Communication0from the Public (3 min. maximum) Christopher O'Hare stated that he felt the choice for Police Chief is excellent and in recognition of that he would delay comment on several items he had intended to address until the January meeting. Martin O'Boyle commented about the deposition of Mr. Graziano. The President of the Place Au Soleil Homeowners Association, Chet Snavely, pointed out that the car dealer to the south of Place Au Soleil is planning a 30 foot tall parking building and he asked Town Commission Regular Meeting a Public Hearing December 9, 2016 @ 9:00 A.M. D. Police Chief 1. Activity for November 2016 Acting Chief Allen asked that the report be accepted as presented if there are no questions. There being no questions, the Mayor declared the finance reports and the police report accepted as submitted. IX. Items for Commission Action. A. Agreement for Election Services-PalmNgreeme ounty Supervisor of Elections The Town Clerk explained that this ais to cover the expenses of the Palm Beach County Supervisor of Elections for providing equipment and materials that are necessary to conduct a municipal election. She added that this is done each year, that all has reviewed the document. �%, Commissioner Orthwein moved that the agreement be approvthe Mayor be authorized to execute the agreement. The motion seconded by Commissioner White and all voted AYE at roll call. B. Appointment of AMLce Chief Town Manager stated tha he had spoken with Barbara Ward, Chief Ward's wife, an h dvised th Gary would be unable to return to his position as Pol e Chief and wo ire on December 1, 2016. With this kn wledge, Town Manager Thrashe aid he is honored to be able to recom'`f o the Commission, the ap intment of Edward Allen. Mayor Morgan that this is a time of conflicting emotions in that many know Chief W well and consider him a friend. He added that best wishes ar tende o Chief Wards family and our prayers and hopes go out to ayor`said that, With regard to the opening of police chief, can whole heartedly support the appointment of Edward Allen. He re ed that since he has been Acting Chief he has had the opportune to observe him more closely and has found him to be a man of excelle managerial skills, ho oversees things very well and also communicates ery well. ayor_Morgan said he is loyal to his staff, the men who serve der him and is decidedly loyal to the residents of the Town of Gulf St m. Christopher O'Hare, if Stream resident, commented that what happened to Chief W is a tragedy but that Chief Allen is great for this position. Commissioner Orthwein moved to appoint Edward Allen to the position of Police Chief of the Town of Gulf Stream and Commissioner White seconded the motion with all voting AYE at the roll call. Chief Allen expressed his appreciation to the Commission for being given this opportunity to serve the residents in Gulf Stream and to those who responded here, residents, family, friends and employees, to 3 MAYOR'S PROCLAMATION FOR ELECTION Proclaiming March 14, 2017 ELECTION DAY In the Town of Gulf Stream, Florida WHEREAS, the Town Charter of the Town of Gulf Stream, Florida requires that a Town election be held on the second Tuesday in March on any year in which a vacancy or vacancies are occasioned by expiration or early termination of the terms of office of Commissioners; and WHEREAS, the terms of the Town Commission members are expiring in March, 2017; NOW, THEREFORE, I Scott W. An election will be held on Tuesday March 14, 2017 for the purpose of electing five (5) Town Commissioners who shall hold office for a term of three (3) years, beginning on Friday, March 17, 2017 at noon. 2. Staff will request to add this to the agenda for 1-13-17 under Comission Action. RESOLUTION NO. 17-01 A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, DESIGNATING THE SUPERVISOR OF ELECTIONS, THE TOWN CLERK AND THE ADMINISTRATIVE ASSISTANT TO THE TOWN CLERK AS THE CANVASSING BOARD, TO BE IN ATTENDANCE FOR THE TESTING OF THE COMPUTER ELECTRONIC SYSTEMS TABULATING EQUIPMENT TO BE USED FOR THE GENERAL ELECTION SCHEDULED FOR MARCH 14, 2017 AND TO CANVASS RETURNS OF SUCH ELECTION INCLUDING THE ABSENTEE BALLOTS; ASSIGNING SUPERVISOR OF ELECTIONS TO HANDLE THE ABSENTEE BALLOTS; PROVIDING FOR REPEAL OF PRIOR RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 101.5612 (1) of the Florida State Statutes provides for the testing of automatic tabulation equipment; and WHEREAS, Section 101.5612 (1) further provides that the canvassing board shall convene and certify to the accuracy of the test or designate one member to represent it at the testing; and WHEREAS, the Town Commission desires to designate a person or persons as a member or members of the canvassing board for the purpose of canvassing the returns and certifying the results of any election, including all absentee ballots, in the Town of Gulf Stream, Florida, and or to attend the testing of the automatic tabulating equipment; and WHEREAS, the Supervisor of Elections has proposed the utilization of a central canvassing board for all municipal elections occurring on March 14, 2017, made up of the Supervisor of Elections, the Town Clerk and the Administrative Assistant to the Town Clerk; and WHEREAS, the proposed central canvassing board will be available, at the discretion of the Supervisor of Elections, if a sufficient number of municipalities agree to employ it so as to make the canvassing and post-election audits more efficient and cost- effective for the municipalities and the Supervisor of Elections; and WHEREAS, Chapter 101 of the Florida Statutes provides for the handling of absentee ballots. NOW THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, that: Section 1. Pursuant to Section 101.5612 (1) and Section 101.68 of the Florida Statutes, Susan Bucher, Supervisor of Elections in and for Palm Beach County, or her successor or designee, the Town Clerk and the Administrative Assistant to the Town Clerk are hereby appointed to serve as the canvassing board of the Town of Gulf Stream for the General Election to be held on March 14, 2017, and to serve as the Town's representative for the testing of the automatic tabulating equipment at the Palm Beach County Supervisor of Elections Tabulation Center, at 7835 Central Industrial Drive, Riviera Beach, Florida; and for the Supervisor of Elections, or her successor or designee, the Town Clerk and the Administrative Assistant to the Town Clerk to further certify to the accuracy of the equipment on the evening of the General Election held March 14, 2017; and to canvass the election results, including all absentee ballots; and to conduct all and such other post- election functions, including testing and audits, as is required by law. Section 2. Pursuant to Chapter 101 of the Florida Statutes, Susan Bucher, Supervisor of Elections in and for Palm Beach County, or her successor or designee, is designated to distribute and certify absentee ballots for the municipal election. Section 3. All Resolutions or parts of Resolutions in conflict are hereby repealed to the extent of such conflict. Section 4. This Resolution shall take effect immediately upon adoption.
