ASSESSMENTS FOR FISCAL YEAR 2019-20
RECOMMENDATION:
It is recommended that the City Council :
1 . Rece ive presentation from staff;
2 . Open the public hearing ;
3 . Receive public input;
4 . Close the public hearing ;
5 . Adopt Resolution No. 19-5402 , ordering the levy and collect ion of assessments for
Fiscal Year ("FY ") 2019-20 .
BACKGROUND:
1. On June 19 , 1979, the City Council of Temple City adopted Resolution No. 79-1825
forming the Temple City Citywide Lighting and Maintenance District (District) and
confirmed assessments for the first time in FY 1979-80 .
2 . On April 23 , 1995 , after giving direction to staff to analyze the assessment
methodology, the City Council received an Executive Summary that exp la ined the
recommended methodology changes and provided examples of the effects of the
different alternatives . The City Council directed staff to make the approved
changes to the District for the FY 1995-96. Notices were mailed to all property
owners outlining the changes to the methodology and stating the assessment
amount proposed for each property and that a Consumer Price Index (CPI)

escalator was included in the District. The changes were approved after a formal
public hearing .
3. On November 5 , 1996, California voters approved Proposition 218, also known as
'The Right to Vote on Taxes Act ". The City was able to continue to levy
assessments at the current rate for the Citywide Lighting and Maintenance District
since Proposition 218 allowed certain exemptions for existing assessments.
However, any increase in the assessment, including the addition of a CPI
escalator, would require a ballot be mailed to each property owner subject to the
assessment, and that a majority of property owners returning their ballot must
approve of the increased assessment. Further, Proposition 218 required that the
local agency distinguish between general and direct benefit and shall only assess
for direct benefit. At that time, the parks assessment was considered to be a
general benefit.
4 . On July 1, 1997 , the City discontinued assessments for park maintenance
operations . The park maintenance program is currently funded through the
General Fund.
5. Pursuant to the 1972 State Lighting and Landscape Act , an engineer's report must
be prepared for each fiscal year in which assessments are levied and collected for
the City's Lighting and Maintenance District. The engineer's report identifies
eligible program expenditures, establishes the Lighting and Maintenance District's
operating budget , updates individual property assessments , and documents the
City's compliance with all applicable laws .
6 . On April 16, 2019 , the City Council adopted Resolution No . 19-5391 ordering the
engineeri ng firm of Harris & Associates to prepare the required Engineer's Report
for FY 2019 -20 , pursuant to the 1972 State Lighting and Landscape Act. The
engineer's report identifies eligible program expenditures , establishes the District's
operating budget, updates individual property assessments , and documents the
City's compliance with all applicable laws .
7 . On June 4 , 2019 , the City Council adopted Resolution No . 19-5399 , declaring the
City 's intention to levy and collect Lighting and Maintenance District assessments
for FY 2019-20 and establishing the time and place for hearing public objections.
8 . On June 6 , 2019 , an amended notice declaring the City 's intention to levy and
collect Lighting and Maintenance District assessment for FY 2019-20 was
published in the Temple City Tribune .
ANALYSIS:
The Landscaping and Lighting Act of 1972 allows the establishment of assessment
districts by cities for the purpose of providing certain public improvements which include

