CITY COUNCIL MINUTES
AUGUST 15, 1989
INITIATION:
1. CALL TO ORDER:
Pursuant to Agenda posted on August 11, 1989, Mayor Froehle
called the meeting of the City Council to order at 7:30 P.M. on
Tuesday, August 15, 1989.
2. The invocation was given by Dr. Douglas Beyer, First Baptist
Church, 6019 North Baldwin Avenue.
3. The Pledge of Allegiance to the Flag was led by Mayor Froehle.
4. ROLL CALL:

5. CONSENT CALENDAR:
Mayor Froehle removed Item B at the request of a member of the
audience. Councilmember Swain-moved to approve the remainder
of the Consent Calendar as presented, seconded by Councilmember
Breazeal and unanimously carried.
A. APPROVAL OF MINUTES - Regular meeting of August 1, 1989 -
Council approved as written.
C. RESOLUTION NO. 89 -2895: REQUESTING ALLOCATION AND PAYMENT
OF COUNTY AID -TO- CITIES FUNDS -
Council adopted Resolution No. 89 -2895, A RESOLUTION OF THE
CITY OF TEMPLE CITY REQUESTING AN ALLOCATION AND PAYMENT OF
COUNTY AID -TO- CITIES FUNDS FOR THE MAINTENANCE OF SELECT
SYSTEM STREETS.

D. ZONING CODE AMENDMENT: ORD. NO. 89 -654 (2ND READING) -
Council waived further reading and adopted Ordinance No.
89 -654 amending Sections 9111, 9116, 9119, 9202, 9291,
9296, 9333, 9350, 9360 and 9362 of the Temple City Zoning
Code.
E. FINAL MAP APPROVAL: PARCEL MAP NO. 19979 AT 10642 EAST
OLIVE STREET (MC CORMICK) -
Council approved Final Parcel Map No. 19979, made the
necessary findings as enumerated in the Los Angeles County
Department of Public Works' letter dated July 26, 1989, and
instructed the City Clerk to endorse on the face of the map
of Parcel Map No. 19979, the certificate that embodies the
approval of said map.
F. FINAL MAP APPROVAL: PARCEL MAP NO. 20356 AT 10119 GREEN
STREET (HOYT /OWEN CONSTRUCTION ) -
Council approved Final Parcel Map No. 20356, approved and
accepted work agreements and improvement securities, made
the necessary findings as enumerated in the Los Angeles
County Department of Public Works' letter dated July 26,
1989, and instructed the City Clerk to endorse on the face
of the map of Parcel Map No. 20356 the certificate that
embodies the approval of said map.
G. PLANNING COMMISSION ACTIONS FROM THEIR REGULAR MEETING OF
AUGUST 8, 1989 -
Council received and filed.
H. RESOLUTION NO. 89 -2898: APPOINTMENT OF PERSONNEL -
Council adopted Resolution No. 89 -2898 approving the em-
ployment of budgeted personnel.
I. RESOLUTION NO. 89 -2899: APPROVAL OF PAYMENT OF BILLS -
Council adopted Resolution No. 89 -2899 allowing claims and
demands in the amount of $154,832.67.
B. RESOLUTION NO. 89 -2897: APPROVING THE DESTRUCTION OF
CERTAIN RECORDS -
William Bretz, 8723 E. Hermosa, as a member of the Con-
cerned Residents of Temple City, asked what kind of records
were being destroyed. He asked if any were related to the
development in Block "A" as he wanted to make sure nothing
on this project was included in the records to be
destroyed.

City Manager Koski stated there are no CRA materials on the
list to be destroyed. All items on the list have been
reviewed and approved by the City Attorney. Most of the
records being destroyed are memos, letters and miscellane-
ous dated material. The destruction of records takes place
annually and is in accordance with the City's Records
Retention Schedule.
Councilmember Atkins moved to adopt Resolution No. 89 -2897,
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
APPROVING THE DESTRUCTION OF CERTAIN CITY RECORDS, seconded
by Councilmember Gillanders and unanimously carried.
6. UNFINISHED BUSINESS: NONE
7. NEW BUSINESS:
A. PUBLIC HEARING: PERS CONTRACT AMENDMENT (ORDINANCE NO.
89 -655) -
Providing background information, City Manager Koski stated
that Council, on August 1, 1989, adopted resolution of
'intention to amend the contract between the City and PERS
relating to the removal of the exclusion of elected offi-
cials and set a public hearing for August 15th. Ordinance
No. 89 -655 is required by PERS to initiate the amendment to
the contract.
Mayor Froehle declared the public hearing open.
As there was no one who wished to speak on this item,
Councilmember Swain moved to close the public hearing,
seconded by Councilmember Gillanders and unanimously car-
ried.
Councilmember Breazeal saw no reason to question this
amendment and recommended approval.
Councilmember Swain moved to introduce for first reading by
title only Ordinance No. 89 -655, AN ORDINANCE OF THE CITY
COUNq,IL OF THE CITY OF TEMPLE CITY AUTHORIZING AN AMENDMENT
TO THE CONTRACT OF THE CITY OF TEMPLE CITY AND THE BOARD OF
ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIRE-
MENT SYSTEM; seconded by Councilmember Atkins and unani-
mously carried.

