HomeMy Public PortalAbout19-9694 Miami Dade County take ownership of NW 131 St from 31st Avenue to 32nd AvenueSponsored by: City Manager RESOLUTION NO.19-9694 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, REQUESTING THAT MIAMI-DADE COUNTY TAKE OWNERSHIP OF NW 131 STREET, FROM NW 31rd AVENUE TO NW 32rd AVENUE; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City is currently under a financial state of emergency and is receiving financial oversight from the State of Florida; and WHEREAS, Miami -Dade County owns property immediately adjacent to City roadway 131 Street (from 31 st Avenue to 32"1 Avenue), known as Ingram Terrace Apartments; and WHEREAS, 131 st Street is the sole means of ingress and egress for the residents of Ingram Terrace Apartments, owned by Miami -Dade County; and WHEREAS, the roadway is currently in an unsafe condition and is difficult to navigate, particularly following rain events; and WHEREAS, there is an immediate need for roadway improvements on NW 131st Street, from NW 31st Avenue to NW 32nd Avenue; and WHEREAS, the City previously applied for Community Development Block Grant funding but was denied by the recommending authority; and WHEREAS, the estimated cost of the roadway repairs and stormwater drainage installation exceeds one million dollars and the City has no ability to pay; and WHEREAS, CDBG reviewers previously advised the City that it should reach out to and otherwise do all that is necessary to seek funding directly from Miami - Dade County to address the serious conditions associated with the subject roadway; and Resolution No. 19-9694 WHEREAS, in an effort to immediately address urgent needed repairs for NW 131st Street, the City Commission is requesting that Miami -Dade County take ownership of the subject roadway and make the necessary repairs now being requested; and WHEREAS, the City is desirous of receiving the roadway back from Miami - Dade County and into its jurisdiction and control once needed repairs are completed; and WHEREAS, County ownership of NW 31st Street between 31st Avenue and 32nd Avenue is in the best interest of the residents of the City of Opa-Locka. NOW THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: Section 1. Recitals. The recitals to the preamble herein are incorporated by reference. Section 2. Ownership by Miami -Dade County. The City Commission of the City of Opa-Locka hereby requests that Miami -Dade County take ownership of NW 131st Street, between NW 31st Avenue and NW 32nd Avenue, for roadway repairs and stormwater drainage installation and improvements. The City Manager, and other city officials, are hereby authorized to execute any and all documents necessary to facilitate the transfer of the subject roadway for the purposes outlined herein. Section 3. Effective Date. This Resolution shall take effect immediately upon adoption, and is subject to the approval of the Governor of the State of Florida or his designee. A request to declare a localized state of flooding emergency. Staff recommends this declaration the basis that we have lost control of our stormwater management. After a rain event the majority of our roadways are rendered impassable due to significanf flooding. 2. The Cairo Lane contractor, Intercounty Engineering, Inc. On August 21, 2019, served us with a notice of their intent to terminate the contract for the Cairo Lane and Northwest 127 Street Roadway Improvemt Project, citing article 13 of the contract. Staff recommends that city commission iterview the contractor or their designee to seek alternatives to their withdrawal from the project. 3. A resolution requesting Miami -Dade County adopt Northwest 131 st Street between Northwest 31 st Avenue to Northwest to Northwest 32nd Avenue. The intent is for the performance of the needed rehabilitation of the roadway. This roadway serves as the sole means of ingress and egress for the residents of the county owned and operated Ingram Terrace Apartments, this complex is centrally located on the south side of the roadway. Staff recommends the passage of this resolution since the roadway is unsafe to navigate during dry periods, and impassibe during periods of rain. 4. Resolution 19-9643 was approved by the Commission for the New Roof Installation to the Municipal; however, we have not been able to mobilize this project because the New City Attorney does not feel comfortable signing a contract that was procured during the supervision of former City Attorney Vincent Brown. To facilitate this transition we are taking the item back to the commission for ratification. END OF MEMORANDUM
