HomeMy Public PortalAbout1992-12-08 Special MeetingCOUNCIL MINUTES SPECIAL, MEETING - DECEMBER 8, 1992 The special meeting of the Bal Barbour Village Council was held on Tuesday, December 8, 1992 in the Council Chamber of Bal Harbour Village Hall. The meeting was called to order at 5:05 p.m. by Mayor Stern. The roll was called and those present were: Also present: Mayor Estelle Stern Councilman Matthew B. Blank Councilman James E. Boggess Carole S. Morris, Village Manager Jeanette Horton, Village Clerk Richard J. Weiss, Village Attorney Absent: Assistant Mayor Andrew R. Hirsch' Councilman Sol M. Taplin As a quorum was determined to be present, the meeting commenced. 2. Ordinance - First Reading: An Ordinance was read, by title, by the Village Clerk, amending Section 14(bl of the Village Charter to allow the election date for Village Elections to be set by the Village Council and providing requisite ballot language. Mr. Weiss explained the amendment to the Council. The amendment would add to Section 14 (b) of the Charter the language" or on another date in April in any particular odd -numbered year as may be designated by a majority vote of the Village Council." He then proceeded to explain the ballot question as it would appear on the ballot for the voters. Councilman Blank questioned if the Village could go to court to have the date of the election changed. Mr. Weiss explained no, the reason being the division of church and state. A motion was offered by Councilman Boggess and seconded by Councilman Blank to enact this Ordinance. There being no further 'discussion, the motion carried with the vote as follows: Mayor Stern aye; Councilman Blank aye: Councilman Boggess aye; Assistant Mayor Hirschl absent; Councilman Taplin absent, and this Ordinance was approved on first reading as AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA AMENDING SECTION 14(b) OF THE VILLAGE CHARTER TO ALLOW ELECTION DATES FOR VILLAGE ELECTIONS TO BE SET BY THE VILLAGE COUNCIL: PROVIDING REQUISITE BALLOT LANGUAGE; PROVIDING FOR SEVERABILITY. INCLUSION IN CHARTER AND AN EFFECTIVE DATE. Other Business: Councilman Blank questioned the process, on rebuilding the Jogging Path. Mrs. Morris explained she i waiting for the permit to be issued by the State Department of Natural Resources. Councilman Blank explained to the Council what had transpired at the Architectural Review Board meeting he attended in reference to the request by the Sheraton Bal Harbour for approval to install a chain link fence. Mrs. Morris explained to the Council the Board deferred the application. She further stated that she has requested that the Sheraton have the trailer that is parked in this area be removed by December 15th. Councilman Blank explained the civil violation the Balmoral and the electrical contractor had received for installing outside light fixtures without a permit. Mr. Weiss explained the code that the penalty to a contractor is $200 or double the permit fee. whichever is greater but to the homeowner the penalty is $100 or double the permit fee. whichever is greater. Councilman Blank stated the Balmoral is well maintained and has never knowingly violated the code. Mrs. Morris stated that there is no provision for the penalty to be waived. 4. Adjourn: There being no further business to come before the Council. a motion was offered by Councilman Boggess and seconded by Councilman Blank to adjourn.
