� parking,spaces. The proposed plans does not call for any
i landscaping. This item was continued from Planning
Commission Meeting of March 10, 1992 at applicant request.

� ANALYSIS AND CONCLUSION:
1. Consistency with Ge�eral Plan
The project is consistent with the existing zoning
classification of C-3 (Heavy Commercial) . However, the
proposed project does not support the General Plan Land Use
Policy calling for, in part, ��...the needed separation of
incompatible land uses." Therefore, granting Conditional
Use Permit No. 106 will adversely affect the General Plan.
2. Site Suitabilitv
See No. 4 Compliance With Development Standard.
3. Comoatibility
The project is surrounded by a mixture of commercial
developments and established uses; and, is in close
proximity to other uses selling alcoholic beverage; thus,
not able to meat distant requirements for such uses.
Therefore, tha project will be incompatible with the
surrounding land uses.
4. Comoliance with Develooment Standards �
The location of the site is not in accordance with distance �
requirements as established by the City's Liquor Ordinance I
(1306), Section 25-16.40, On-Sale Liquor Establishments. I
5. Conditions of Approval ;

The project as proposed, will have a negative effect on the !
values of the surrounding properties and interfere with or
endanger the public health, safety or welfare. �
6. Benefits to Communitv

The proposal will not assist in upgrading the commercial use �
of the property and support the Commercial designation of �

The applicant is requesting a Conditional Use Permit to establish

3840 E. Martin Luther King Jr. Boulevard in the C-2 (Light

Facts

The subject property is located at the intersection of
Martin Luther King Jr. Boulevard and Ernestine Avenue,
southwest corner.
3. Property Size
The subject site is regular in shape, and approximately
64,000 square in size (400'x160').
4. Existina Land Use �
The existing restaurant, 4500 square feet in size, is I
located in a 33,000 square foot building, formerly the f
Century Discount Department Store. The site also contains a I
parking area on its west side. The surrounding land uses •�
are as follows:

will offer alcoholic beverages only with food during lunch �
and dinner. The operating hours of the restaurant are 8:00

' altered with tenant improvements and exterior upgrading. The
. subject site has a total of 160 parking spaces with
approximately five (5�) percent landscaping.
7. Citv Council Review •
At its regular meeting on February 4, 1992, the City Council
reviewed and recommended approval of the applicant's
request for beer and wine sales as a part of a plan to
convert an existinq restaurant into a full service
restaurant. The item was forwarded to the Planning
Commission with a recommendation of approval for the
requested Conditional Use Permit Application.

ANALYSIS AND CONCLUSION:'
1. Consistencv with General Plan
The proposed land use is consistent with the existing zoning
classification of C-2 (Light Commercial) and the General
Plan designation of Commercial, therefore, granting
Conditional Use Permit No. 111, will not adversely affect
the General Plan. Furthermore, the proposal is consistent
with Ordinance 1306 in reference to a bona fide restaurant
engaging in the sale and on-site consumption of liquor.

The property is adequate in size and shape to accommodate ,
the proposed development relative to structures, parking, �
walls, fences, landscaping, driveways and other development !
features required by the 2oning Ordinance. ;

Martin Luther King Jr. Boulevard is a major arterial and is
well suited to carry the quantity of traffic the proposed �
development would generate. '
3. Compatibilitv �
The proposed development is surrounded by a mixture of `
commercial developments, public facilities, and residential �
uses. The community will benefit with the addition of a
full service restaurant. The restaurant owner believes that �
the viability of the restaurant depends upon including beer �
and wine in the menu to establish a full service restaurant.

The City is contemplating a reevaluation of the land use and ;
development within the Civic Center. The applicant is j
proposing to redevelop the facility in accordance with an '
overall scheme which is being formulated in cooperation with �

Civic Center and the boundaries of Redevelopment Project �

The proposal for a full service restaurant is a key element �
in the overall redevelopment of the area. The proposal will
be part of a Planned Commercial Development that may be
proposed for the Civic Center. �

