HomeMy Public PortalAbout001-2006 - Annexation - Ramsey DevORDINANCE NO. 1-2006 ORDINANCE ANNEXING CERTAIN CONTIGUOUS LANDS INTO THE CITY OF RICHMOND WHEREAS, the boundary of the City of Richmond, Indiana is contiguous to the real estate described herein, and WHEREAS, on December 28, 2005, a Petition For Annexation Into The City of Richmond, Indiana was filed by the owner of said real estate requesting annexation of the area pursuant to Indiana Code § 36-4-3-5.1. NOW THEREFORE, BE IT HEREBY ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOND, WAYNE COUNTY, INDIANA, That: Section 1. The following described real estate be, and the same is, hereby annexed to and declared a part of the City of Richmond, Wayne County, Indiana, to -wit A part of the West Half of the Northwest Quarter of Section Ten (10), Township Thirteen (13), Range One (1) West, bounded and described as follows, to -wit: Beginning at a point in the west section line six hundred eighty-two *682) feet north of the southwest corner of said quarter, being the south boulder post at the northwest corner of Charles Muhl's land; thence north six hundred thirty-eight (638) feet, more or less, to the northwest corner of the south half of said quarter section; thence east eighty (80) rods to the center corner of said quarter section; thence south twelve (12) rods to Ottie M. Murray's north line; thence west on said north line one hundred sixty-five (165) feet; thence south twenty-nine (29) rods to William James Chapman's north line; thence west eight hundred twelve (812) feet and six (6) inches to Charles Muhl's east line; thence north twenty-two (22) feet to said Muhl's northeast corner; thence west three hundred forty-two (342) feet six (6) inches to the place of beginning, containing seventeen (17) acres, more or less. ALSO: The Northwest Quarter of the Northwest Quarter of Section Ten (10), Township Thirteen (13), Range One (1) West, AND ALSO: Two (2) rods in width of the north side of the Southwest Quarter of the Northwest Quarter of Section Ten (10), Township Thirteen (13), Range One (1) West, containing approximately 42.276 acres, more or less. EXCEPT: Situated in the Northwest Quarter of Section Ten (10), Township Thirteen (13) North, Range One (01) West, Wayne County, Indiana, including part of a 17 acre tract, and part of a 42.276 acre tract, both described in Deed Records Volume 436, Page 124, in the Office of the Wayne County Recorder, and being more particularly described as follows: Commencing at an iron pin found at the southwest corner of said Northwest Quarter, in the intersection of South 23rd and Wernle Road; thence North 00024'50" West 682.00 feet along the west line of said quarter, in South 23rd Street, to a railroad spike found at the southwest corner of said 17 acre tract, said spike being the TRUE POINT OF BEGINNING for the tract herein described; thence continuing North 00024'50" West 369.94 feet along the west ling of said quarter, in South 23rd Street, to a railroad spike set; thence North 89035'10" East 263.00 feet along a new division line, to an iron pin set; thence South 88025'06" East 353.60 feet along a new division line, to an iron pin set; thence North 62013'31" East 139.42 feet along a new division line, to an iron point set; thence North 05041'14" East 439.21 feet along a new division line, to a point; thence North 11048'03"East 154.79 feet along a new division line, to a point; thence North 21 °08'45" East 520.00 feet along a new division line, to a point; thence North 1301221" West 270.00 feet along a new division line, to a point; thence North 00012'13" West 180.00 feet along a new division line, to a point, thence North 89031'04" East 390.00 feet along the south line of South "L" Street, to an iron pin found; thence South 00012'13" East 1480.61 feet along the east lines of said 42.276 acre tract, and said 17 acre tract, to an iron pin found; thence South 89029'51" West 164.83 feet along an east line of said 17 acre tract, to an iron pin found; thence South 00015'47" East 482.25 feet along an east line of said 17 acre tract, also being the west line of a 20.87 acre tract described in Instrument Number 1996010968, and the west line of a 16.095 acre tract described in Deed Records Volume 479, Page 848, to an iron pin set; thence South 89049'01" West 827.93 feet along a south line of said 17 acre tract, also being the north line of a 2.40 acre tract, and a tract with no acreage described in Deed Records Volume 439, Page 250, and the north line of a 4.97 acre tract described in Deed Records Volume 397, page 362, to an iron pipe found; thence North 00031'20" East 22.00 feet along a south line of said 17 acre tract, also being an east line of a tract described in Deed Records 301, page 391, to an iron pin set; thence South 89041'54" West 342.50 feet along a south line of a said 17 acre tract, also being the north line of said tract described in Deed Records Volume 301, page 391, to the point of beginning, containing 26.892 acres, more or less, being subject to the legal right-of-way of the public road and any legal easements of record. Bearings for the above description are based upon the State Plane Coordinate System. Iron pins set in the above description are 5/8 inch by 30" reinforcing rods, with aluminum caps stamped "Kramer, Eaton, Richmond." Surveyed and prepared by Douglas E. Kramer, Registered Surveyor #20143 on September 5, 1997, as shown on Drawing D-1033 by Kramer & Associates, Eaton, Ohio and Richmond, Indiana. ALSO EXCEPT: Situated in the Northwest Quarter of Section Ten (10), Township Thirteen (13) North, Range One (01) West, Wayne Township, Wayne County, Indiana, being part of a 26.892 acre tract described in Instrument Number 1998016963, in the Office of the Wayne County Recorder, and being more particularly described as follows: Commencing at an iron pin found at the southwest corner of said Northwest Quarter; Thence North 00024'50" West 682.00 feet along the west line of said quarter, in South 23rd Street, to a railroad spike found at the TRUE POINT OF BEGINNING for the tract herein described; Thence North 00024'50" West 369.94 feet along the west line of said quarter, to a railroad spike set, witness an iron pin set North 88033'45" East 30.00 feet; Thence North 88033'45" East 1171.35 along a new division line, to an iron pin set; Thence South 00015'48" Eat 416.87 feet along an east line of said 26.892 acre tract, to an iron pin set; Thence South 89049'01" West 827.93 feet along a south line of said 26.892 acre tract, to an iron pipe found; Thence North 00031'20" East 22.00 feet along a south line of said 26.892 acre tract, to an iron pin set; Thence South 89041'54"West 342.50 feet along a south line of said 26.892 acre tract, to the point of beginning, containing 10.688 acres, more or less, being subject to the right of way of the public road and any legal easements of record. The above -described real estate shall be assigned to City Council District 2, subject to any later reapportionment, as required by statute. Section 2. Be it further ordained that the boundaries of the City of Richmond, Indiana shall be and the same hereby are, declared extended to include all of the real estate herein above described as part of the City of Richmond, Wayne County, Indiana. Section 3. This ordinance shall be in full force and effect from and after its passage by the Common Council and its approval by the Mayor of the City of Richmond, Indiana and publication in accordance with the law.
