BACKGROUND: On June 4 , 2019, the City Council introduced Ordinance No . 19-1035 for f i rst reading , by title on ly, amending TCMC Titles 4 and 5. ANALYSIS: As introduced by the City Council , Ordinance No . 19-1 035 amends the TCMC to comply with Senate Bill 946 and to establish reasonable regulations pertaining to sidewalk vending and mob ile food ve nding . The City Council introduced the ordinance as proposed , with one rev ision as recommended by the City Attorney . TCMC Section 4-12-7-B was revised to all ow t he City Manager or their designee to establish additional requirements fo r sidewalk vending in City-owned o r operated parks , c ons istent with the Government Code . City Council Ju ne 18, 2019 Page 2 of 2 CITY STRATEGIC GOALS : Ame nding the TCMC to comply with SB 946 is consistent with the City's strategic goals of Good Governance and Economic Development. FISCAL IMPACT : This item does not have an impact on t he Fiscal Year (FY) 2018-19 or FY 2019-20 C ity Budget. ATTACHMENT : A. Ordinance N o . 19-1035 ATTACHMENT A ORDINANCE NO. 19-1035 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY MUNICIPAL CODE TO ADOPT CHAPTERS 4-12 (SIDEWALK VENDING) AND CHAPTER 4-13 (MOBILE FOOD VENDING) T he C ity Council of t he C ity of Temple City orda ins as follows : SECTION 1. Findings . The C ity Council finds as follows : A. On September 18 , 2018 , Governor Brown signed in to law Sena te Bi ll ("SB ") 946 , wh ich adopts state law t hat im poses lim its on how loca l autho ri t ies , includ in g cit ies , may regulate sidewalk vending . SB 946 is cod ified in Government Code 51036 and fo ll owing . B. Among other things , SB 946 limits c ity regulation of s idewa lk vending t o restrict ions t hat are directly related to ob j ective health , safety, o r welfare concerns and prohib its pu nishment for street vend ing-related violat ions unless it is through a civ il f ine . C. SB 946 recognizes , however, that "California has an interest in the regulation of traffic ... whether in e ns uring t he appropriate flow of traffic o r i n ensu ring the safety of pedestrians on the road o r the s idewalk ," and has ac knowledged t hat there are regulations that are di rectly related to obj ective health , safety , or welfare concerns that a city may adopt , which inc l ude , but are not l im ited to , regulations concerning hours of operation , sanitation , s idewalk access , health and vendor permits , compliance with othe r gene rally applicable laws , registrat ion requirements , and interference w ith othe r special events or perm itted activ ities . In addition , stat e law recogn izes that the health , safety, and we lfare interest in prov iding safe school zones and protecting adjacent streets , sidewa lks , and public ways from activities that may disrupt school activities and the health and safety of schoolchildren . D. The City a lso has a public health , safety , and welfa re interest in food -related vending from motorized veh icles , and des ires to am end its m un icipa l code to upd ate t he regulations regarding operation of certain types of vehicular-re lated food vend ing in order to protect public health , safety and welfare . E. As a result, the C ity desires to upda t e its municipal code to establ ish sidewal k vending and mobile food vending regulat ions that are directly related to the objective hea lt h, safety , and welfare of the City and are consistent with state law . The update wi ll also result in some conforming changes to the municipal code . F. On June 4 , 20 19, t he City Counc il considered th is o rdinance , and al l i nterested parties we re g iven full opportunity to be heard . SECTION 2 . Environmental Review. The City Council exercises its independent judgment and finds that the proposed ord i nance is not subject to Cal iforn ia Env ironmental Quality Act (CEQA), pursua nt to Section 15060 (c)(2) (the activ ity w i ll not resu lt in a d irect or reasonably fo reseeable indi rect physical change in the e nvironme nt), and sect ion 15060(c)(3 ) (the activ ity is not a project as defined in Section 15378) of th e CEQA Guidelines , California Code of Regulations , Title 14 , Chapter 3 , because the subject regulat ions have no potential for resu lt ing in any sign ifica nt physical change to the environment, e ither d irectly or i nd ire ct ly. Ordinance No. 19-1035 Page 1 of 3 SECTION 3 . Adoption of Chapter 4-12 (Sidewalk