4. ComDliance with Develooment Standards
' The proposal conforms to the development standards required
by the Zoning Ordinance with respect to setbacks; lot
coverage; building heights; parking; and with the distance
requirements as established by the City's Liquor Ordinance
(1306) Section 25-16.40 On-Sale Liquor Establishment for
bona fide restaurants and veterans clubs. The Ordinance
states that Bona fide restaurants are exempted from.having
to meet the distance requirements of other liquor
establishments as well as residential uses. (See attached
Liquor Ordinance).
The proposal carries out a number of goals from some of the
Elements of the General Plan. They are as follows:
City Concept Goal 1: The potential of creating and
establishing a high quality of life for City residents.
aoal 2: Provides for the strengthening and expanding
of existing Lynwood businesses under the Economic
Development Element of the General Plan.
Land IIse Goal 5: The encouragement of the development
of new commercial and retail uses in locations where they
can most efficiently provide Lynwood residents with needed
products, services, and employment opportunities.
In addition the project may be incorporated into an overall
plan for the area as part of a Planned Commercial District
(PCD) pursuant to Section 25-34 of the Lynwood code.
5. Conditions of Approval
The improvements as proposed, subject to the conditions
recommended by the Community Development Department, will
, not have a negative effect on the values of the surrounding l
properties or interfere with or endanger the public health, I
safety or welfare.
6. Benefits to Communitv �

The proposal will facilitate upgrading the commercial use j
of the property and support the commercial designation of �
the General Plan. �
7. Environmental Assessment

The Community Development Department has determined that the i
project could not have a significant effect on the
environment. Therefore, a Notice of Exemption has been �
prepared and is on file in the Community Development '
Department office and in the office of the City Clerk. �

Commission adopt the attached Resolution No. 2428. '

LYNWOOD AMENDING THE LYNWOOD MUNICIPAL CODE BY
PROVIDING CITY-WIDE REGULATIONS OF
' ESTABLISHMENTS SELLING ALCOHOLIC BEVERAGES FOR
ON-SITE AND OFF-SITE CONSUMPTION.
THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, I
RESOLVE, AND DETERMINE AS FOLLOWS: '

SECTION 1. The_City Council hereby finds and determines that

SECTION 2. Section 25-16.20 pertaining to on-sale liquor
establishments shall be deleted in its entirety. ,

No on-sale liquor establishments shall be main- !
tained within five-hundred feet (500') of any !
other establishment wherein alcoholic beveraqes
are sold, for on-site and/or off-site ;
consumption, or from any residential use or from

such consideratioa points as schools (public and
private); established churches or other place
of worship; hospitals, clinics, or other health
care facilities; public parks and paygrounds
and other similar uses, except that veterans
clubs and bona fide restaurants may be closer
than five-hundred feet (500') from one another
or less than 150 feet from any of the referened
consideration points. All distances shall be
measured between the nearest entrances used by
patrons of such establishments along the
shortest route intended and available for public
passage to other such establishments, or to the I
nearest property line of any of the above- �
referenced consideration points. '

1) A masonry wall of six feet (6') in height �
shall be constructed around the parking area �
of such establishments when said area is i
adjacent to properties zoned or used for �
residential purposes:
2) The noise levels generated by the operation I
of such establishment shall not exceed 60 �
dBA on adjoining properties zoned or used ;
for residential purposes; �
3) Exterior lighting of the parking area shall �
be kept at an intensity of between one (1) ��
� and two (2) foot candles, so as to provide
adequate lighting for patrons while not ,
disturbing surroundinq residential or '
commercial areas. '
4) A minimum of fifty-one percent (51$) of . �
restaurants gross receipts shall be from i
food sales. The owner/operator shall submit
� evidence of total food sales to the
Accounting Department of the City of +
Lynwood, one year after approval of the j
Conditional Use Permit by the Planning
Commission.
25-16.50 Off-sale Liquor Establishments �
No off-sale liquor establishment shall be �
maintained within five'hundred feet (500') of
any other establishment wherein alcoholic
beverages are sold for both off-site and on- ;
site consumption or such consideration points �
as schools (public and private), established
churches or other places of worship, '
hospitals, convalescent homes, public parks,
and playgrounds and/or other similar uses.
The distance of five hundred feet (500') shall �
be measured between the nearest entrances used
by patrons of such establishments along the �
shortest route to other establishments, or to I
the nearest property line of any of the above
referenced consideration points.

or store motor fuels on the same premises as .

1. No beer or wine shall be displayed within �
five (5) feet of the cash register or the ,

2. No advertisement of alcoholic beverages
shall be displayed at motor fuel islands. �
3. No sale of alcoholic beverages shall be made
from a drive-in window. '
4. No display or sale of beer or wine shall be !

