HomeMy Public PortalAbout1992-09-15 Budget Hearing11 COUNCIL MINUTES BUDGET HEARING AND ZONING MEETING - SEPTEMBER 15, 1992 A Budget Hearing and Zoning meeting of the Bal Harbour Village Council was held on Tuesday, September 15, 1992 in the Council Chamber at Bal Harbour Village Hall. The meeting was called to order by Mayor Stern at 5:55 p.m. The roll was called and those present were: Mayor Estelle Stern Assistant Mayor Andrew R. Hirschl Councilman Matthew B. Blank Councilman James E. Boggess Councilman Sol M. Taplin Also present: Carole S. Morris, Village Manager Jeanette Horton, Village Clerk 1 Richard J. Weiss, Village Attorney As a quorum was determined to be present, the meeting commenced. 2. Discussion of Proposed Tax Millage over the Rolled -Back Millage and discussion of the tentative Budgets: Mayor Stern announced that the millage rate proposed, 0.0% over the rolled back millage rate. Mayor Stern then opened the Public Hearing, and as no one desired to speak, closed the Public Hearing. 3. Adoption of the Tentative Millage Rate: A:motion to tentatively adopt the millage rate of 3.36 was offered by Councilman Bank and seconded by Councilman Taplin. The motion carried unanimously (5-0). 4. First Reading Ordinances/Public Hearings - Tentative Budgets: General Fund: An Ordinance was presented for first reading and read by title by the Village Clerk which would provide for adoption of the General Fund Budget for the fiscal year 1992/93. Mayor Stern then opened the Public Hearingfor comments, and as no one desired to speak, closed the Public Hearing. A motion was offered by Councilman Boggess and seconded by Councilman Blank to enact this Ordinance. The motion carried unanimously (5-0), thus becoming ORDINANCE OF BAL HARBOUR VILLAGE ADOPTING A BUDGET FOR THE PERIOD OF OCTOBER 1, 1992 TO SEPTEMBER 30, 1993 IN THE AMOUNT 1 Mr. Weiss left the meeting after the Zoning Ordinance and was replaced by Deputy Village Attorney Gil Pastoriza Budget Hearing and Zoning 9/15/92 1 118 OF $4,117,187 AUTHORIZING EXPENDITURES; ESTABLISHING AN EFFECTIVE DATE. Water Department: An Ordinance was presented for first reading and read by title by the Village Clerk which would provide for adoption of the Water Department Budget for the fiscal year 1992/93. Mayor Stern then opened the Public Hearingfor comments, and as no one desired to speak, closed the Public Hearing. A motion was offered by Councilman Taplin and seconded by Assistant Mayor Hirschl to enact this Ordinance. The motion carried unanimously (5-0), thus becoming ORDINANCE OF BAL HARBOUR VILLAGE ADOPTING A BUDGET FOR THE WATER DEPARTMENT FOR THE PERIOD OF OCTOBER 1, 1992 TO SEPTEMBER 30, 1993 IN THE AMOUNT OF $852,725; AUTHORIZING EXPENDITURES; ESTABLISHING AN EFFECTIVE DATE. Sanitary Sewer Department: An Ordinance was presented for first reading and read by title by the Village Clerk which would provide for adoption of the Sanitary Sewer Department Budget for the fiscal year 1992/93. Mayor Stern then opened tfie Public Hearing for comments, and as no one desired to speak, closed the Public Hearing. A motion was offered by Councilman Blank and seconded by Councilman Boggess to enact this Ordinance. The motion carried unanimously (5-0), thus becoming ORINANCE OF BAL HARBOUR VILLAGE ADOPTING A BUDGET FOR THE SANITARY SEWER DEPARTMENT FOR THE PERIOD OF OCTOBER 1, 1992 TO SEPTEMBER 30, 1993 IN THE AMOUNT OF $486,410; AUTHORIZING EXPENDITURES; ESTABLISHING AN EFFECTIVE DATE. Department of Tourism: An Ordinance was presented for first reading and read by title by the Village Clerk which would provide for adoption of the Department of Tourism Budget for the fiscal year 1992/93. Mayor Stern then opened the Public Hearing for comments. Councilman Blank questioned the fund balance of the Department. Mrs. Morris replied between $1.6 and $1.7 million. As there were no further comments, Mayor Stern closed the Public Hearing. A motion was offered by Councilman Blank and seconded by Councilman Taplin to enact this Ordinance. The motion carried unanimously (5-0), thus becoming ORDINANCE OF BAL HARBOUR VILLAGE ADOPTING A BUDGET FOR THE DEPARTMENT OF TOURISM FOR THE PERIOD OF OCTOBER 1, 