A SPECIAL ORDINANCE AMENDING THE ZONING MAP
FOR A CERTAIN PARCEL FROM M-1 TO C-4
Whereas, the Zoning Map designates certain property legally described as follows, to wit:
Situated in the Northwest Quarter, Section 1, Township 13 North,
Range 1 West and the Southwest Quarter, Section 36, Township 14
North, Range 1 West, City of Richmond, Wayne Township,
Wayne County, Indiana, being part of a 61.464 acre tract as
described in Instrument 2004009191, as recorded in the Wayne
County Recorder's Office; being more particularly described as
follows: Commencing at an unmarked stone found at the southwest
corner of said Northwest Quarter; thence (bearings based on the
west line of said Northwest Quarter as being North 00°47'33" East
per prior surveys) North 00°47'33" East 1546.95 feet along the
west line of said Quarter, to the south line of said 61.464 acre tract;
thence South 89°59'49" East 951.83 feet along said south line, to
the POINT OF BEGINNING for the tract herein described; thence
North 00°47'33" East 514.12 feet, to the east side of a 50.00 foot
radius cul-de-sac on the proposed extension of South 52" d Street;
thence along a 50.00 foot radius curve to the left, through a central
angle of 45 °3 5' 57", having an arc length of 21.02 feet and a chord
which bears North 18°42'52" West 38.75 feet; thence North
04°03'32" East 300.09 feet along the east line of the proposed
extension of South 52" d Street, to a point of curve; thence along an
835.00 foot radius curve to the left, through a central angle of
14°19'24", having an arc length of 208.74 feet and a chord which
bears North 03°06'10" West 208.20 feet thence North 10°15'52"
West 149.49 feet, continuing along said street extension, to the
south line of a 1.720 acre tract, as described in Deed Record Book
462, Page 42; thence North 79"43'27" East 318.00 feet, to the
southeast corner of said 1.720 acre tract; thence North 40°37'09"
West 318.66 feet, to the northeast corner of said 1.720 acre tract;
thence South 79°42'25" West 191.95 feet, to the northwest corner
of said 1.720 acre tract, in South 52" d Street; thence North
10° 15' 52" West 299.67 feet, in South 52" d Street, to the centerline
of Old National Road; thence South 74°18'25" East 318.86 feet
along said centerline; thence South 73°59'00" East 816.12 feet
along said centerline, to the northwest corner of a 0.947 acre tract,
as described in Deed Record Book 480, Page 306; thence South
16°08'55" West 184.79 feet, to the southwest corner of said 0.947
acre tract, also being the northwest corner of a 2.337 acre tract, as
described in Instrument 1998017172; thence South 00°48'09"
West 446.46 feet, to the southwest corner of said 2.337 acre tract;
thence South 82°03'47" East 240.01 feet, to the southeast corner of
said 2.337 acre tract, also being on the east line of said 61.464 acre
tract; thence South 00°48' 1 F West 795.93 feet, to the southeast
corner of said 61.464 acre tract; thence North 89°59'49" West
1101.52 feet along the south line of said 61.464 acre tract, to the
point of beginning, containing 36.009 acres, more or less, as shown
on Drawing No. D-1742, dated 21 April 2009, being subject to the
right-of-ways of South 52" d Street and Old National Road and to
all legal easements of record.
as an M-1 Light Industrial District as outlined on Exhibit A; and
Whereas, it is desirable to change the above described real estate's zoning designation to C-
4 General Business District in order to allow the owner to use said real estate to
develop the tract as commercial property.
NOW THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the zoning designation for the above described property is changed to C-4.
Passed and Adopted this 6th day of _Jules , 2009, by the Common Council
of the City of Richmond, Indiana.