5. No beer or wine advertising shall be located
on motor fuel islands and no self-
illuminated advertising for beer or wine �
shall be located on buildin9s or windows.
6. Employees on duty between the hours of 10:00 �
p.m. and 2:00 a.m. shall be at least 21
years of age to sell beer and wine. ,
25-16.60 Existina Establishments Sellina Alcoholic '
Beverages
Existing establishments which sell alcoholic �
beverages may not be continued or re-
established without conditional use approval
granted in accordance with the provisions of '
this ordinance, if any of the following occur '
after the effective date of this ordinance: ;
1) The establishment changes its type of I
liquor license within a license '
classification; or
2) There is a substancial change in the mode �
or character of operation of the �
establishment; or ,
3) The establishment is abandoned or has !
discontinued operation for three (3) months. �
The burden of proof shall be upon the applicant �
to determine when said establishment was in I
operation.
25-16.70 Non-transferabilitv of Licenses �
No license issued pursuant to this ordinance �
shall be transferable.

SECTION 4. Chapter 25-16.17 of the Lynwood Municipal Code .
pertaining to Service Stations is hereby deleted in its entirety:
"25-16.17 Motor-Fuel Providers and Service Station
Standards."

SECTION 5. Section 25-8.1 of Chapter 25, the Zoning Ordinance,

"50. Restaurant, tearoom, cafe, cocktail bars, provided that
the requirements of Section 25-16.20 through Section 25- �
16.70 are met." ��

SECTION 7. Severability. If any section, subsection,
subdivision, sentence, clause, phrase, or portion of this '

any court or competent jurisdiction, such de�ision shall not affect I
the validity of the remaininq portions of this ordinance or its
application to other persons or places. The City Council hereby �
declares that it would have adopted this ordinance, and each

pursuant to law, held a public hearing on subject application; and '

WHEREAS, the Commission has carefully considered all pertinent '

WHEREAS, the Community Development Director has determined that II
the proposal is exempt from the provisions of the State CEQA �
Guidelines, Section 15061 b(3) as amended; and �

that the subject site is designated "Commercial" on the General Plan �

regulations of the Lynwood Municipal code, the Uniform Building
Code and the Uniform Fire Code.
2. Any proposed subsequent modification of the subject site or
structures thereon, shall be first reported to the Community
Development Department, Planning Division, for review. �
3. The applicant, or his representative, shall sign a Statement of
Acceptance stating that he/she has read, understands, and
agrees to the conditions stated herein before any building �
permits are issued. �

Use Permit approval is required by the Planning Commission. ;

11. This permit shall become void in one hundred twenty (120) days, '
unless extended, after the use permitted has been abandoned or
has ceased to be actively exercised.
12. Where vehicles are to be parked immediately adjacent to a '
public or private street or alley, a decorative masonry wall �
(maximum of thirty-six inches in height measured from the
finished surface of the parking area) or bermed, shrub and j
groundcover shall be provided. If a wall is provided, there
must be minimum landscaping to screen wall from street view and
accessibility.
13. Pursuant to the City's code and the attached Site Plan, each
off-street parking space shall not be less than twenty (20) '
feet in length and nine (9) feet in width, exclusive of access
driveways or aisles, except as noted below: �
a. Any standard parking space that is immediately adjacent to �
a wall, structural column, light standards, o� similar �
obstruction on one or both of its longer sides or in an
enclosed space shall be at least ten (10') feet in width
and twenty (20') feet in length.

b. Two parking spaces designed for the handicapped shall
• be provided. These spaces may be provided as follows:
a. Dimensions. The minimum dimensions of each
automobile parkinq stall for the handicapped shall be
not less than fourteen (14) feet in width by'eighteen

provide a nine (9) foot parking area and a five (5)
foot loading and unloadinq area or;
b. Two (2) spaces may be provided within a twenty-three

ANALYSZS AND CONCLUSION:
� 1. Consistency with General Plan
The proposed land use is consistent with the existing zoning
, classification (C-2A) Medium Commercial and General Plan
designation of Commercial. Therefore, granting Conditional
Use Permit No. 112 will not adversely affect the General
Plan.
2. Site Suitabilitv
- The property is adequate in size and shape to accommodate the
proposed development relative to structures, parking, walls,
fences, landscaping, driveways and other development features
required by the Zoning Ordinance.
3. Compatibility
The proposed development is surrounded by a mixture of
commercial developments; therefore, the project will be
` compatible with the surroundinq land uses. However,
residential uses are to the north of the proposed use.
4. Comnliance with Develooment Standards
The proposal meets the development standards required by the
Zoning Ordinance with respect to setbacks; lot coverage;
building height and density. However, Ordinance No. 1367,
adopted on December 17, 2991, places a Moratorium on all
automotive related land use.
5. Benefits to Communitv
- The proposal.will not assist in upgradinq the commercial use
- of the property and support the Commercial intent of the
� General Plan, given the imposed Moratorium.

