HomeMy Public PortalAbout04/23/1951Minutes - meeting April 23, 1951, Town of Gulf Strre m Council At a meeting of the Town Commissioners of the Town of Gulf Stream, Florida held on April 9, 1951, it was voted but not recorded to hold a secondary meeting to discuss certain matters. At the meeting held this day there were present: lviayor Commissioner L. Seton Lindsay, Vice Mayor Commissioner N. J. Clarke, ,.. Town Clerk Commissioner Wm. J. Bauer and Mr. Alexander B. Royce. The minutes of the meeting held on April 9th were not read as this was considered a continuation of said meeting. There was brought to the attention of the Town Commission a letter received from Mr. Robert G. Leonard relative to the action, conduct, and condition of Officer E. W. Cooper when stopping Mr. Leonard for reckless driving. Mr. Leonard posted a X10.00 bond for appearance in court on March 29th, but did not show up and said bond was forfeited. It was also discussed at this meeting comments received from others on the conduct and condition of Officer E. jy. Cooper. Mayor Commissioner L. Seton Lindsay repmrted to the Commissioners present that he had a serious talk with Officer E. W. Cooper relative to the above and the C �nmissioners voted that Officer E. W. Cooper be retained under probation. The Commissioners voted that should any further incidents occur relative to the above, that Officer E. W. Cooper be dismissed. It was unanimously voted that a copy of the above paragraph be forwarded is Officer E. W. Cooper C Quite a lengthy discussion was held relative to Garbage Collection this summer and next fall. Before making any definite arrangements, it was voted that the Mayor Commissioner and Vice Mayor Commissioner have a: talk with the present truck driver, Robert Pollack, relative to wages, hours and work to be.done. Discussion was held relative to a proposal Mayor Commissioner L. 3eton Lindsay had received from a Protective Agency in which it was stated that if a certain number of residents of the Town of Gulf Stream, Florida would subscribe to their service, they in turn would agree to police the Town of Gulf Stream for a certain fee and number of hours according to agreement read. The Commissioners unanimously voted,that no action bgel4i @$ at this meeting but that when said agency had made sufficient /contracts in this Town, that their proposition again be reviewed. The Commissioners unanimously approved altering that portion of the tail gate that a present drops don on hinges, so that it be split in two and hinged on both ends or sides, making it easier for the truck driver to shut in the back end. Letter addressed to Municipal Judge Johnston, received from Mr. Robert G. Leonard, relative to action and conduct of Police Officer E. P,'. Cooper together with reply from Judge 'Johnston, is attached as part of these minutes. ( ) There being no further business, the meeting was adjourned. March 319 1951 Municipal Judge Johnston Town of Gulf Stream Florida Dear Sir: After spending an enjoyable three week vacation touring Florida wit-1i ,.V family, I was headed home on State Highway AIA in your town on I-larch 249 1951. On that date I was stopped by a Gulf Stream 1,atrol car and accused of reckless driving, a chaZ;e which I categorically deny. However neither the charge nor the resultant ten dollar "bond" is the basis for this letter of protest. Rather, it is because the accusing patrolman was so obviously intoxicated. In support of the above statement, I submit a number of facts: 1. The patrolman was totally unable to read aW clearly typed name and address on ray drivers license and had to depend upon my verbal spelling. 2. His great difficulty in reading the tir:e from his watch. 3. His inability to read the large letters and numbers on my license plate at a distance of five feet. 4. The strong odor of alcoholic beverE.ge on his breath. 5. His four time repeated (and thrice forgotten) question as to the state reyresented• by -.y license. 6. The drunken scrawl evident on the laboriously written surmmns. (Photostat enclihsed) This letter is addressed to you not only i(t� explanation but also to make certain that the ten dollar bond is Belk ed to the town treasury instead of being used to sustain the patrolman's alcoholic breath. By copy I am advising the Florida State Police of the situation and further state t: at I,, and a passenger witness, will be glad to forward notarized statements if desired.