construction , maintenance and servicing of street lights , traffic signa ls, landscapi ng , and
park and recreation faci li t ies . The 1972 Act also requ ires that maintenance
assessments be levied acco rding to direct benefit rather than according to assessed
value .
The C ity Council formed the Temple City Citywide Lighti ng and Maintenance District on
June 19 , 1979 and confi rmed assessments beginn ing in FY 1979-80 . Ea c h fi sca l year,
the C ity Counci l considers a resolution to levy and collect assessments necessary to
f und exist ing District programs .
Utiliz ing the d irect benefit assessment methodo logy established in 1995 , each year the
City supp lements revenue generated by the existing District to finance the cost of
providing maintenance and operation of a street li ghting system and to cover the costs
of providing maintenance and operation of the traffic signals in the City. These
assessme nts also cover the cost of mainta in ing t he med ian and parkway la ndscap ing in
the City.
Annual Program Cost Summary and Budget Deta il
The Landscap ing and Lighti ng Act of 1972 requ i res the preparation of an Engi neer's
Report each f iscal year for wh ich assessments are levied and collected . In general , the
Engineer's Report determines eligible program expend itures , updates i ndividual
property assessments , and docu ments the C ity's compliance wi t h a ll applicable laws .
Assessment Rate Formulas
The Ad Valorem tax (i.e ., ta x based on the assessed valu e of real estate o r personal
property) revenue is used exclus ively to fund the street lighting program , traffic s ignals ,
and related capital improvements .
All resident ial properties are equally assessed for Ci tywide maintenance p rog rams .
Commercia l, industrial and i nstitutional property assessments are determi ned by total
a rea (ac reage ) based on an equivalent dwell i ng unit (EDU ) formula . T he ave rage
s ingle-fami ly res idential pa rcel i n Temple City is approximate ly 7 ,200 square feet or one
(1) EDU , w hich is approximately six parcels per acre . The refore , comme rcial , industrial
and institutional properties are assessed at an amount equa l to s ix res identia l parce ls
per acre . Church properties are assessed 75 % of the commercial rate , wh ich is
equivalent to 4.5 EDU 's per acre .

C ITY STRATEGIC GOALS:
As a result of the City Counci l accepting the Eng ineer's Report for the Temple C ity
Citywide Lighti ng and Maintenance District for FY 2019-20 and adopting Resolution No .
19-5402, the City will further the Strategic Goal to promote Good Governance.
FISCAL IMPACT:
Approval of th is agenda item will allow the City to continue the process to set the
assessment rates for the FY 2017-18 Lighting and Maintenan ce District and generate
an estimated $330,000 in assessment revenues . The General Fund will supp lem ent a
portion of the remaining costs of approximately $396 ,000 providing fund i ng for the
citywide street l ighting , tree maintenance, and traffic signal maintenance programs .

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY , CALIFORNIA , ORDERING THE LEVY AND
COLLECTION OF ASSESSMENTS FOR FISCAL YEAR (FY)
2019-20 WITHIN THE CITYWIDE LIGHTING AND
MAINTENANCE DISTRICT, PURSUANT TO THE STATE
LANDSCAPING AND LIGHTING ACT OF 1972 AND
AUTHORIZING THE ADDITION OF SPECIAL
ASSESSMENT FEES TO THE TAX BILLS
WHEREAS, the City Council of the City of Temple City , on June 4 , 2019 , adopted
Resolution of Intention No . 19-5399, to levy and collect assessments for FY 2019-20
within the Citywide Lighting and Maintenance District, which reso lution was published as
required by law and witnessed by proof of publication on file in the office of the City Clerk ;
and ,
WHEREAS, the City Council has received and considered evidence , including oral
and written testimony regard i ng the jurisdictional facts in this proceeding and the
necess ity for the proposed work and benefits to be derived therefrom ; and ,
WHEREAS, the City Council has the authority to establish and order the collection
of the proposed assessments ; and ,
WHEREAS, the County of Los Angeles is respons ible for enter ing special
assessment fees on the tax bills , which the County collects on the City's behalf pursuant
to the general services agreement between the City of Temple City and County of Los
Angeles and in accordance with Government Code Sections 51800 and 29304 ; and ,
WHEREAS, under the terms of sa id agreement, the City of Temple City requests
the County of Los Angeles enter the City's special assessment fees on the tax bill s for the
City.
NOW, THEREFORE , the City Council of the City of Temple City does hereby
resolve as follows :
SECTION 1. The City Council of the City of Temple City approves the report filed
by the engineer.
SECTION 2. The publ ic interest and convenience require the ordering of the levy
and collection of assessments for FY 2019-20 . Therefore , the City Council hereby orders
the levy and collection of assessments within the Citywide Lighting and Maintenance
Distr ict.

SECTION 3. The adoption of this resolution constitutes the levy of the assessments as
set forth in the engineer's report for FY 2019-20 .
SECTION 4. The City Clerk is hereby authorized and directed to file a certified
copy of the diagram and assessment with the Auditor of the County of Los Angeles no
later than the third Monday in August 2019 .
SECTION 5. The City Council hereby requests the County enter City special
assessment fees collected by the County on the City's behalf, on the tax bills for the City.
SECTION 6. The City Clerk shall certify to the passage and adoption of this
res olution .