Vending). Chapter 4-12 of the Temple City Municipal Code is adopted as set forth in Exhibit A. SECTION 4 . Adoption of Chapter 4-13 (Mobile Food Vending). Chapter 4-13 of the Temple City Municipal Code is adopted as set forth in Exhibit B. SECTION 5. Conform ing Amendments . T he follow ing sections of the Temple City Municipal Code are amended as f ollows : A. Sections 3-4-A-14 (Solicitation from Public Street Prohibited), 4-8-14 (Vendor's Pe rmit), 3-5D -10-A (Merchandising in Pa rks), 4-8-15 (Vendors ' Restr ict ions ), 4-8- 16 (Vendo rs' Veh icles), and 4-8-1 7 (Sales Upon Streets ), are deleted in their entirety . B. Section 5-1 C-0 (Definitions ) is amended to revise the defin it ion of "Peddlers and Solicitors" as follows : ""PEDDLERS" or "SOLICITORS": Includes any person , except for sidewalk ve ndors (as defined in Section 4-12-0) or mob il e food vendors (as defined in Sectio n 4-1 3-0), who trave ls from place to place or house to house and makes demonstrations of, or solicits , takes orders or canvasses for the sale of, or who sells any goods , wares or merchand ise , or th ings or art icles of value of any nature , kind o r description ." SECTION 6 . Severability . If any section , subsection , sentence , clause , or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a dec ision of any court of competent jurisdiction , such decision will not affect the va li dity of the rema ining portions of th is ordinance. The C ity Counc il hereby declares that it would have passed th is ordinance and each and every section , subsectio n, sentence , clause , or phrase not de cl ared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 7 . Publication . The City C lerk is d irected to ce rtify this o rd ina nce and cause it t o be published in the manner requ ired by law . "Cart" means any pushcart, stand, display , pedal-driven cart, wagon , showcase , rack, or other non-motorized conveyance, and includes a stationary cart or a mobile cart . "Cart permit" means a permit issued by the City for a cart to vend food or merchandise within the City . "Californ ia Retail Food Code" means Part 7 of Division 104 of the Californ ia Health and Safety Code (commencing at Secti on 113700). "Department" means the City's Department of Commun ity Development. "Director" means the director of the City 's Department of Community Development. "Food " means any type of ed ible substance or beverage . "Health Department" means the Los Angeles County Department of Pub lic Hea lth . "Los Ange les County Department of Public Health permit" means any and all licenses , permits, cert ifi cat ions , and courses required and issued by the Los Angeles County Department of Public Health to vend food with in the City in accordance with th is chapter. "Merchandise" means any item or goods that is not food . "Mob ile cart " means a pushcart , pedal-driven cart, wagon , or other non-motorized con veya nce used by a roam ing sidewalk vendor. "Person " or "persons" means one or more natural persons , individua ls , groups , businesses , business trusts , companies , corporations , joint ventures , joint stock companies , partnership , entities , associat ions , clubs or organizat ions composed of two or more individuals (or the manager, lessee , agent , servant, officer or employee of any of them), whether engaged in business , nonprofit or any other activ ity . "Roaming vending cart " means a pushcart , pedal-driven cart, wagon , or other non- motorized conveyance used , by a roaming sidewa lk vendor, to be moved from place to place , and with stops only to complete a transaction . "Roam ing sidewalk vendo r" has the same meaning as set forth in Government Code section 51 036 (b), and includes a s idewalk vendor who moves from place to place and stops on ly to complete a transaction . Page 1 o.f 7 "Ru les and regulations " means the rules and regu lations , if any , estab lished by t he d irector and adopted by City Council reso lution , concern ing any sidewa lk vend ing program that is intended to clarify and a id in the admin istration and enforcement of this chapter. "Sidewalk" means any paved surface in the public right-of-way prov ided f o r t he us e of pedestrians and includes pedestrian paths . "Sidewa lk vending prog r am " means the program establ ished by th is chapte r t hat is applicable t o sidewalk vend ing-re lated activities. "Sidewa lk vendor" has th e same mean ing as set forth i