At all times material hereto, Plaintiff is and was the owner of real property located at 23 Hidden Harbour Drive in Gulf Stream, Florida. ("Property.") 4. Defendant is apolitical subdivision of the State of Florida. Factual Background 5. Early in 2014 the Plaintiff became aware that pipes and/or other improvements (the "Improvements") had been installed by the Town of Gulf Stream underground on his Property. 6. Upon learning of the presence of the Improvements, Plaintiff informed Defendant and Mr. Danny Brannon of Brannon & Gillespie, LLC, a third party engineering consulting firm hired by the Defendant to oversee the installation of the Improvements, of the installation of the Improvements and demanded their removal. 7. Plaintiff requested that Defendant cease its work on Plaintiffs Property and, inter alia, immediately remove the Improvements that were installed. 8. On March 31, 2014 Mr. Brannon informed Plaintiff that the Improvements had been partially removed and that the remaining sections would be removed. 9. On or around August 27, 2014, Plaintiff, while in Town Hall, noticed a town map on an easel in the lobby that indicated that the Improvements (labeled as "Underground Pipe — Purple" on the map) were still in existence and installed on Plaintiffs Property. 10. On the same date, Albert Medina, Esq., then counsel for Plaintiff, emailed Mr. Brannon regarding the removal of the Improvements. 11. To date the Improvements have not been removed.
