RESOLUTION APPROVING CHANGE ORDER NO. 1-SUSPECT AREAS
SEWER SEPARATION AND IMPROVEMENTS CONTRACT

WHEREAS, ou July 19, 2001, the Governing Body of the Borough of Carteret passed
Resolution No. 01-241 awarding a contract to Star of the Sea Concrete Corp. in the
amount of $339,950.00 for the Carterct Suspect Areas Sewer Separation and
Improvements Contract; and
WHEREAS, the Borough's consulting engineer for the project, T&M Associates, has
advised the Governing Body that a modification to said contract is needed as a result of
conditions which were unforeseen at the time of the award of said contract, namely the
discovery of large amounts of unsuitable backfill material being removed from most of
the sewer line trenches and the discovery that a sanitary sewer does not exist on a portion
of Columbus Avenue where the plans require the connection of two sewer laterals; and
WHEREAS, due to said unforeseen field conditions, T&M Associates has recommended
that the above referenced contract be modified in accordance with Change Order #1 (see
attached letter); and
WHEREAS, Change Order #I includes an increase in the cost of the contract due to an
increase in the bankrnn sand and gravel backfill quantity contract due to the total
projected to be required (2,750 CY), an increase in PVC pipe quantities, and the
additional installation of 245LF of 8" PVC sanitary sewer on Columbus Avenue in the
total amount of $56,130.00; and
WHEREAS, the Borough's Chief Financial Officer has certified that funds are available
for the payment of the contract amount inclusive of Change Order #1.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey as follows:
(1) Contract Change Order #1 in the amount of $56,130.00 and the payment of
the revised contract price for the Suspect Areas Sewer Separation and
Improvements Contract including said Change Order in the total amount of
$456,080.00 is hereby approved;
(2) That the appropriate officials authorized and directed to execute Change
Order #1.