n G overnment Code sect ion 51 036 (a), and includes a pe rson who sells food or me rchand ise f ro m a pushcart, stand , d isplay , pedal -driven cart , wagon , showcase, rack , or other non -motorized conveyance , or f rom one 's person , upon a public sidewalk or other pedestrian path . "State seller's perm it " means a perm it issued by the Ca liforn ia Department of Tax a nd Fee Administra ti on . "Stat ionary vend ing c art" means a pushcart , stand , di splay , pedal-d rive n c art , wag o n , showcase , rack, or other non-mot o rized conveya nce , th at is i ntend ed to be operat ed fro m a f ixed location by a stationary s idewa lk vendor instead of be ing moved fro m p lace to place , w he re stops are limited to completing a transaction . "Stationary sidewalk vendor'' has the same meaning as set f orth i n Government Code section 51 036 (c), and includes a sidewalk vendor who vends from a fixe d location . "Vend " means to se ll , offe r for sale , expose o r d isplay fo r sa le, sol icit offe rs t o purch ase , barter, or exchange anyth in g of va lu e, even if the transa ct ion is chara ct e r ized as a donati on . "Vending license" means a license issued by the City to vend food or mercha nd ise w ithi n the City in accordance with this chapter. 4-12-1 : ADMINISTRATION: A The department is authorized to issue sidewa lk vending li censes and vend i ng c art permits in accordance w ith th i s chapter. B. The d irector is authori zed to develop , and enforce , t h is chapter and a ny rul es and regu lat ions regard i ng the li censing , perm itt ing , and ope ratio n of s idewa lk vend i ng , th at are adopt ed in accordance w it h this chapter. 4-12-2: VENDING LICENSE REQUIRED: No sidewa l k vendor may vend or operate anywhere within the City w ithout first obtain ing a sidewalk vend ing license . S idewalk vendors must comply with the t erms and condit ions set forth in the s idewa lk vend i ng license . 4-12-3 : CART PERMIT REQUIRED : No cart ma y be used for sidewa lk vend i ng anywhere w ith in th e C it y w it hout first obta in ing a s idewal k ve nding cart perm it for s uch cart. Page 2 of 7 4-12-4: APPLICATION REQUIREMENTS: A. To obtain or to renew a sidewalk vending license or vending cart permit, a s idewal k vendor must provide the following as part of the appl ication: i. Valid identification , such as a State of Cal iforn ia driver's license or identification number, an ind ividual taxpayer identification number, or a mun icipa l identifi cation number, o r any other government-issued identification card . ii. The name , address and telephone n umber of the sidewa lk vendor; iii. Proposed hours or days of operation ; iv . Whether the sidewalk vendor intends to operate a stationary vending cart or a roaming vend ing cart; v. Proposed locat ion of operation ; vi . The type of merchand ise or food offered for sale or exchange ; vii. Proof of a va li d City business license ; vii i. Proof of liab ility insurance and a signed indemnification in favor of the City , in an amount not less: than $1 million for property damage and injuries , includ ing injury resulting in death , caused by the operation of the vending business ; ix . The appl icat ion or renewal fee ; x . A valid Ca liforn ia Department of Ta x and Fee Adm ini stration selle r's perm it and any additiona l licenses from state or local agencies to the extent requ ired by law; xi. A permit from the Health Department for food-related vending , if applicable; xii. A certificate of completion of a food handler course and present a copy of the course completio n cert ificate , if appl icable ; xiii. A declaratio n tha t the information prov ided to the C ity is true and correct ; and xiv . Any other information , including operations-related information , as m ay be required by the director. B. Vending licenses and vending cart permits w ill expire on December 31 of the year issued . C . Vending licenses and vending cart per mi ts are not transferable . D. A person whose vend i ng lic ense and vend ing cart perm it is revo ked may not renew their vend ing li cense and vend ing cart perm it for one year. Page 3 of 7 4-12-5: OPERATIONAL REQUIREMENTS : A. Every cart used to vend food must be approved by the health department. A cart may only vend the types of food that are listed and approved by the health department under the health department permit. B . A cart used for sidewalk vending