economic stimulus, so
what dollars are being available are tax exempt low interest loans
from the IRS that come through the Redevelopment Agency and
are loaned to businesses that are going to be building in Carteret.
He said it cannot be used for acquisition or for hiring, it can only
be used for construction. He explained those liens, like a small
business loan, would be the first or primary mortgage on the
property so it wouldn't be subordinate to any other type of lien,
loan or lender.
Mi•. Urban asked who is ultimately responsible for that bond,
because he explained he may of read it wrong but it said that the
State and County were not responsible, but the Borough of Carteret
is.

Mayor Reiman said the Borough is not responsible for the Kevin Urban Cent:
bonding, the Redevelopment Agency would be issuing the bond,
again explaining it is a IRS tax exempt loan that would be a low
interest economic development loan that would go through the
Redevelopment Agency to the private entity and the private entity
would be the responsible party and would be putting up whatever
the collateral is such as the property, the building , personal
guarantees, private financing, any type of financing like that like a
normal commercial loan.
Mr. Urban asked if there would be no way at all that Carteret
would be on the hook for any of that money.
Mayor Reiman said there was no way that the Borough, per say, is
on the hook for any of the money, explaining the Redevelopment
Agency ultimately is the lending entity. He said the IRA makes it
tax exempt and the Redevelopment Agency would be the lending
entity to the business that would be building or developing and
ultimately if there is an issue he explained that they have no ability
to raise taxes so it wouldn't necessarily hit any taxpayer.
Mr. Urban said the article said they cannot levy taxes or be
responsible on a county, state or local level for any of the monies,
except the Borough of Carteret.
Mayor Reiman said Ire didn't not know specifically what he was
referencing but he said he knew he was referencing the Build
America and Economic Development Bonds that are issued
through the Redevelopment Agency process.
Upon MMS &C by Councihnembers Sitarz and Krum and Public Portion
unanimous affirmative vote of the five (5) Councilmembers Closed
present the public portion was closed.
Mayor Reiman then asked if there were any questions from the RESOLUTIONS
Borough Council for Resolutions #10 -259 thru #10 -263.

COMMITTEES
Cont: Forms in a steadily fashion and are ready to begin processing the
rebate checks. He said in terms of the Finance Office we requested,
from all departments, to receive their budget request for 2011 by
November 1st and they have been received and the information is
being compiled. He went on to report that they are beginning to
work on the 2011 Municipal Budget and after hunting numbers
will figure out how the 2% levy cap will effect our Municipal
Budget. Continued Progress.
FIRE &DOMESTIC PREPAREDNESS - Committee Chairperson
Krum reported on November 7 °i the Fire Department gave away
over two hundred (200) smoke detector batteries in front of the
local Shop Rite as part of the "Change Your Clock, Change Your
Battery Program" of which the batteries were supplied by the
Energizer Company and served as a reminder to change the smoke
detector batteries amorally, fIe said on this past Thursday our paid
firefighters and EMT's hosted a Fire Safety Education Program for
our seniors where the firefighters made meatballs and ziti and
dessert and there was a home health company there to speak on
different programs available to our seniors. He went on to report
on November 6 "' our volunteer and career firefighters participated
in a joint drill at the academy in Middlesex for a live burn exercise
which focused on fighting basements fires and the difficulties
associated with them, such as limited ventilation and access.

POLICE: Conunittee Chairperson Sitarz reported Progress.
PARKS, RECREATION & PUBLIC PROPERTY: Committee
Chairperson Bellino reported basic day to day operations and that
Sullivan Field was in process with 8% of the drainage in now and
is looking good. Progress.
PUBLIC WORKS: Councithnember Bellino reported Progress for
Public Works.
BOARD OF EDUCATION: Committee Chairperson Napes said
the Middle School is sponsoring a Food Drive for the holidays and
anyone that wishes to donate food can drop the food off at the

For Resolution #10 -263, upon individual roll call vote, Resolution #10 -26
Councilmembers Diaz, Naples, Krum and Sitarz voted in the Adopted
Affirmative. Councilmember Bellino Abstained and
Councilmember DiMascio was noted Absent.
Mayor Reiman asked Councilmember Bellino asked if be
abstained on Resolution #10 -263 because lie was a Commissioner
on the Authority and Councilmember Bellino concurred.
Upon MMS &C by Councilmembers Diaz and Sitarz, all bills PAYMENT OF BILLS
appearing on the prepared list, properly audited and signed were
ordered to be paid. Upon individual roll call vote, Councilmembers
Bellino, Diaz, Krum, Naples and Sitarz voted in the Affirmative.
Councilmember DiMascio was noted Absent.
REPORTS: REPORTS
Health/OA- September & October 2010.
Upon MMS &C by Councilmembers Bellino and Sitarz and
unanimous affirmative vote of the five (5) Councilmembers
present, all Reports were ordered to be received and placed on file.
COMMITTEES: COMMITTEES
BUILDINGS & GROUNDS: Conunittee Chairperson Naples
reported regular maintenance and getting the equipment ready for
snow and putting up the holiday decorations and getting ready for
the festival.
FINANCE & ADMINISTRATION: Committee Chairperson Diaz
reported the Sewer Collection Office is receiving the Sewer Rebate

and serviced quite a few students under the money from that grant
and they will be working on some health and obesity training.
Mayor Reiman then spoke on the question, brought up earlier, Mayor Reiman
relative to the Economic Development Bonds, for the
Redevelopment Agency. He said he wanted to go on record
pointing out that it was a very competitive process for the Agency
and the Borough to receive that designation, explaining towns,
municipalities and counties all around the nation were applying to
use these dollars and in essence in private Economic Development
if someone is going to an institutional lender, Wall Street or a
bank, they are going to be paying 7% to 9 %. and said financing
private development construction through the Redevelopment
Agency will allow the agency to benefit, as well as the community,
in terms of ratable growth and will also allow a developer, as
incentive, they will be able to borrow the money from Wall Street
at 3 % or 4 %, almost half than the amount they otherwise would
have been paying on those bonds. He said it is a way to stimulate
the economy, economic development revitalization in that
particular area. He explained Carteret received that designation
because of our redevelopment efforts and because of our Urban
Enterprise Zone status and we received designation up to eleven
(11) million dollars and there have been two (2) or three (3)
projects fimded as part of that 1.7 million that we referenced.
Mayor Reiman said he also had an ordinance to introduce and said
lie did not have a hard copy, as of yet, but they would do it just by
title and then of course publish it. He explained it is a technical
correction in Chapter 19 of the Borough Code; Ordinance #02 -23;
relative to hours of operation.
ORDINANCE #10 -14 was introduced and adopted on First ORDINANCE #10 -14
Reading and the Assistant Clerk authorized and directed to "Amending OrdinanTe
