HomeMy Public PortalAbout20061002REGULAR COUNCIL MEETING OCTOBER 2, 2006 CALL TO ORDER 1 The Regular Council Meeting of October 2, 2006, was convened at 6:00 P.M. by Mayor John Landwehr. Prayer was offered by Councilman Michael Berry, followed by the Pledge of Allegiance. ROLL CAL The following Council Members were present for the roll call: Present: Berry, Brown, Crane, Ferguson Harvey, Layton, Oetting, Pope, and Vogel Absent: None A quorum was declared present. Mayor John Landwehr recognized a member of Boy Scout Troop 104 from St. Joseph's Cathedral and welcomed him to the meeting. MISCELLANEOUS AGENDA ITEMS Recognition of City Clerk - City Administrator Steve Rasmussen read into the record a letter received by the International Institute of Municipal Clerks stating that City Clerk Phyllis Powell had recently achieved the Second Level Membership of the IIMC Master Municipal Clerk Academy. MINUTES AND REPORTS RECEIVED AND FILED Mayor John Landwehr announced that the following minutes and reports have been received and are on file and may be reviewed in the City Clerk's office: a. CAMPO Board of Directors Meeting, August 23 and September 7, 2006 b. Planning & Zoning Commission, August 10, 2006 c. Minutes and Reports of the CVB (available for review in the City Clerk's Office) REGULAR COUNCIL MEETING OCTOBER 2, 2006 COUNCIL LIAISON REPORTS There were no reports made at this time. 2 ANNOUNCEMENTS OF OTHER UPCOMING MEETING AND EVENTS a) Dedication of Veteran's Memorial Plaza - Pat Sullivan stated that the Plaza is almost completed and a dedication ceremony will be held at 10:00 A.M. on Monday, October 9 at the site. He encouraged the public to attend. Community Development Director Pat Sullivan stated that bricks will be available on an ongoing basis, and when enough bricks have been purchased, another section of the plaza will be installed. APPOINTMENTS BY THE MAYOR There were no appointments recommended at this time. PRESENTATIONS FROM STAFF, CONSULTANTS & INVITED GUESTS Mr. Phil Freeman and Mr. Bob Scruggs made a presentation regarding the city half cent sales tax issue which is scheduled to be voted on at the November 7 election. A brief slide presentation was given showing the successes of past sales tax initiatives and needs for continuing the funding for future projects. Mayor John Landwehr thanked the two citizens for their hard work on behalf of the city on this issue. Ms. Shannon Hawk, Jefferson City Multicultural Forum, made a presentation regarding the Saturday, October 7 annual Multicultural Forum which will be held at Memorial park beginning at 11:00 A.M. She invited everyone to attend. Following the presentations, Councilman Michael Berry asked if Rogers, AR has an English - only ordinance on its books. Ms. Hawk stated she did not know but that she could find out and get that information to the Council. Mayor John Landwehr asked Assistant to the City Administrator Melva Fast to give a report on the recent visit of 29 visitors from Jefferson City's partner city of Muenchberg, Germany. Ms. Fast gave brief highlights of the various events which occurred while the visitors were here, and stated that both the citizens of Jefferson City and the visitors from Muenchberg were very pleased with the success of the visit. She stated that the Muenchberg citizens have now invited visitors from Jefferson City to their city. REGULAR COUNCIL MEETING OCTOBER 2, 2006 PRESENTATIONS FROM THE GALLERY 3 The following persons made presentations indicating their wishes that the Jefferson City Memorial Airport control tower remain open. Mr. Bob Morgan, 918 Nob Hill Mr. Herman Lueckenotte, 602 Mesa Avenue Dr. Arthur Langston, 605 Nelson Drive Mr. Jack Kennedy, 1003 Jason Road Mr. Eddie Bingham, 2007 Wooded Lane Mr. Dave Martin, 3319 Shamrock Road At the conclusion of the above six presentations, Mayor John Landwehr asked if the Council wished to make an exception to the rules which place a fifteen - minute total limit on a group of presentations made on the same topic. A motion was made by Councilman Edith Vogel to make an exception to the rule and extend the time allowed for the presentations, seconded by Councilman Kenneth Ferguson, and approved unanimously. Also the Council did not object to the request of an additional presentation by someone who had not previously signed up. The presentations continued on the same topic by the following presenters: Mr. David Jennings, 3904 Liverpool Drive Mr. Pete Abbott, Ashland, MO Mr. Rick Barnes, (no address given) Mr. A. J. Stricker, P.O. Box 431, Holts Summit Some of the presenters distributed handouts, and all voiced their concerns with safety to life, equipment, insurance costs, and loss of potential economic development of the city if the control tower did not remain open. Following the presentations, Mayor John Landwehr stated that there no plan for the city to close the control tower. He thanked the citizens for voicing their concerns and stated the City would keep them informed on any future discussions which