The applicant proposes to develop a triplex with six (6) (2
°'• car garages per unit). The first floor shall consist of

laundry area. The second floor include two (2) bedroom and
" a full bath. Approximately twenty-five (25�) percent of, the
site is designated for landscaping.
Staff reviewed and recommended the revisions shown on the "
attached site plan. Staff recommended a stepped two-story
town house design with attached garage.

On April 1, 1992, the Site Plan Review Committee evaluated
the proposed development and recommended approval to the
Planning Commission, subject to specific conditions and
requirements.

ISSUES AND ANALYSIS
1. Consistency with General Plan
The proposed land use is "consistent with the existing
zoning classification (R-2) and the General Plan
designation Town Aouse and Cluster Housing. Therefore,
granting Conditional Use Permit No. 113, will not adversely
affect the General Plan.
2. Site Suitabilitv
The subject property is.adequate in size and shape to
accommodate the proposed development relative to the
• proposed density; bulk of the structures; parking; walls,
fences; driveways, and other development features required
by the Zoning Ordinance. Furthermore, the subject property
is adequately served with the required public utilities and
� offers adequate vehicular and pedestrian accessibility.
3. Comnliance with Develooment Standards
The proposed development meets all the development standards
required by the Zoning Ordinance regarding off-street
parking; front, and rear yard setbacks; lot coverage,
height, unit size; and density.
4. Comoatibilitv
. The proposed project will be located in a neighborhood that
is substantially transitioned from single-family to two-
family residences. The Century Freeway (I-105) is_to the
North of the property. Properties located to the south,
east, and west are developed as single family residential
respectively.

The improvements proposed, subject to the conditions
recommended by the Site Plan Review Committee, will'not have

The Community Development Department Staff has determined
that the project is categorically exempt pursuant to Section
15061 B(3) of the State of California Environmental
Quality Act of 19s9 as amended.
RECOMMENDATION•
Staff respectfully requests that after consideration, the
Planning Commission adopts the attached Resolution No. 2431:
1. Certifying that the project is categorically exempt
from the provision of the State CEQA Guidelines as
amended by Section 15061 b(3)

, A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF LYNWOOD APPROVING CONDITIONAL USE
PERMIT NO. 113 FOR THE CONSTRUCTION OF A
TRIPLEX AT 11�31 SECOND AVENUE IN THE R-2
(.TWO-FAMILY RESIDENTIAL) ZONE, LYNWOOD,
CALxFORNIA.
WHEREAS, the Lynwood Planning Commission, pursuant to law,
conducted a public hearing on the subject application; and
WHEREAS, the Planning Commission, considered all pertinent
testimony offered at the public hearing; and
WHEREAS, the Community Development Director has determined
that the proposal. is exempt from the provisions of the State CEqA
Guidelines Section 15061 b(3), as amended; and
WHEREAS, a Conditional Use Permit is required for
development in the R-2 (Two-Family Residential) zone.
Section 1. The Rlanning Commission hereby finds and
determines as follows:
A. The site of the proposed use is adequate in size and
shape to accommodate the structures, parking, walls,
landscaping, driveways and other development features
required by the Official Zoning Ordinance.
B. The structures, as proposed, subject to conditions,
will not have a negative effect on the values of
surrounding properties or interfer with or endanger the
public, health, safety, or welfare.
C. The site will be developed pursuant to the current
zoning regulations and site plan submitted and approved
by the Site Plan Review Committee.
D. The grantinq of the Conditional Use Permit will not
adversely affect the General Plan.
E. The proposed development will add favorably to the
housing stock and will provide additional affordable
priced housing in concert with the policies of the
Housing Element of the General Plan.
F. The proposed development will aesthetically upgrading
the area and will act as a catalyst in fostering other
quality developments.
Section 2. The Planning Commission of the City of Lynwood,
based upon the aforementioned findings and determinations, hereby
approves Conditional Use Permit, Case No. 113, provided the
following conditions are observed and complied with at all times.
COMMUNITY DEVELOPMENT DEPARTMENT
1. The proposed development shall comply with all applicable
regulations of the Lynwood Municipal Code, the Uniform
Building Code and the Fire Code and be in substantial
compliance with plans on file with the Community Development
Department.
2. Any proposed subsequent modification of the subject site or
structures thereon, shall be first reported to the Coaununity
Development Department, Planning Division, for review of
said Conditional Use Permit.