must obtain , possess, and prominently display a val id cart perm it and all other requ ired permits that are issued by other public agencies such as a health department permit. C . A cart used for sidewal k vend ing must be placed and used at all t imes in compliance with the terms and cond itions of the permit and all other applicable laws and regulations , including the California Retail Food Code if food is sold . D. A vend ing cart must operate according to its approved hours of operation . The director may im pose reasonable hours of operation for s idewalk vendors . For sidewa lk vend ing in nonresidential areas, the director may limit the hours of operation in a manner consistent with other businesses or uses on the same street(s) in those nonresidential areas. E. No vend ing cart , cond iment table or trash receptacle may be left on the s id ewalk after a stationary sidewalk vendor's stated closing time . F . A stationary sidewalk vendor must maintain a clean and trash-free 1 0-foot radius from a stationary cart during hours of operation and must leave the area clean by the approved closing time . G . S idewal k vendors that vend food items must provide a trash receptacle for customers and must ensure proper disposal of customer. trash . The trash receptacle must be large enough to accommodate customer trash without resorting to existing trash receptacles located on any block for use by the genera l publ ic . H . A stationary vending cart that vends food must be operated within 200 feet travel distance of an approved and readily available toilet and handwashing facility . If the facility is lo cated on private property , the vendor must possess a copy of an enforceable contract between the private property owner and the vendor allowing the vendor to utilize such facilit ies , includ ing the days and hours of operat ion . I. Vendors must comply w ith a ll applicable federa l, state , and local laws , regu lati ons, and ord inances . J. No signs that are not attached to the vending cart may be used or displayed . K. No s idewalk vendor or vending cart may use any device that produces a loud noise , nor may the vendor use or operate any loud speaker, public address system , rad io , sound amplifier, or other simi lar device . Page 4 of 7 4-12-5: VENDING IN RESIDENTIAL AREAS : No stationary vendi ng cart may be used to vend w ithi n a residential-zoned area . However, a roaming sidewa lk vendor may use a roaming vending cart within a res idential zone, and must move continuously except when necessary to complete a sale . 4-12-6: PROHIBITIONS ON PLACEMENT OF STATIONARY OR ROAMING CARTS: A. No s idewalk vendor may place or leave any vend ing cart: i. Within 5 feet of a marked crosswal k . ii. Within 5 feet of the curb return of an unmarked crosswalk. iii. Within 5 feet of any fire hydrant. iv . W ithin 5 feet ahead and 45 feet to the rear of a sign designating a bus stop. v . Within a marked bus zone . v i. W ithin 10 feet of a bench or shelter used for public transit. vi i. W ithin 5 feet of a driveway or driveway apron . v iii. Within 18 inches from the edge of the curb . ix. Where placement impedes the flow of vehicular traffic such as on public stre ets or publ ic highways. x . W it h in 300 feet of th e nearest property li ne of any property on which a public or private school building is located. B. No vend ing cart may be chained or fastened to any pole , s ign , tree , or other object in the public right-of-way or left unattended . C. No vending cart may impede the flow of pedestrian traffic by reducing the path of travel to less than 4 feet, or impede access to or restrict the use of abutting property , including , but not limited to, residences and places of business, in accordance w ith the Americans w it h Disabil ities Act (ADA). D . Notwithstanding any prohibit ions in this section , no sidewalk vendor may in stall , use or ma intain a cart where p lacement endangers the safety of persons or property. 4-12-7 : SIDEWALK VENDING RELATED TO PARKS , SPECIAL EVENTS: A. No sidewalk vending is allowed w ithin 300 feet of a perm itted event during the duration or ope r ating hours of s uch an event. For purposes of this section , the term "perm itted events" means certified farmers' m arkets, swap meets , and any event that requires an Page 5 of 7 encroachment perm it , special event perm it, or temporary event permits to allow the permit- holder the temporary use of or encroachment on the sidewa lk or other pub lic area . B . The C it y Manager or their designee may issue additiona l requ irements consistent with Government Code section 51 038(b)(2)(B) for City -owned or operated parks , effective after s ig ns are posted giving not ice of such add ition al requ irements . 