CV409- O R D E R Plaintiffs filed this action on June 3, 2009, bringing claims under the Fair Housing Act, 42 U.S.C. §§ 3601 -3631, and related state law claims. (Doc. 1.) The Parties' have submitted a proposed Consent Decree (Doc 64) and Joint Motion for Dismissal with Prejudice (Doc. 65). The proposed Consent Decree, which the Parties request the Court approve, resolves all claims brought by Plaintiff Savannah— Chatham County Fair Housing Council ( "SCFHC ") 1 Plaintiffs and Defendants, with the exception of Defendant Bailey, have filed a Motion to Dismiss Michael William Bailey. (Doc. 67.) Defendant Bailey failed to answer Plaintiffs' Complaint. After careful consideration, the Motion is GRANTED and Defendant Bailey is DISMISSED from this case. against Defendants. The Joint Motion for Dismissal resolves Plaintiffs Sturgess's and Gehringer's claims against Defendants. The Consent Decree proposes that the alleged violations of the Fair Housing Act be addressed by Defendants retrofitting the completed construction. Defendants also agree to comply with the Fair Housing Act in the future, to educate its employees on design and construction requirements under the Fair Housing Act, and to provide public notice of their non - discrimination policy. Additionally, Defendants will pay Plaintiff SCFHC $10,800.00 as compensation for costs associated with bringing this litigation, including attorney's fees. In return, all claims asserted by Plaintiff SCFHC will be dismissed with prejudice. Parties to a lawsuit may always settle their dispute. See United States v. Armour & Co., 402 U.S. 673, 681 (1971). But where the parties wish to incorporate their settlement into a judicial decree, courts must give the agreement more careful scrutiny. United States v. City of Miami, 664 F.2d 435, 441 (5th Cir. 1981).2 Specifically, "[d]istrict courts should approve consent decrees so long 2 In Bonner v. Stovall v. City of Cocoa, 117 F.3d 1238, 1240 (11th Cir. 1997). After a careful review of the claims and defenses in this case, the Court APPROVES the proposed Consent Decree. Accordingly, Plaintiff SCFHC and Defendants are bound by the Decree's terms, and all claims asserted by Plaintiff SCFHC are DISMISSED WITH PREJUDICE. In addition, Plaintiff Sturgess, Plaintiff Gehringer, and Defendants' Joint Motion for Dismissal with Prejudice is GRANTED.