, 3. The applicant shall meet the requirements of all other City
Departments.
4. The applicant and/or his representative shall sign a
Statement of Acceptance stating that he/she has read,
understands, and agrees to all conditions of this resolution
prior to issuance of any building permits.
PLANNING DIVISION CONDITZONS
5. The applicant shall contact the U.S. Post Office (Lynwood
main office) to establish the location of mail boxes servinq
the proposed development.
6. This Conditional Use Permit shall lapse and become void one
hundred and.twenty (120) days after the use permitted has
been abandoned or has ceased to be actively exercised.
7. Construction shall commence within ,(6) months from date
of issuance of building permits.
8. Landscaped areas are to be a minimum of twenty-five (25�)
percent of the lot area.
9. Landscaping and irrigation sha'll be installed in accordance
with a detailed plan to be submitted and approved by the
Planning Division prior to issuance of any building permits.
The minimum plant material sha11 be trees and shrubs
combined with ground cover as follows: One (1) five (5)
gallon shrub for each 100 square feet of landscaped area;
and two (2) fifteen gallon trees for each 500 square feet of
landscaped areas.
The southerly portion of the property shall be landscaped
with a minimum of ten trees 15 gallons.
10. The required front, rear, and side yards shall be landscaped
and shall consist predominately of plant materials except
for necessary walks, drives and fences.
11. A minimum of six (6) enclosed parking spaces shall be
provided.
12. A six (6') foot high block all shall be installed along the
perimeter of the property, except within the twenty (20')
foot front yard setback. In this frontage, if built, the
wall shall not exceed a height of four (4') feet measured
fr'om top of curb.
13. No side yard shall be less than five (5') feet.
14. Final building elevations, includinq materials of
construction, shall be submitted to and approved by the
Building Official and the Planning Division prior to
issuance of any building permits.
15. Before any building permits shall be issued, the developer
shall pay $1.58 per square foot for residential buildings to
the Lynwood Unified School District, pursuant to Government
Code Section 53080.
16. All driveway and parking areas shall be paved. �
17. Acoustical construction materials shall be used throughout
the units to mitigate freeway noise to the standards and
satisfaction of the Building and Safety Division.

' property acquisitions be in conformance with adopted general
plans.

The property is a large, improved, industrial property
comprising the westerly portion of the city block bounded by
Alameda Street on the west, Martin Luther King Jr. Boulevard
, on the north; 108th Street on the south; and Santa Fe Avenue
on the east.
3. Prooer� Size
The subject property is basically rectangular in shape. It
has 250 feet of frontage along Alameda Street; 703 feet along
Martin Luther King Boulevard; 559 feet along 108th street.
The area has been calculated to be approximately 139,728
, square feet, Or 3.21 acres. '
, 4. Existing Land Use
The subject site is flat, with two story, masonry and steel,
' office building, a modern, concrete tilt-up, light building,
and a semi- modern; steel frame metal clad, warehouse
building. The surrounding land uses are as follows:

South- Single Family West- Manufacturing
5. Consistencv With General Plan
The proposed land acquisition is consistent with the existing
zoning classiEication (M) and general plan designation of
industrial. Therefore, granting the acquisition will
notadversely affect the General Plan.
6. Environmental Assessment
Pursuant to Section 15073 of the State CEQA Guildelines, as
• � amended, a Negative Declaration has been prepared . Zt has
been determined that the acquisition of subject property will
not have a significant effect upon the environment based upon
the completion of the Initial Study and Environment
Checklist.
7. Recommendation

square feet to 50,000 square foot building at 10901 Atlantic
Avenue, in the C-3 (Heavy Commercial) zone.