might involve the airport. COUNCIL COMMENTS IN RESPONSE TO PRESENTATIONS FROM THE GALLERY No comments were made at this time. CONSENT AGENDA REGULAR COUNCIL MEETING OCTOBER 2, 2006 4 The following items were brought before the Council for approval by Consent at this time. a. Minutes of September 15 and September 18, 2006 City Council Meetings b. Authorizing United States Trustee to Rent Council Chambers c. Renewal (Year 6) - Agreement with United Health Care for employee health care benefits Renewal (Year 3) - Agreement with Blue Cross Blue Shield for Employee Dental Insurance Councilman Bryan Pope stated he wished to consider item (d) individually so he could abstain on it. Items (a), (b), and (c): A motion was made by Councilman Kenneth Ferguson for approval of the Consent Agenda with item (a) amended by correcting the September 15 Brown Bag minutes to show Councilman Mike Harvey present, seconded by Councilman Michael Berry, and approved unanimously. Item (d): A motion was made by Councilman Mike Harvey for approval as presented, seconded by Councilman Cindy Layton, and approved with Councilman Bryan Pope abstaining. Mayor John Landwehr asked City Planner Janice McMillan questions about how the zoning plans would work if the land was deeded to the Missouri State Prison Redevelopment Commission. He asked other questions about how the land will be conveyed. Ms. McMillan will find the answers to his questions and get them to the Mayor and Council. Councilman Bryan Pope made comments regarding the fact that this bill proposes raising fares for users of the bus system while the users of the City's airport expect their fees to remain the same. Councilman Kevin Brown asked about the reason this bill came up. City Administrator Steve Rasmussen stated that any Council Member may request staff to place legislation before the Council for its consideration, and explained that the sponsor of this bill was the source of it. Several questions were asked about the bill, and several Council members agreed that before such a bill is considered it should go through a Council committee first. Mayor John Landwehr suggested one member from each of the five wards should go on all of the committees. He would like to make the appointments to any new committees quickly, and asked the Council to discuss among themselves which committee they prefer to serve on, and suggested seniority on the Council should play a factor in determining preferences. Councilman Kevin Brown requested that Bill 2006 -52 remain on the Informal Calendar at this time. REGULAR COUNCIL MEETING OCTOBER 2, 2006 RESOLUTIONS 11 RS2006 -17 Recognizing AmerenUE for Missouri Change a Light Rebate Program (Berry) A motion was made by Councilman Michael Berry for adoption of RS2006 -17, seconded by Councilman Kevin Brown, and approved unanimously. SCHEDULED REPORTS No reports were given at this time. NEW BUSINESS Nominations of Ward Five Council Member: Councilman Cindy Layton suggested waiting until the filing period closed before nominating a replacement to fill the Ward Five vacancy because that was what happened when she was appointed by the Council. A motion was made by Councilman Michael Berry to defer the nominations until after the filing period closed, seconded by Councilman Kenneth Ferguson. Following a lengthy discussion, the motion was defeated by the following roll -call vote: Aye: Berry, Ferguson, and Layton Nay: Brown, Crane, Harvey, Oetting, Pope, and Vogel Nominations were then taken. Councilman Michael Berry nominated Brenda Hancock, seconded by Councilman Cindy Layton. Councilman Mike Harvey nominated Daniel Klindt, seconded by Councilman Edith Vogel. Councilman Kenneth Ferguson nominated Sharon Mize, seconded by Councilman Cindy Layton. There being no further nominations made, a motion was made by Councilman Mike Harvey to close nominations, seconded by Councilman Edith Vogel, and approved unanimously. Mayor John Landwehr stated that the next step in the process is to schedule a public forum to meet the three nominees, and reminded the nominees that they will need to file their Declaration of Candidacy with the City Clerk to validate their nomination. Mayor John Landwehr mentioned that he had spoken to several people who are in the process of renovating some old buildings in the City, and that in all cases, they told him their REGULAR COUNCIL MEETING OCTOBER 2, 2006 12 desire to do this was directly related to the prison redevelopment. UNFINISH ED BUSIN ESS There was no unfinished business brought before the Council at this time. APPROVAL OF CLOSED SESSION MINUTES September 15, 2006, Closed Session Minutes - A motion was made by Councilman Bryan Pope for approval of the minutes as presented, seconded by Councilman Cindy Layton, and approved unanimously. GO INTO CLOSED SESSION Mayor John Landwehr stated that, Pursuant to Sec. 610.021 of the Revised Statutes of Missouri, the Chair would entertain a motion to go into Closed Session to discuss the following: a. Real Estate [Sec. 610.021.(2)] b.
