Before you consider this matter closed I respectfully request you send me your response. I also ask to inspect the public record of any electronic data that would confirm transmission of your response on January 8 by email. When I asked Lt. Allen about Chief Ward's absence earlier this year Lt. Allen explained to me that Chief Ward was on sick leave but provided me with no details of his condition or when he would return. I did not know how serious that condition was until reading about it in your email today. I wish Chief Ward a speedy recovery and if you or any anyone in your office has an opportunity to speak with him or his family I ask that you convey to them my sincerest wishes for his return to health. You write in your email, "If there is another route you would like me to take regarding this request, please advise." I cannot think of any route except those provided in Florida Statute Chapter 119. Am I correct to assume that Lt. Allen has stepped into the role of Gulf Stream Police Chief during the temporary absence of Chief Ward? Have you asked Lt. Allen if he has any records responsive to my request? May I hear from you soon? By way of example, see your latest response which I forwarded herein for your reference. Regardless of the time, the circumstances, the simplicity of the request or any other variable condition that is unique to the request or unique to the time you receive the request, you many times respond as follows: The Town of Gulf Stream is currently working on a large number of incoming public records requests. The Town will use its very best efforts to respond to you in a reasonable amount of time with the appropriate response or an estimated cost to respond. Given the unique circumstances surrounding each request, the actual number of requests that you consider to be a "large number" must vary from request to request. Since the length of time you consider to be "a reasonable amount of time" may be a function of the specific number of requests you are working on at the time each new request is received, your statement that you will respond in a reasonable amount of time is not very informative as to when you will actually respond. I consider it a mandatory regulation of Florida Statute 119.07(1)(a) that you shall permit the record to be inspected and copied by any person desiring to do so, at any reasonable time, under reasonable conditions. Your "boiler plate" standardized response is not a reasonable condition. Your "boiler plate" standardized response is not responsive to my request and, if not deliberately misleading, at best it is fuliginous, unclear, and ambiguous. Please consider this email to be yet another attempt by me to inspect this record as per Article 1, Section 24 of the Florida Constitution and Chapter 119 of the Florida Statutes.