Section 25-32.1.5 of the Lynwood Municipal Code requires that
a11 new commercial development in the City, of Lynwood obtain
approval of a Conditional Use Permit from the Planning
Commission.
2. Pronertv Location
' The project_is located on the northwest corner of Pendleton
� and Atlantic Avenue and is comprised of six parcels. The
site will have vehicular access from Atlantic Avenue,
Imperial Highway, and Pendleton Avenue. (See attached

, The proponent (Central Applicance) is proposing to modify
Conditional Use Permit Case No. 105 to reduce the project
, size to 50,000 square feet. The original 77,000 square feet
project was approved by the Planning Commission on February
11, 1992. The proposed two story 50,000 square feet retail
- store will carry products such as electronics, furniture,
appliances,, and spbrting goods. All existing structures on
site shall be demolished. -

parking offsite possibly on Lucky Market/ or,,other adjacent

At its regular meeting on April 1, 1992, the Site Plan Review
Committee evaluated the proposed development and recommended
approval to the Planning Commission, subject to specific
conditions and requirements.

ANALYSIS AND CONCLUSION:
1. Consistency with General Plan
The proposed land use is consistent with the existing zoning
classification (C-3) Heavy Commercial and General Plan
designation of Commercial. Therefore, granting Modification
to Conditional Use Permit No. 105 will not adversely affect
the General Plan. �
2. Site Suitability
The property is adequate in size and shape to accommodate the
proposed development relative to structures, parking, walls,,
. fences, landscaping, driveways and other development features
required by the Zoning Ordinance.
3. Comnatibilitv
The proposed development is surrounded by a mixture of
commercial and residential developments; therefore, the
project will be compatible with the surrounding land uses.
Residential uses are located to the north of the proposed
use.
4. Comoliance with Development Standards
The proposal meets the development standards required by the
Zoning Ordinance with respect to setbacks; lot coverage;
building height and density. The parking standards will be
satisfied via a covenant to locate a minimum of 15 spaces
off-site.
5. Conditions of Approval
The improvements as proposed, subject to the conditions.
recommended by the Site Plan Review Committee, will not havea
negative effect on the values of the surrounding properties
or interfere with or endanger the public health, safety or welfare.

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF LYNWOOD APPROVING MODIFICATION
OF CONDITIONAL IISE PERMIT NO. 105 FOR THE
DEVELOPMENT OF A 77,000 SQUARE FOOT AND A
5400 SQUARE FOOT AUTO SERVICE AT 10901
� ATLANTIC AVENUE IN THE C-3 (HEAVY
t COMMERCIAL) ZONE.
WHEREAS, the Lynwood Planning Commission, pursuant to law,
conducted a public hearinq on the subject application; and
WHEREAS, the Planning Commission, considered all pertinent
testimony offered at the public hearing; and
WHEREAS, the Community Development Director has determined
that the proposal will not have a negative effect on the
environment, and has therefore declared a Negative Declaration
for the project; and
WHEREAS, a Conditional Use Permit is required for
development of a new eommercial use in area designated as
� Commercial under the General Plan and in a C-3 (Heavy Commercial)
. zone.
Section 1. The Planning Commission hereby finds. and
determines as follows:
A. The site of the proposed use-is adequate in size and'
shape to accommodate the structures, parking, walls,
: landscaping, driveways and other development features
required by the Official Zoning Ordinance.
B. The structures, as proposed, subject to con3itions, will
not have a negative effect on the values of surrounding
properties or interfere with or endanger the public,
health, safety, or welfare.
C: The site will be developed pursuant to the current
zoning regulations and site plan submitted and reviewed
by the Site plan Review Committee.
D, The granting of the Conditional Use Permit will not
adversely affect the General Plan.
E. The proposed development will aid in esthetically
upgrading the area and will act as a catalyst in
fostering other quality commercial developments.
Section 2. The Planning Commission of the City of Lynwood,
based upon the aforementioned findings and determinations, hereby-
approves Modified Conditional Use Permit, Case No. -105, provided
the following conditions are observed and complied with at all
times.
COMMUNITY DEVELOPMENT DEPARTMENT
General
1. The proposed development shall comply with all applicable
regulations of the Lynwood Municipal Code, the Uniform
Building Code and the Uniform Fire Code.
2. Any proposed subsequent modification of the subject site or
structures thereon, shall be first reported to the Community
' Development Department, Planning Division, for review.