4-12-8: FINES: Sidewalk vending in violat ion of this chapter will not be punishable as a crimina l infraction or misdemeanor, but will be subject to an adm ini strative enforcement process includ ing citat ions as follows : A. For vending without a valid vending license or vending cart perm it: i. An administrativ e fine of $250 for a first violation . ii. An administrative f in e of $500 for a second v iolation with in one year of the f i rst violation. iii. An administrative fin e of $1,000 for a th ird violation and each subsequent vio lation , within one year of the first vio lat ion . iv . Upon proof of a valid permit issued by the City before such fines are due , the City will reduce the amount of the fines to $100 for the f irst violation , $200 for the second violation , and $500 for each vio lat io n thereafter. B. For all violations of this chapter other than vend ing without a valid vending license or vending cart permit as outl in ed in subsection A above : i. An administrative fine of $100 for a first violation . ii. An administrative f ine of $200 for a second violation within one year of the first v iolation. iii. An administrative f ine of $500 for a th ird violation within one year of the first violation . iv . An adm in istration fine of $500 for a fourth and each subsequent violation and revocation of the license or perm it. C. The City w ill provide the person subject to the f ine notice of his or her right to request an ab ility-to-pay determ in at ion and will make avai lable instructions or other materia ls for request in g an abil ity-to-pay determination . D. All citations issued for violations of this chapter are subject to the admin istrative hearing and appeal process under Chapte r 1-4 of the Temple City Mun icip a l Code and Page 6 of 7 the City's authority to use any civil remedy available to co ll ect any unpa id adm i nistrative fine . E. Fines assessed pursuant this section may be reduced to 20 percent of the original fine amount upon submission of proof of inability to pay at a n adjudicat ion hearin g if requested by the person pursuant to Government Code section 51 038 (f). 4-12-9 : REMOVAL OF CART The City may request a sidewalk vendor remove any cart that is in violation of th is chapter. If the sidewalk vendor refuses to remove the cart, or if a cart has been abandoned , the C ity may cause the cart to be removed and may subsequently d ispose of the cart (includ ing any associated merchandise and food) if not claimed by the vendor w ith in 30 days of removal by the C ity, or if an admi nistrative appeal is fi led related to the cart removal , then 30 days after a final decis ion in the administrative appeal (including the payment of any outstanding adm inistrative fines). Page 7 of 7 EXHIBIT B CHAPTER 13: MOBILE FOOD VENDING 4-13-0: DEFINITIONS: As used in this chapter, the followi ng terms shall have the following meanings: "Business license" means a general license issued by the City to conduct bus iness in the C ity. "Health department" means the Los Angeles County Departme nt of Public Health . "Health perm it" means any and all licenses, perm its, certifications , and cou r ses requi red and issued by the Los Angeles County Department of Publi c Health t o vend food w it hin the C ity in accordance w ith this chapte r . "Motorized veh ic le " means any motorized veh icle , facility, or trailer. "Mobil e food vending " means the sell ing, vend ing, supplying or providing food , drinks o r any other consumables from any motorized veh icl e . "Mobile food vendor" means any person engaged in the activity of mobile food vending . "Person" means any natural person , bus iness, firm , company, non-profit organ ization , corporation , c lub, trust , partnersh ip , association , or s im ilar entity. "Street" means any area dedicated to public use for public street purposes and includes , but is not li mited to, roadways, pa rkways, medians, alleys, s idewalks, or front curbs, and publi c ways . 4-13-1: BUSINESS LICENSE REQUIRED: No mobil e food vendor may engage in or conduct any mobile food vend ing without a bus iness license . 