B. RECOMMENDATION FROM TRAFFIC COMMISSION MEETING OF AUGUST 2,
1989: S.M.A.R.T. - SPEED MONITORING AWARENESS RADAR TOOL -
As background, City Manager Koski reported that the Traffic
Commission on August 2, 1989 received information and
reviewed a video about a new traffic safety device which
provides motorists with a reminder of the posted speed
limit and a visual display of their current speed. The
consensus of the Commission was that SMART appeared to be a
simple and effective tool which could be of significant
value in reducing speeding and accidents on many of the
City's streets. The Commission recommends Council con-
sider acquisition of a SMART for use in Temple City, er-
haps in joint ownership with another city. The Commission
recommends staff investigate possible alternate sources of
funding and a possible joint use and maintenance agreement
and report back to Council.
Mayor Froehle explained the machine uses radar to measure
speed of a vehicle; however, it is not used to write tick-
ets. It is a trailer with a sign indicating the speed
-limit and then large numbers appear indicating the speed at
which the approaching vehicle is traveling. It acts as a
deterrent.
Councilmember Gillanders remarked he saw one in Oregon and
it did get his attention. He asked if Prop. A Funds might
be used in this area. He would like to see it used on
Lower Azusa Road.
Councilmember Atkins shared some of Councilmember
Gillanders thoughts on it. He felt it would be a helpful
tool. He did feel the display should have plexiglass
rather than glass. He felt it would be appropriate to put
on El Monte Avenue and then Lower Azusa.
Councilmember Swain felt it would be a fine tool and could
be put to good use. Additionally, she felt sharing the
cost-with another city is an excellent idea.
Councilman Breazeal commended the Traffic Commission and
Sgt.'Terhorst for doing a good job on the study.
Mayor Froehle felt staff should pursue alternate sources of
funds, such as service clubs, etc. before paying out of
General Fund or using Prop. A. Funds.
Councilmember Gillanders moved to approve acquisition of a
SMART for use in Temple City and to pursue the possibility
of a joint ownership agreement with Duarte or another
neighboring community and requested staff to pursue alter-
nate sources of funds; seconded by Councilmember Breazeal
and unanimously carried.

C. PLANNING COMMISSION RECOMMENDATION RE: COMMERCIAL DEVELOP-
MENT IN BLOCK "A" -
As background, City Manager Koski stated that on August 8,
1989, the Planning Commission adopted a resolution recom-
mending the approval of a General Plan amendment, Zone
Change and Conditional Use Permit to allow development of a
promotional retail shopping center at the northwest corner
of Las Tunas Drive and Rosemead Blvd. The proposed devel-
opment is situated within a portion of Block "A" of the
Rosemead Boulevard Redevelopment Project Area. The project
as recommended by the Planning Commission is consistent
with and subject to all mitigation measures and provisions
of the previously certified Environmental Impact Report and
previously approved Disposition and Development Agreement.
The action of the Planning Commission in this instance is
advisory. The entire project, including the Conditional
Use Permit is subject to approval of the City Council. It
is suggested a public hearing be set for this matter for
September 5, 1989.
Councilmember Swain moved to accept Planning Commission's
."recommendation and set public hearing for General Plan
Amendment No. 89 -2, Zone Change No. 89 -1013 and Conditional
Use Permit No. 89 -1012 for September 5, 1989; seconded by
Councilmember Atkins and unanimously carried.
D. URGENCY AMENDMENT TO ORDINANCE NO. 89- 651U -A1, AMENDMENT
SUBSECTION B OF SECTION 4 -
Council adopted Urgency Ordinance 89- 6510 -A1 on June 10,
1989. This Ordinance exempted projects which had received
an approved CUP (and Tentative Tract Map or Parcel Map, if
applicable), prior to the - effective date of the Urgency
Ordinance. The proposed amendment would also exempt pro-
jects which received site plan review approval or variance
approval prior to the effective date of the Urgency Ordi-
nance. If such previously approved projects are not ex-
empted, these cases would be treated differently from other
CUP applications. It is suggested that such projects be
exempt from provisions of the Urgency Ordinance.
Community Development Director Dawson reported there are
three cases that went through Planning Commission and City
Council and received approval but were inadvertently omit-
ted when they were reviewing the other exemptions. In
answer to questions from Council, Mr. Dawson stated he was
not sure of the F.A.R. of the three projects. They are all
located in an R -1 Zone and would be in compliance with
regulations of the R -1 Zone prior to adoption of the Ur-
gency Ordinance.