� 3. The applicant and/or his representative shall sign a
Statement of Acceptance stating that he/she has read,
i understands, and agrees to all conditions of this resolution
prior to issuance of any building permits.
REDEVEIAPMENT DIVISION
4. The project design shall provide for access and circulation
.� of vehicular, pedestrian, and emergency vehicle traffic in a
safe, logical and efficient manner, both to the site (off-
site) and within the site (on-site).
5. The proposed design shall be compatible with existing
developments in the area in terms of scale, height, bulk,
materials, colors, and the preservation of privacy.
6. The main entrance to the primary building should provide for
independent access to the physically impaired.
7. The street address shall be displayed in a prominent
location on the street side of the building. All address
numbers shall be.easily visible to vehicular and/or
pedestrian traffic. The street address and room number
shall be no less than four (4) inches in height and shall be ;
of a color contrasting to the background to which they are
attached. �

8. On-site lighting shall be installed along all vehicular ��
access ways and major walkways. Such lighting shall be �
directed onto the driveways and walkways within the
• development and away from adjacent properties. '

9. The parking aisle width shall be twenty-five (25') feet.
Exits from parking lot shall be clearly posted with stop i
signs.
10. Cart return areas if applicable, must be provided and shown I
on the site plan. '

11. All landscaped areas shall be landscaped with a mixture of ,
ground cover, shrubs and trees, and may include decorate
rock, sculpture,, and walkways, within the major parking
area. ,
12. Within the main parking area, one (1) tree shall be provided i
for each ten (10) parking spaces. The trees shall be of a ,
species that provides a broad canopy. ,
13. All required landscaping materials shall be not less than i
the following sizes:
o Trees - at least fifteen gallon •
o Shrubs - at least five gallon j
o Grounds cover - lawn shall be of sod and shall cover �
the proposed area. ;
14. No sign shall be erected without a sign permit.
15. The Director or his designee shall issue the sign•permit !
upon approval by the Planning and Redevelopment Divisions. ,
16. Only individual illuminated channel letters shall be
permitted.

17. Uses within seventy-five (75') feet of and fronting on a
major street shall have monument identification signs.
- 18. Billboards signs are prohibited.
Y9. There shall be a periodic review of the applicant's
compliance with all of the requirements, at a time specified
by the Director, but in no event longer than 12 months.
20. The applicant or his/her successor in interest shall provide
, evidence of good-faith compliance with all of the
requirements at the time of said review.
21. If, at the end of the time period established by the
Director or his/her designee, the applicant or his/her
successor in interest has failed to comply with all of the
, requirements, the Director or his/her designee, shall notify
the Planning Commission of his/her findings and recommend
such action as deemed'appropriate, according to the Lynwood
- Municipal Code.
PLANNING DIVISION '
22. . The applicant shall contact the U.S. Post Office (Lynwood
main office) to establish the location of mail boxes serving
the proposed development.
, 23. Construction shall commence within six (6) months from date
of issuance of building permits.
24. This permit shall become void one hundred twenty (120) days,
unless extended, after the use permitted has been abandoned
or has ceased to be actively exercise.
Landscaoinq
' 25. The applicant is required to submit a landscape plan drawn
by a licensed landscape architect to the satisfaction of the
Director of Community Development prior to any building
permit being issued. "
26. The amount of landscaping required shall be provided and
consistent with the proposed landscape plan.
27. All other existing mature trees and other significant
vegetation should be preserved and integrated into the
landscape plan to the satisfaction of the Community
Development Director or his/her designee.
28. All landscaping shall be permanently maintained. Lawn and
ground covers are to be trimmed or mowed regularly, with all
. planted areas kept free of weeds and debris. All plantings
are to be kept in a healthy and growing condition. An
automatic sprinkler or irrigation system shall be provided
and maintained in working condition.
29. where vehicTes are to be parked immediately adjacent to a
public or private street or alley, a decorative masonry wall
a maximum of thirty-six inches in height measured from the
finished surface of the parking area, shrub and groundcover
'_ lot from street view shall be provided. If a wall is
provided, there must be minimum landscaping to screen wall
from street view and accessibility.
, 30. Prior to the installation or construction of any fence or
masonry wall within any zone, the property owner shall
obtain a permit and submit the following information to the
Planning Division of the Community Development Department.

