April 18, 1978 HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL SUBJECT: ZANE CHANGE APPEAL - 10965 WRIGHT ROAD Gentlemen: � On March 14. 1978 the Planning Commission for the City of Lynwood denied a change of zone from R-3 (Multiple Family Residential) to �M (Manufacturing). zone for Mr. Carl Brandon, owner of the property. Mr. Brandon's reasoning for the zone change is that he feels it would enhance property values in the area and would be in conformance with the General Plan. Staff differs with Mr. Brandon's opinion in that the change does not conform to the City's General Plan and that the .surrounding land use is entirely multi-family residential which is highly incompatible with M uses unless a buffer or greenbelt is provided. The General Plan calls for this area to ultimately be zoned R-2 (Townhouse and Cluster housing). There is currently a amall, single-family residence located at the southeast fringe of the lot. Recommendation � ' Staff recommends that the zone change again be denied Mr. Carl Brandon� to change the zoning on Lots 5 and 6, Tract 10634; commonly known as 10965 Wright Road, from R-3 to M. In addition, under Section 19-134 an annua � enewal fee of $2.00 is charged. This has recently been reviewed by staf�� in view of the proposed overnigl�t parking ordinance and it is recommended that it would be appropriate to increase the fees fc�r overnight parking permits. In order for these'fees to be increas�ed a change in the existing ordinance would be required. The City Council of the City of Lynwood hereby does ordain as follows: SECTION 1 Section 19-129 of the Code of the City of t Lynwood hereby is amended to read as follows: Section 19-129 Fee for Original Application. The applicant filing an original application shall accompany the application with an investigation fee.of $10.00, which shall be paid to the City Clerk. SECTION 2 Section 19-134 of the Code of the City of Lynwood hereby is amended to read as follows: Section 19-134 Renewal of Certificate If, at.the expiration of the term provided for in the certificate of ne"cessity, irrespective of whether the certificate was issued under an original or subsequent application; the holder of the certificate is desirous of renewing his certificate, the . same procedure shall be followed as provided in this div'ision for an original certificate, except that the investigation fee shall be $5.00. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY UF LYNWOOD ADDING SECTION 19-22 TO AMENDItdG SECTIONS 19-127, 19-128, 19-131, 19-132, 19-133, AND 19-134 OF, AND REPEALING SECTION 19-136 OF THE CODE OF THE CITY OF LYNLYOOD RELATING TO CERTAIN PARKING PROHIBITIONS. The City Council of the City of Lynwood hereby does ordain as follows: SECTION 1. Section 19-122 hereby is added to the Code of 'the City of Lynwood to read as follows: ' Section 19-122 Parking Prohibitions for the Purpose of Street Sweeping " When signs are erected giving notice thereof, no person shall stand or park a vehicle upon any bf the streets or parts thereof as prescribed by resolution of the City Council during the period of time as prescribed by resolution of the said City Council. SECTION 2. Sections 19-127, 19-128, 19-131, 19-132, 19-133, and 19-134 of the code of the City of Lynwood hereby are ainended to read as follows: Section 19-127 Required No person shall stand or park a vehicle on any street, except as exempted in certain zoned business and commercial areas, as prescribed by resolution of the City Council of said City, between the hours of 2 a.m> and 6 a.m. of any day except in accordance with a certificate of necessity issued by the City Clerk as provided in this Division. Section 19-128 Application generally (a) Any occupant of a dwelling located in the City who, for reasons of hardship or necessity believes that there should be issued to him a certificate of necessity pursuant to this division which would "give him an all-night parking privilege may file an application for a certificate of necessity for each motor vehicle to which he desires a certificate of necessity to apply. � (b) The application provided for by subsection (a) shall meet•the following requirements: ° ' (1) It shall be in writing on a form furnished by the City Clerk. (2) It shall set forth: a. The name and address of the applicant; b. The name and address of the owner of the real property where the applicant resides, or agent of the owner, if the property is being managed by an agent. � � c. The number of separate dwellings on a particular lot or parcel of land affected by the application; d. The number of vehicles insofar as known by the applicant, possessed by the occupants of the lot or parcel of land; e. The license number and motor number or serial number of the vehicle or vehicles to which applicant desires the certificate of necessity to . aPP1Y; e f. The make,.model and type of each vehicle to which the applicant desires the certificate of necessity to apply; g. The necessity for the certificate requested; and, ho Such other pertinent information as the City Clerk shall require. Section 19-131 Permanent file or original application and investigation findings.. The City Clerk shall cause a permanent file to be made of all original applications and all of the investigative written data made•and compiled in connection with each investigation, with the intent and purpose that the file and the information therein contained shall constitute the foundation for t'He-processing of'all subsequent