1992 TO SEPTEMBER 30, 1993 IN THE AMOUNT OF $ 1,295,285; AUTHORIZING EXPENDITURES; ESTABLISHING AN EFFECTIVE DATE. 5. Announcement: Percentage, if any, by which the Proposed Millage exceeds the Rolled -Back Millage: Mayor Stern announced that the proposed millage rate exceeds the rolled -back millage rate by 0.0%. Budget Hearing and Zoning 9/15/92 2 119 6. Announcement: Next Budget Hearing Date: Mayor Stern announced that the next Budget Hearing will be September 30, 1992 at 5:15 p.m. 7. Other Business: Zoning Ordinance First Reading/Public Hearing Appearance Code Amendment An Ordinance was presented for first reading and read by title by the Village Clerk which would appoint an Ex-Officio member to the Architectural Review Board. Mayor Stern opened the Public Hearing for comments and there being none, closed the Public Hearing. A motion was offered by Councilman Blank and seconded by Councilman Taplin to enact this Ordinance. The motion carried. unanimously (5- 0), thus becoming ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA AMENDING SECTION 5.5-11 OF THE BAL HARBOUR VILLAGE CODE; DESI` rNATING THE CHAIRMAN OF THE BAL HARBOUR BEAUTIFICATION COMMITTEE AS AN EX-OFFICIO, NON -VOTING MEMBER OF THE ARCHITECTURAL REVIEW BOARD; PROVIDING FOR SEVERABLIITY, INCLUSION IN THE CODE AND AN EFFECTIVE DATE. PERMITTED USE Mr. Weiss explained the difference between the Ordinance as presented by Mr. Whitman's attorney and the alternate. He further stated that the alternate Ordinance gives the Council more control, as well as eliminatesg service stations as a permitted use. Discussion followed and it was the consesus of the Council to add the following additional permitted uses which are houseware stores, optical businesses, skin salons and watch sale and repair shops. A motion was offered by Councilman Blank and seconded by Councilman Taplin to enact the alternate Ordinance. The motion carried unanimously (5-0), thus becoming ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA AMENDING SECTION 21-316 OF THE VILLAGE CODE; EXPANDING THE LIST OF PERMITTED USES IN THE "B" BUSINESS DISTRICT TO INCLUDE THE FOLLOWING: APPLIANCE, ELECTRONIC AND TELEPHONE STORES; ART GALLERIES; AUCTION HOUSES; FINANCIAL INSTITUTIONS; CHILD CARE OR JUVENILE ENTERTAINMENT FACILITIES (BUT NOT VIDEO ARCADES); BAKERIES; FLORISTS; HEALTH CLUBS AND SPAS; DRY GOODS STORES; DEPARTMENT AND VARIETY STORES; HOME FURNISHINGS, CHINA, JEWELRY. BOOK, TOY, VIDEO, SOAP, PERFUME, COMPUTER HARDWARE AND SOFTWARE, LEATHER GOODS AND GIFTS STORES; PARKING OF AUTOMOBILES; PRIVATE CLUBS; ALTERATION SHOPS; TRAVEL AGENCIES; AND OTHER SIMILAR USES AS MAY BE PERMITTED BY, THE VILLAGE COUNCIL, AFTER A PUBLIC HEARING, PROVIDED THAT SUCH USES ARE COMPATIBLE WITH AND DO NOT ADVERSELY AFFECT THE CHARACTER OF THE "B" BUSINESS DISTRICT; ELIMINATING SERVICE STATIONS AS A PERMITTED USE; Budget Hearing and Zoning 9/15/92 3 120 PROVIDING SEVERABILITY, INCLUSION IN THE CODE AND AN EFFECTIVE DATE. At this time Councilman Boggess requested that the Village Manager and Village Clerk be excused. Deputy Attorney Mr. Pastoriza will take the minutes. Discussion followed as to what a good job the Manager is doing and that there is no comparison with other cities. The salaries of Key Biscayne and Bay Harbor Island Managers were given in comparison with Mrs. Morris. Councilman Boggess stated the minutes of January 1991 reflect that the Village Clerk was appointed with a provision of a salary review after four months and it is now nineteen months. Councilman Boggess suggested a salary increase to $40,000 for the Village Clerk and $60,000 for the Village Manager without any cost of living increase. Assistant Mayor Hirschl stated that both the Village Manager and Village Clerk salaries should be reviewed on an annual basis by the Council. A motion was offered by Councilman Blank and seconded by Councilman Boggess to increase the salary of the Village Manager i-o $60,000 and the Village Clerk to $40,000. The motion carried unanimously (5-0). 8. Adjourn: There being no further business to come before the Council, a motion was offered by Councilman Blank and seconded by Councilman Taplin to adjourn.