PART I-OVERVIEW

The purpose of this report is to se t forth f ind ings and engineering analysis f or the Temple City Citywide
Lighting and Maintenance District for the 2019-20 fisca l yea r . Thi s District, utilizing direct benefit
assessments, (1) supplements reve n ue generated by t he existing 1919 Act Temple City Municipal Lighting
District to f inance the cost of p rovidin g ma intenance and operation of a str eet l ighting system and covers
t he cos t s of pr oviding ma intenance and operation of t he traffic sig n als in the Ci ty, and (2 ) covers the costs
of main ta ining the median and parkway landscap ing in the City of Te m ple Ci ty.
The City Council of Temple City adopted Reso lution No . 79 -1825 on Ju ne 19, 1979, which formed the
Temple Ci ty Citywide Lighting and M aintenance District and confirmed assessm ents for the fi rst fiscal year,
1979-80.
Fo llowin g t h e complet ion of the Di strict proceeding s for FY 1994-95, the City Council direct ed staff to
analyze the assessment methodology. Th e purpose of t he st u dy was to ver ify that properties were being
assessed i n proportion to the benef it received . An Exe cutive Summary exp lai ning the findings, detailing
recommende d methodology changes, and providing exa mple s of the effect s of the different alternatives
was compl et ed and submitted to the City Council.
On April 23,1995, the City Cou n cil received the Executi ve Summary, app roved t he recommended changes,
and dir ect ed staff to make the approved change s to t he District fo r FY 1995-96. Notices were ma iled to
all p roperty owners outlining the changes to the methodology, and stating the assess men t amount
proposed for each prop erty and t ha t a CPI escalator was included in the Dis trict. The changes were
app roved after a formal protest hea ri ng which wa s held prior to th e passage of Proposi tion 218.
Following the p assage of Propos ition 218 in November, 1996, t he City has been ab le to cont inue to levy
assessment at t he cur ren t rate si nce Proposi tion 218 allowed certain exemptions for exist ing
assessm ents. However, the City ado pted the inclu si on of a CP I escalator pri or to the passage of Prop . 218
and any in crease in the assess ment, inclu ding the addition o f a CPI escalator, wil l requ ire that a ballot be
ma il ed to each p roperty owner su bject to the assessme nt, and that a majority of property owners
(weighted by asses sm ent amount) r eturning their ballot must app rove of the increase in the
assessment. In add ition, any other change s needed to comply w ith the requirements of Propositi on 218
would have to be made at that ~im~
Th is r eport reflects those changes and covers the levy of annual assessments for the 2019-20 fiscal year.

PART II-PlANS AND SPECIFICATIONS

The installation of planting. landscaping, irrigation systems, lighting and the construction of appurtenant
facilities to be operated, serviced and maintained w ithin the City of Temple City, is generally described as
follows:
The facilities to be constructed, mai ntained and serviced are the st reets and sidewalks within the District,
includi ng street lighting, traffic signals, street trees, med ian and parkway, landscaping and hardscaping.
The District will supplement revenue generated by the exist ing 1919 Act Temple City Municipa l Light ing
District, and will fund costs in con nection with the District maint enance and servicing including. but not
limited to, personnel, electrical energy, water, materials, contract ing services, and other expenses
necessary for the satisfactory operation of these facilities. Reference is made to Part IV of this report for
a discussion of the Zones of Benefit and the fac ilities associated with them wh ich are serviced and
maintained. The improvements are described as follows :
Landscaping and Appurtenant Facilities
Facilities include but are not limited to: Landscap ing, planting, shrubbery, trees, irrigation systems,
hardscapes, fixtures, sidewalk maintenance resul tin g from landscape growth and appurtenant facilit ies ,
in public street and sidewalk r ights-of-way, medians, parkways and dedicated easements w ithin the
boundaries of the District .
Lighting, Traffic Signals and Appurtenant Facilities
Facilities include but are not limited to: Poles, fixtures, bu l bs, conduits, conducto rs, equipment including
guys, anchors, posts and pedesta ls, metering devices and ap purtenant facilit ies as req uired to provi de
lighting and traffic signals in public street and sidewalk r ights-of-way and ded icated easements within the
boundaries of the District .
The public lighting system shall be maintained to provide adequate illumination. The traffic signal system
shall be ma intained based on the City spec ifi cations and current i ndustry standards . Electricity for street
light s and traffic signals sha ll be furnished, and it shall be adequate f or the i ntended purpose. Rates for
power shall be those authorized by the Cal ifornia Pub lic Utilities Commission .
Maintenance means the furnishing of services and materials for the ordinary and usual operat ion,
maintenance and servicing of the landscap ing, public light ing facilities and appurtenant facilities within
the public street right-of-way, including repair, removal or repla cement of all or part of any of the
landscaping, public lighting facil ities or appurtenant fac i lities; providing for the life, growth, health and
beauty of the landscaping, including cultivation, irrigation, trimming, spray ing, fertiliz ing and treating fo r