applications affecting the same lot or parcel of land described in the original application. No. 700 Sec. 153; Code 1961, Sec. 22.101) Section 19-132 Issuance of certificate; duration• no refund of investigative fee izpori denial of certificate. - If, after an investigation as provided for in this division, the Chief of Police determines that there is not adequate off-street parking space reasonably obtainable by the applicant at the place of his residence or within six hundred (600) feet thereof for the parking of the vehicle described in the application, a certificate of necessity shali be granted to the applicant and to-which the Chief of Police, : in his discretion determines that the certificate"s of necessity should apply. The certificate of necessity shall be for a term from July 1, � of any calendar year through June 30 of the immediate subsequent year, , or any portion thereof, except those applications made within a 60 day period immediately preceding June 30 of any year shall have effect for a certificate of necessity for the term through June 30 of the immediate subsequent year, unless terminated as provided in this division. Should the certificate of necessity be denied, the investi- gative fee shall not be refunded. Section 19-133 Attachment of Certificate to Vehicle � A decal furnished by the City Clerk pursuant to this division ' shall be permanently attached to the left rear portion of each vehicle to which the Chief of Police has, in writing, made the certifi- cate applicab],e as provided in this division. No. 700, Sec. 143; Code 1961, Sec. 22.107 ' , i � � � Section 19-134 Renewal of Certificate (a) If, at the expiration of the term provided for in the certificate of necessity, irrespective of whether the certificate was issued under an original or subsequent application; the holder of the certificate is desirous of renewing his certificate, the same procedure shall be followed as provided to this division for an original certificate. (b) For each subsequent application filed, a fee of five dollars ($5.00) shall accompany the application and shall be paid to the City Clerk. Should the certificate of necessity be denied, ' the fee of five dollars ($5.00) shall not be refunded. SECTION 3. Section 19-136 of the Code of the City of Lynwood hereby is repealedo SECTION 4 Severability In any section, subsection, subdivision, sentence, phrase or portion of this ordinance, or the application there any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such.decision shall not affect the validity of remaining portions of this ordinance or its application to persons or places. In addition, under Seotiori 19-134 an annual renewal fee of $2.00 is charged. This has recently been reviewed by staff in view of the proposed overnight parkirig ordiriance and it is recommended that it would be appropriate to increase the fees for overnight parking permits. In order Por these fees to be increased a change in the existing ordinanoe would be required. AB 3296 was introduced this week at the request of .the League by Assemblywoman Caro1 Hallett.to restore the ability of cities and counties 'to establish local sick leave policies for employees retired for disability. This legislation, in recognizing the legitimate need for local governments to establish their own sick leave policies, will both strengthen the concept of home rule and enable local governments to realize cost savings on behalf ,of their local taxpayers. Until recently local employees who were retired for disability were entitled to such accumulated sick leave rights as was provided by the rules of the city or county by which they were employed. Then, in an appellate'decision, the so-ralled "Marsille" cause, the California courts held that, as a matter oE state law, such employees were entitled'to"all sick leave benefits accrued, regardless of the local rules. AB 3296 simply makes this particular determination once again subject to, local rules rather than state law. '� � BINUING ARBITR'ATION i � � AB 2659 would mandate compulsory and binding arbitration of � negotiation impasses reached:with police or fire employees. The public reaction at the. polls in recent years to the continuing benefit requests of public safety services; the public demand for � severe tightening of public budgets; and the continuing success '� at the bargaining table of firefighter and law enforcement repre- j sentatives have in no way impeded the legislative efforts of th.ese � safety services to make collective negotiation a one-way street on top of guaranteed no-cut contracts. This measure would correct an existing ad- ministrative problem within the.Department of Motor Vehicles whereby cities and counties lose approximately $30 million per year in motor vehicle in lieu tax receipts which should come to local � agencies. Under the existing accounting system, the Department � of Motor Vehicles is assuming that the administrative costs for opexating'this program and collecting these fees for local govern- ment is about $l0 million more than the actual costs of such collection and disbursement. � � State-Local Public Wo�rks Agreement Act Again �Proposed AEter Governor Fails to Act SR 2010 - last year, the League sponsored SB 920 which would have provided a mechanism, based on the one presently provided for freeway agreements, by which local govern- ments would have been furnished a mechanism for reviewing and commenting on state public works'projects proposed within their j,urisdiction.