Councilmember Atkins moved to adopt Urgency Ordinance No.
89- 651U -A2, AN INTERIM ZONING ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF TEMPLE CITY AMENDING SUBSECTION B OF SECTION
4 OF ORDINANCE 89- 651U -A1 AS IT RELATES TO A MORATORIUM ON
CERTAIN TYPES OF DEVELOPMENT WITH THE R -1, R -2 AND R -3
ZONES OF THE CITY; seconded by Councilmember Breazeal and
unanimously carried.

9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: NONE
RECESS TO CRA:
At 7:50 P.M. the City Council met as the Temple City Community
Redevelopment Agency; approved the Minutes of the regular
meeting of August 1, 1989; held public hearings and adopted
Resolutions Nos. CRA 89 -372, 89 -373, 89 -374 and 89 -375, Reso-
lutions of the Agency finding and determining the public inter-
est and necessity for acquiring and authorizing the
condemnation of certain real property and tenants' leasehold
intexest and certain fixtures and equipment at 8925 and 8863
Las-Tunas Drive, 8844 -50 Elm Avenue and 5729 Rosemead Boule-
vard; recessed to a closed session with Agency's negotiator
regarding negotiations concerning the purchase of properties at
the above - listed addresses; considered City acquisition of the
property situated at the northwest corner of Elm and Rosemead
Boulevard for parking purposes; adopted Resolution No. CRA
89 -376 allowing claims and demands in the amount of $9,077.19
and received and filed correspondence from Champion Development
Company regarding the intent of T.J. Maxx to locate a depart-
ment store at the Northwest corner of Las Tunas Drive and
Rosemead Boulevard. The Minutes of the Agency are set forth in
full in the Agency's records. -
RECONVENE AS CITY COUNCIL
10. ACTION ON REQUEST BY CRA:
A. AUTHORIZATION TO APPRAISE AND NEGOTIATE FOR THE PURCHASE OF
PROPERTY LOCATED AT 8917 -23 ELM AVENUE AND 5801 -07 ROSEMEAD
BOULEVARD -
As background information, the Planning Commission on
August 8, 1989, recommended approval of a General Plan
Amendment, Zone Change and Conditional Use Permit for a
commercial shopping center at the northwest corner of Las
Tunas Drive and Rosemead Blvd. The project area includes a
so- called "Developer Parcel" situated north of Elm between
Reno and Rosemead Blvd. Champion Development owns a portion
of the "Developer Parcel" with the exception of the subject
property and has been unable to reach an acquisition agree-
ment with the owner. The Community Redevelopment Agency

has requested the City Council to consider acquisition of
the subject property for public parking. The request from
the Agency is to authorize appraisal and negotiation for
the purchase of this property.
Councilmember Gillanders moved to authorize appraisal and
negotiation for the purchase of the McAuley property lo-
cated on the northwest corner of Reno and Rosemead Boule-
vard, seconded by Councilmember Atkins and unanimously
carried.
11. MATTERS FROM CITY OFFICIALS:
A. CRIME VICTIM'S JUSTICE REFORM ACT -
Councilmember Atkins stated he just could not support this
until he finds out more about it. He felt it was a politi-
cal tool.
Councilmember Gillanders also expressed his hesitancy to
support this matter until he hears more about it.
It was the consensus of Council to take no action until
they receive more information on it.
Councilmember Swain moved to consider the following request as
an emergency issue because of timing, seconded by Councilmember
Gillanders and unanimously carried.
LEAGUE OF CALIFORNIA CITIES WORKSHOP, CLOVIS, CALIFORNIA
- SEPTEMBER 9, 1989 -
Approval is requested by Councilmember Breazeal to sit on panel
at a League Workshop as noted above. This request was received
too late to be included on the Agenda.
Councilmember Gillanders moved to approve attendance and au-
thorized the necessary expenditures as requested, seconded by
Councilmember Swain and unanimously carried.
Councilmember Breazeal commented on a letter Council received
from a resident expressing his appreciation and thanks to staff
for the manner in which they removed a tree on his property.
Mayor Froehle wished Councilmember Swain a Happy Birthday. He
then mentioned the luncheon held at Live Oak Park for a visit-
ing baseball team from Japan. He commented that the members of
the visiting Japanese All -Star team were very gracious. The
City presented a plaque to the visitors and in return received
several souvenirs from several Japanese guests.

12. ADJOURNMENT:
At 12:05 P.M., Councilmember Swain moved to adjourn to an
adjourned meeting on August 29, 1989, at 7:30 P.M. in Council
Chambers, seconded by Councilmember Breazeal and unanimously
carried. The next regular meeting of the City Council will be
held on Tuesday, September 5, 1989, at 7:30 P.M. in Council
Chambers, 5938 North Kauffman Avenue.