disease or injury; the remova l of trimmings, rubbish, debris and other solid waste; and the cleaning,
sandb lasting and painting of walls and other improvements to re move or cover graffiti.
Servicing means the furnishing of wa t er for the irrigation of the landscap ing and the maintenance of any
of the public lighting facilities or ap purtenant faci lities within the street right-of-way and the furn ishing of
elect r ic energy for the public lighting facilities, landscaping or appu rtenant facilities .
The plans and specifications for the improvements, showing the general nature, location, and extent of
the improvements, are on file in t he office of the City Clerk and are by reference herein made a part of
this report.

The 1972 Act requ i res that a special f und be setup for the revenues and expenditures of the Distr ict. Funds
raised by assessment shall be used only for the purpose as stated herein. A contribution to the District by
the City may be made to reduce asse ssments, as the Ci ty Council deems appropriate. Any balance or
deficit remaining on July 1 must be carried over to the next fiscal year.

GENERAL
Pa rt 2 of Division 15 of the Streets and Highways Code, the Land scap i ng an d Lighting Act of 1972, permit s
the establ ishment of assessment districts by ci t ies for t he purpose of providi ng certain public
improvements which includes the construction, maintenance and servicing of street lig hts, traffic signals,
landsca ping, and park and recreational facilities .
Section 22573, of the Lands capi ng and Lighting Act of 1972 requi res that maintenance assessments be
levied accord ing to benefit rather than acco rding to assessed va l ue . This section states:
"The net amount to be assessed upon lands within an assessment district may be
apportio ned by any formula or method which fairly distributes the net amount among all
assessable lo ts or parcels in proportion to the estimated benefits to be received by each
su ch lot or parcel from the improvements. N
Because assessments are lev ie d on t he basis of benefit, they are not a tax, and, theref ore , are not
governed by Article XIIIA of the Californ ia Constitution.
The Act permits the desi gnation of zones of benefit within any individual asse ssment district if "by rea son
of va r iations in the nature, location, and exten t of the improvements, the various areas wil l receive
different degrees of benefit from t he improvements ." (Sec . 22574). Thus, the 1972 Act req uires the levy
of a true "benefit as sessment" rather than a "special tax ."
The Act also permits certain parcels to be exempt from assessment. Excepted from these assessments
are areas of all publicly owned pr operty such as: public streets, pub li c avenues, public lanes, public roads,
p ub lic drives, public courts, public alle ys, all public easements and ri ghts-of-way, all public p ar ks, green
belts and parkways, and all public property being used for public purposes, as well as utility owned
property since they do not receive a benefit from the improvements. Also excepted from these
assessments are common areas in multiple lot/unit developments; undeveloped lots and parcels that are
of such size and/or configuration an d location tha t the City's cu rrent zoning and subdivision laws prohibit
beneficial development and usage.
PARCEL CLASSIFICATION
All parce ls in the City ofTemple City derive special benefit from t he street lighting and traffic signal system,
general land scape ma i ntenance in the streets and sidewalks, arterial highway median maintenance on

