CALL TO ORDER

The November 17, 2006, "Brown Bag" Work Session was convened at 12:05 P.M. by Mayor
John Landwehr.
ATTENDANCE
The following Council Members were present when the meeting convened:
Present: Brown, Crane, Ferguson, Harvey, Klindt, and Oetting
Absent: Berry, Layton, Pope, and Vogel
A quorum was present.
DISCUSSION OF AGENDA ITEMS
Meetings & Events:
Councilman Kevin Brown asked that if the Council would like to have a Finance Committee
meeting to let him know.
Bills:
2006 -71 - Mayor John Landwehr suggested withdrawing this Bill which is on the Informal
Calendar as well as Resolution RS2006 -18 which has been tabled. This would allow time
for more council and public input into the issue. Councilman Ferguson agreed that would
be a good idea.
2006 -83 - Councilman Brian Crane stated he was not sure if he would be voting on this
Monday night or not. He is waiting for some legal opinions on the matter.
Presentations:
Parks & Recreation Director Bill Lockwood was asked to make a presentation Monday night
under "Invited Guests" to talk about the two portions of the greenway trail which will be
added by the passage of Bills 2006 -93 and 2006 -94.
Resolutions:

RS2006 -22 - Mayor John Landwehr explained how this came about through the
Administration Committee and who all will be on the Committee. He suggested that the CVB
appointments be amended by removing "from their members" from the language appointing
a CVB representative.
Closed Session:
The City Clerk was directed to add "litigation" to the topics to be discussed in Closed
Session.
New Business:
Councilman Kenneth Ferguson stated that the Human Relations Commission is interested
in allowing people who live outside the City to be members of that board.
Councilman Kevin Brown stated he has been reading the City's code regarding
emergencies, and that any kind of emergencies beyond water emergencies is pretty
unclear. He suggested that the city re- evaluate its emergency preparedness code.
EMERGENCY EXERCISE PARTICIPATION
The following occurred in connection with the emergency preparedness exercise which is
being carried out today involving several different entities. The actions taken are simulated
for purposes of the exercise:
Ms. Susan Green read the scenario and then made a formal request to declare a state of
emergency. City Counselor Nathan Nickolaus answered questions about how this would
apply in a real emergency situation. A motion was made by Councilman Brian Crane,
seconded by Councilman Dan Klindt, that a state of emergency be declared and that the
Mayor be given the powers stated in the document which was provided by Mr. Nickolaus
and Ms. Green. The motion was approved unanimously by the following roll -call vote:
Aye: Brown, Crane, Ferguson, Harvey, Klindt, and Oetting
Nay: None
Ms. Green left the meeting at this point.
Back to Brown Bag meeting topics:
Adiscussion was held on the two ordinances being introduced regarding the burn ban issue
which was submitted by petition to the city. Mr. Nickolaus was asked to find out if the 60
days given to the Council for action began when the petition was filed, or when it was
verified by the City Clerk. The Council would like that information before Monday's meeting.

Mayor John Landwehr asked staff to simplify the sunshine law resolution to merely adopt
the state law by reference. He suggested that the resolution which is on Monday night's
meeting could be adopted, but that the next resolution might be simplified so it would
remain current.
