HomeMy Public PortalAbout20060117REGULAR COUNCIL MEETING JANUARY 17, 2006 CALL TO ORDER The Regular Council Meeting of January 17, 2006, was convened at 6:00 P.M. by Mayor John Landwehr. Prayer was offered by Councilman Edith Vogel, followed by the Pledge of Allegiance. ROLL CAL The following Council Members were present for the roll call: Present: Berry, Crane, Ferguson, Layton, Martin, Pope, Schnitzler, and Vogel Absent: Brown and Harvey A quorum was declared present. PUBLIC HEARINGS Rezoning 601 -615 Clark Avenue from RS -4 to C -1 - City Planner Janice McMillan gave a staff report on the background of the requested rezoning, and answered questions by the Council. No one present requested to speak in favor of, or opposition to, the proposed rezoning. Mayor John Landwehr declared the evidentiary portion of the public hearing concluded, and announced the Council will now take up the associated pending bill. Bill 2005 -130, sponsored by Councilman Brown, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING FROM RS -4 SINGLE FAMILY RESIDENTIAL TO C -1 NEIGHBORHOOD COMMERCIAL, PROPERTY ADDRESSED AS 601 -615 CLARK AVENUE, LOCATED ON THE EAST SIDE OF CLARK AVENUE SOUTH OF ELM STREET AND CONSISTING OF THE WEST 122 FEET OF LOTS 108, 109, 110, AND 111 AND ALL OF LOTS 112, 113, 114, 115 AND 116, FAIRVIEW ADDITION, JEFFERSON CITY, MISSOURI. Bill 2005 -130 was read third time by title, placed on final passage and passed by the following roll -call vote as Ordinance 13997: REGULAR COUNCIL MEETING JANUARY 17, 2006 Aye: Berry, Crane, Ferguson, Layton, Martin, Pope, Schnitzler, and Vogel Nay: None MINUTES AND REPORTS RECEIVED AND FILED Mayor John Landwehr announced that the following minutes and reports have been received and are on file and may be reviewed in the City Clerk's office: a. Finance Committee, October 24, 2005 b. Transportation & Traffic Commission, November 10, 2005 c. Police Personnel Board, November 3, 2005 d. Historic Preservation Commission, December 13, 2005 e. Board of Adjustment, December 13, 2005 COUNCIL LIAISON REPORTS Councilman Kenneth Ferguson announced that at its January 10 meeting, the Human Relations Commission had conducted a training workshop to determine what their role and functions are. Mayor John Landwehr asked Councilman Kenneth Ferguson would relay an invitation to the Chairman of that Commission to attend an upcoming Council Meeting to make a presentation about activities of the Commission. Councilman Kenneth Ferguson stated he would pass that invitation along to the Chairman. ANNOUNCEMENTS OF OTHER UPCOMING MEETING AND EVENTS Councilman Kenneth Ferguson announced that a meeting of the East Side Neighborhood Association will be held on Thursday, January 26 at 6:30 P.M. at the Missouri River Regional Library. Councilman Jonathon Schnitzler announced that he and Councilman Edith Vogel are cosponsoring a Ward 2 Listening Post meeting which will be held on Monday, February 13 from 6:30 to 8:00 P.M. at the National Guard Armory to discuss issues affecting the area surrounding the 800 to 1900 blocks of St. Mary's Boulevard. He invited citizens in that area, as well as any other Council Members, to attend. APPOINTMENTS BY THE MAYOR There were no appointments brought before the Council at this time. Mayor John Landwehr asked if someone from staff could ask Finance Director Steve Schlueter, who is absent from tonight's meeting, to provide the Council with a report that shows how the airport operates financially in relationship to the budget. BILLS PENDING Bill 2005 -131, sponsored by Councilman Martin, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE REGULAR COUNCIL MEETING JANUARY 17, 2006 MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH TRANSYSTEMS CORPORATION.\ Bill 2005 -131 was read third time by title, placed on final passage and passed by the following roll -call vote as Ordinance 13998: Aye: Berry, Crane, Ferguson, Layton, Martin, Pope, Schnitzler, and Vogel Nay: None INFORMAL CALENDAR Bill 2005 -116, sponsored by Councilman Martin, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI APPROVING A SPECIAL EXCEPTION USE PERMIT FOR A CLUSTER SUBDIVISION ON 14.47 ACRES OF LAND LOCATED NORTHWEST OF DIAMOND RIDGE AND AMETHYST LANE, IN THE 900 BLOCK OF AMETHYST LANE, DESCRIBED AS PART OF TRACT 1 OF MOSERS SUBDIVISION. Councilman Dean Martin, requested that Bill 2005 -116 remain on the Informal Calendar at this time. City Planner Janice McMillan announced that a meeting has been scheduled for January 26 from 4:00 to 6:00 P.M. at City Hall between the affected residents and developer to discuss this issue. RESOLUTIONS There were no resolutions brought before the Council at this time. SCHEDULED REPORTS No reports were scheduled at this time. NEW BUSINESS Mayor John Landwehr announced that the signing ceremony for the Memorandum of Understanding between the United States Government and local entities for the location of a new Federal Courthouse in the Prison Redevelopment area. He stated this is a very important development for our city. UNFINISHED BUSINESS REGULAR COUNCIL MEETING JANUARY 17, 2006 City Counselor Nathan Nickolaus announced that Council Members unable to attend the Brown Bag meetings will be able to participate in those meetings by a conference call system which the City has set up at Councilman Jonathon Schnitzler's request. Councilman Edith Vogel gave a report on a recent meeting of the committee charged with looking at the issue of a new Cole County Jail facility. She stated the main committee had appointed six subcommittees which were all charged with looking at more specific aspects of the facility. Councilman Kenneth Ferguson reported on a tour of the current jail facility, and stated that the judges have asked the committee to consider that the jail and courthouse remain together as one facility. January 3, 2006, Closed Session Minutes A motion was made by Councilman Kenneth Ferguson to approve the minutes as presented, seconded by Councilman Michael Berry, and approved unanimously GO INTO CLOSED SESSION Mayor John Landwehr stated that, pursuant to Sec. 610.021 of the Revised Statutes of Missouri, he would entertain a motion for the Council to go into Closed Session to discuss the following: a. Personnel [Sec. 610.021(3)] A motion was made by Councilman Cindy Layton, seconded by Councilman Jonathon Schnitzler, and approved unanimously by the following roll -call vote at 6:35 P.M.