maintenance on Las Tunas Drive (City Center Parkway Im provem en t s). The intent of this report is to
establish a methodology that fairly di stributes the cost in relation to the special benefits received .
• Residential -All residential uses are asses.sed 1 EDU per dwelling unit.
• Commercial/Industrial -Commercial, Industrial and Institutio na l parcels are converte d to EDUs
based on the lot size of eac h par ce l of land . In converti ng these properties to ED Us, the factor used
is the City of Temple City's ave rage single family residen t ial lot size of 7,200 square feet, which is
approximately 6 lots per acre. Therefore, commercial/industrial parcels are assessed six (6) EDUs
per acre.
• Churches -The City Council has ordered that ch urch-owned properties receive a 25 percent
re duction to the assessme nt r ate. Therefore, chu rch pro perties with resi dential uses are assessed
0. 75 ED Us per dwelling unit. All other church prope rties are assessed 75 perce nt of the
commercial/industrial rate, which calculates to 4.5 EDUs per acre .
The land use classification for eac h parcel has been based on the Los Angeles County Assessor's Roll .
SPECIAL BENEFIT DETERMINATION
Property values in a community are individually increase d when public infrastructure such as street lights
and traffic signals, and landscaping facilities are in place, improved, operable, safe , clean and maintained.
Street Lighting and Traffic Signals
The proper functioning of street lighting and traffic signa ls is im pe rative for the welfare and safety of the
public and property throughout the City. Proper maintenance and servicing of the street lighting system
benefits properties within the District by providing proper illumination for ingress and egress and safe
traveling at night. Properties within t he District also benefit from the proper functioning of the District's
t raffic sig na l system . Proper op eration of the street light and t raffic si gna l systems is imperative to pub lic
convenience, orderly traffic flow, enh anced congestion managem ent and safety. Improved security, fuel
conservation, protection of property from crime and vandalism, and reduction of traffic accidents, are
spec ia l and direct benefits to all properties within the City; l ighting benefits are directly related to public
safety and property protection and therefore increase property values.
Street Landscaping
The City ma intains trees and miscellaneous shrubbery throughout the City . The trees and sh r ubbery are
located within the public right-of-way . These trees and sh rubbery provide an aesthetically pleasing
environment, shade, beautification, and accord ing to some authorities, air purification and sound
attenuation. These positive attributes increase the value of all properties throughout the Ci ty.

within the District.
City-wi de Benefits within the District include landscape maintenance throughout the City, the operation
and maintenance of traffic sign als , and street lighting and median ma intenance on the ma jor
thoroughfares , whic h are the main trave l ways of the City.
Local Bene fits
• Local Light ing
Streetlights adjacent to or near a parcel of land provide a special and di rect Loca l Benefit to that
parcel. Th is i ncludes added security, reduction in traffic accidents and increase d aesthet ics benefi t
the surrounding parcels and thereby enhance the value of th e parcels .
All parcels with streetlights in t heir vicinity rece ive a Local Benefit .
• Rosemead Boulevard and Las Tunas Drive Medians
These improvements are located al ong Rosemead Boulevard, f rom Broadway to Hermosa , and Las
Tunas Drive, from Muscatel to Su ltana, and consist of median improvements including
landscap i ng, irrigation and hardscape .
The improvements are located on major arterials , and therefore provide benefit to all parce ls
wi thin the City. However, the commercial properties di rectly adjacent to these improvements
receive a direct Loca l Ben efit in addition to the Citywide Ben efit, due to economic enhancement
r elating to parkway beautificat ion and increased desirability of the su rroundings which provides
additional incr eases in property value as a result of the improvements .
Because the improvements provide a Citywide Benefit and a Local Benefit, it is proposed that the
costs f or maintaining and servici ng these improvements be divided so that half of the cost is spread
Citywide and half of the cos t is spread to the loca l area of benefit.
• City Center Parkway Improvements
These improvements are located along Las Tunas Drive, from Cloverly to Kauffman, and consist of
pa rkway improvements inclu ding ra ised planters, automatic irrigation, street trees, decorative
lighting fixtures, tree grates, bench es, and hardscape .
Since City Center Parkway is a major arterial, the l andscaping provides benefit to all parcel s within
the City. However, the commercial properties di rect ly adjacent to these improvements re ceive a

parcels abutting the Rosemead Boulevard/Las Tunas Drive medians. They are assessed the Rosemead
Boulevard/Las Tunas Drive Media n Local Benefit, as well as the Ci tywide Benefits and direct Local Lighting
Benefit.
Zone D -City Center Parkway Improvements. This zone includes commercial parce ls abutting the City
Center Parkway Improvements. They are assessed the City Cente r Parkway Improvement Local Benefit,
as well as the Citywide Benefits and direct Local Lighting Benefit.