4-13-2: HEALTH PERMIT REQUIRED: No mobile food vendor may engage in or conduct any mobile food vending without valid approvals from the health department, including but not lim ited to, a health perm it , and any applicable food handling perm it a nd a valid letter grade health perm it. Health perm its m ust be displayed at a ll t imes in a conspicuous view upon any motorized vehic le used for mobil e food vending . 4-13-3: TRAFFIC SAFETY REGULATIONS: A. No m obil e food vendor may operate or engage in any mobile food vendi ng on t he e x posed street and/or traffic side of the motorized veh icle . B . No mobi le food vendor may ope rate or engage in any mobi le food vend ing w ith in 25 feet of any street corner controlled by a crosswa lk , traffic light , or stop s ign . Page 1 of 3 C. No mobile food vendor may park any motorized vehicle for mobile food vend ing within 10 feet of a bus stop, mail box , or within 1 0 feet of a driveway apron to preserve adequate v isibility for vehicles to exit driveways . D. No mobile food vendor may use lighted or flashing signs on any motorized veh icle used for mobile food vend ing . 4-13-4: OPERATING TIME LIMITS: No mobile food vendor may stand or park any motorized vehicle used for mobile food vend ing for more than one hour in any particular location . However, this one-hour period will not apply to a vendor who is lawfully parked and peddling goods with a valid permit issued by the City for a special event. 4-13-5: OPERATING WITHIN PROXIMITY TO SCHOOLS: No mobile food vendor may operate or engage in any mobile food vending , or park any motorized vehicle to engage in mobile food vending , in or upon any street or other public place, including both public and private property, w ithin 300 feet of the nearest property line of any property on which a public or private school bu il d ing is located. 4-13-6: USE OF AMPLIFIED DEVICES PROHIBITED: No mobile food vendor may use amplified sound-making devices on any mobile veh icle while engaged in m obile food vend ing . Any mobile food vending operation must comply w ith any applicable city noise ordinance. 4-13-7: RESTROOM REQUIREMENTS: A mobile food vendor must demonstrate that there will be sufficient access t o nearby or on-site restroom facilities and hand washing stations provided for customers of the mobile food vendor. Restrooms must be accessible durin g mobile food vendor's hours of operation . Portable restroom facilities are not permitted . No mobil e food vendor engage in any mobile food vend ing unless the mobile food vendor or its customers have perm ission to use an approved and readily ava ilable toilet and hand washing facility that is located within 200 feet trave l d istance from the mobile food vending location . If the to ilet and hand washing facility is privately-owned , the mobile food vendor must obtain written permiss ion from the owner or authorized agent, and a copy of the written permission must be kept in the motorized vehicle use for mobile food vending and ava ilable for inspection at all times. The mobile food vendor must clearly post on the motorized veh icle, a notice stating that: ( 1) a toilet and hand was hing facility has been made available as required by th is section ; and (2) the location of that facility. 4-13-8: TRASH RECEPTACLE REQUIREMENTS : Each motorized vehicle used for mobile food vending must be equipped with a trash receptacle of a size adequate to accom modate all trash and refuse generated by such mobil e food vend ing . Each mobi le food vendor must p ick up and deposit in the trash receptacle on the vehicle any paper, cups , wrappers, litter, or other refuse of any kin d which was a part of the goods or merchand ise supplied from the motorized vehicle and which has been left or abandoned within 25 feet of such motorized veh icle on any public or private property other than in a trash receptacle provided for such purposes. No mobi le food vendor may dispose of any trash or refuse in any such publ ic or private trash receptacle other than a trash receptacle owned , operated , or otherwise provided by and under the control of such mobile food vendor. 4-13-9: PRIVATE PROPERTY MOBILE FOOD VENDING REQUIREMENTS: Mobile food vendors a re proh ib it ed on private property unless explicitly permitted by the Zoning Code or the vendor is operating pursuant to a val id permit issued by the C ity for a specia l event.