a. A simple plot plan showing the location of fence or
masonry wall in.relation to the property lines, heights,
proposed materials, and openings or gates to provide
access for vehicles and pedestrians.
b. For masonry walls a building permit shall be applied for
upon approval of the plot plan described above. All
masonry walls of any heiqht shall meet the requirements
for masonry construction as defined in Chapter 24 of the
Uniform Building Code. A fee based on the valuation of
the.proposed construction shall be paid to the Building
Division.
31. All fences or masonry walls shall be required to maintain
adequate pedestrian access for the purpose of safety and
' convenience. A thirty-six (36) inch or three foot clear
gate or opening shall be provided to all enclosures for
_-, pedestrian and wheelchair access. Pedestrian and vehicular
access shall be provided.
32. All fences or masonry walls shall be required to be
installed with a finished, esthetically pleasing side facing
out toward adjacent properties or the public right-of-way to
� the satisfaction of the Community Development Director or
, his/her designee.
33. The applicant must provide a trash enclosure consistent with
• the materials and color of the main building(s), with gates,
on the site of the subject property. The trash enclosure
shall be built as per Buildinq aad Safety Division
standards.
PARKING `
34. The applicant shall enter into a covenant agreement with the.
City to accommodate required parking off-site in conformance
with off-site parking requirements of the Lynwood City code.
- 35. Parking shall be a minimum of 157 stalls for customer
, parking only.
36. Each off-street parking space shall not be less than twenty
(20) feet in length and nine (9) feet in width, exclusive of
access driveways or aisles, except as noted below:
° a. Any standard parking space that is immediately adjacent
to a wall, structural column, light standards, or
similar obstruction on one or both of its longer sides
'.. or in an enclosed space shall be at least ten (l0') feet
in width and twenty (20') feet in length.
b: At a minimum two parkinq spaces designed for the
handicapped shall be provided. These spaces may be
provided as follows:
1. Dimensions. The minimum dimensions of each
automobile parking stall for the handicapped shall
be not less than fourteen (14) feet in width by
twenty (20) feet in length. Said stalls shall be .

' 3. Location. All parking spaces for the handicapped
shall be located adjacent to the main entrance of
the facility for which the spaces are provided. The
parking spaces shall be positioned so that the
handicapped persons shall not be required to walk or
wheel behind parked vehicles.
37. The applicant shall submit elevation drawings tot he
Planninq Division showing the exterior building design;
including the specification of colors, and materials. Prior
to the issuance of building permits, the design of the
subject building including color and materials, must obtain
• approval by the Director of Community Development.
38. Prior to the installation, display, enlarging, modifying,
relocating or changing of signs, a permit must be obtained
from the Department of Community Development, Planning
Division.
39. Central Heating, cooling ventilation equipment, swimming ,
pool pumps and heaters and all other mechanical devices
shall be screened from public view. Such equipment shall be
screened from surrounding properties and streets and
operated that they do not disturb the peace, quiet and
comfort of neighboring residents, in accordance with the
City's Noise Ordinance. All means of access to the
referenced equipment shall be designed and installed so as
to prevent access to unauthorized persons and shall be
approved by the Building and Safety Division.
40. All security fences, grills, etc. shall be architecturally
compatible with the design of the subject and adjacent
buildinqs. In addition, no security fences, grills, etc.
shall be installed without the prior written approval of the
Director of Community Development and required building
permits as per plan.
41. Pursuant to Ordinance No. 1319 to insure variation and
� esthetically pleasing color schemes for buildings in
i Redevelopment areas along major City Streets, i.e. Long
i Beach Blvd., Atlantic Ave., Martin Luther King Jr. Blvd., or
, Imperial Highway, the exterior of any building or structure
i shall be painted with a color within a range of colors
, approved by the Community Development Director.

42. The existing property shall be cleaned and maintained in a
� sanitary condition pending construction and shall be
i maintained in a neat and orderly manner at all times.
Failure to comply may result in revocation of the
� Conditional Use Permit.
43. Entity will maintain a pro-active approach to the
elimination of graffiti from the structures, fences and any
accessory building, on a daily basis.
j Maintenance of sidewalk, parkinq area, gutters and any
; surrounding area will be done a minimum of twice a day
j (before starting operations and before closing).

I 44. A cover sheet of approved Conditions must be attached to
plans prior to submission to the Building and Safety
Division.

' 45. Any violation of said conditions in this resolution may
! result in revocation or modification of the Conditional use
� Permit by the issuing body at a regularly scheduled meeting.

48. Provide documentation that lots composing the property were
legally tied together to the satisfaction of the Department
